  • The right to take collective action in EU law based on the European Pillar of Social Rights and the recent case law of the CJEU

    This paper is built around the workers’ fundamental right to take collective action and collective bargaining. Although, this right is firmly embedded in the majority of labour law systems in the social policy (meaning labour law, too) of the European Union, it is worth analysing it separately with an independent meaning. We can approach this right from the fundamental rights, the fundamental treaties or from certain directives, so we can find several questions that are difficult to answer properly. These problems are mostly catalysed by the necessary collision between the need for socially motivated legal protection and the fundamental economic freedoms. In my research, I analyse this right – along with some other connected ones – with the help of the recent case law of the Court of Justice of the European Union and the European Pillar of Social Rights because the latter highlights the holistic approach in the current reforms of EU social policy.

    The aim of the paper is to give an overview of the pathfinding process of the copyright law, and of the European and Hungarian endeavors in favour of the sustainability of the copyright law via the copyright specific aspects of sustainability. It then aims to summarize the achievements of the harmonization process and draw attention to the goals to be achieved. The topic is approached from a cultural economic perspective. The main topic is described via historical and current aspects of the balance search of copyright law. the paper reviews the background of the development and current situation of copyright law from the point of view of philosophy and fundamental rights. With the analysis of the dynamism of economic and moral rights the paper outlines the necessity of parallelism of the two parts of copyright law. The examination of competitiveness of copyright law tends to highlight the inseparability of competitiveness and sustainability and emphasizes their development as being interlinked.

  • Effects of the State Aid Soft Law on Beneficiaries: Annotation on an order of the General Court

    The European Commission issues guidelines and other soft law instruments to define the compatibility conditions of State aid to be granted by Member States with the internal market. Although the soft law is only binding on the Commission it has not negligible indirect effect on the Member States state aid policy and thereby on other policies. So far it was not clear how much beneficiaries could find remedy at European Courts against the soft law issued by the Commission. The present article gives a description on the adoption of the new energy and environmental aid guidelines with the focus on the conditions related to aid to operating aid to energy generation from renewable energy sources in the context of the State Aid modernization initiative. A comparison to the previous rules was also made. Thereafter the article summarizes an order of the General Court issued in a procedure where an applicant has initiated action for annulment of the guidelines. The article also tries to draw some conclusions about the possibilities and limits of beneficiaries and Member States to question the legality of State aid soft law instruments at European Courts.

  • The Regulation of Screening of Foreign Direct Investments in the European Union

    This paper examines the framework and cooperation mechanisms set up by Regulation (EU) 2019/452 of the European Parliament and of the Council of 19 March 2019 establishing a framework for the screening of foreign direct investments into the Union. The Regulation merely gives a framework for the coordination of national legislation, and member states can still decide if they want to set up screening mechanisms and to screen foreign direct investments. The pandemic has accelerated these processes, and more and more European Union member states enacted legislation relating to the screening of foreign direct investments in strategic branches of the economy. The Commission has also issued a Guidance at the end of March 2020, in which it warns about the risk that the Coronavirus related economic shock might have on strategic industries, especially on healthcare related industries. At the same time, recognizing the importance of foreign direct investments for the economy, it pointed out in the Guidance the necessity to find a balance between the need for foreign capital and the protection of European Union strategic industries using appropriate screening tools.

  • The Financial Supervisory Agencies of the European Union and the Question of the European Administrative Procedure

    The agency-type organs have a history of several decades in the European Union. In the last few years there were two different tendencies leading towards the establishment of regulatory (or decentralised) agencies with strong powers, especially in the field of financial supervision. The first of these tendencies was the fall of the neoliberal dogma of the self-regulating market – as a consequence of the 2008 financial-economic crisis – which led to the priorities of the decision-makers being reset in favour of a stricter regulation than that of the New Public Management era. The other tendency was that the debate about a European administrative law started to live. The European Supervisory Authorities of the financial sector, which were established after the crisis, are regulatory agencies with strong powers. However, some of their competences are so strong, that it poses questions regarding the legal protection of the participants of the market. Moreover, the case-law related to their function seems to overwrite the accepted norms of delegation of competences within the institutional framework of the European Union.

  • Impact of EU Law on National Criminal Law

    This paper aims to analyse the main linking points between EU law and national criminal law. For a long time, the criminal laws of the Member States have been heavily affected by EU law. This influence can be either negative or positive. The most lenient form of the positive effect is the assimilation principle, which does not seek to incorporate EU norms into national criminal law, only attempts to extend the latter’s applicability to the protection of the interests of the European Union. In the case of legal harmonization the Member States are required to adopt common criminal norms which aim to reduce the differences of the national criminal law systems. The most serious impact on national penal law is the supranational criminal legislation, which results not only in the approximation but the unification of the criminal laws of the Member States.

  • Balancing Work and Life: New Developments in the Field of Legal Protection of Workers

    The present study deals with the current labour law questions of balancing work and private life. The topicality of the study is supported by Directive (EU) 2019/1158 which, built on the existing legislative basis, brings several novelties in this regulative area refreshing the key elements of the criteria of equal employment referring to the employees raising children. The researched regulation fits into the high level, socially motivated; worker-protection Directive designated by the European Pillar of Social Rights, consequently, this aspect also plays a role in elaboration. In my analysis, I concentrate on the regulative background, subject of the new Directive, as well as its connection to fundamental social rights and the new norms describing the potentially strengthening legal protection of workers. I draw conclusions based on their synthesis about the predictable future effects of the new regulation.

    The organizational issues of European public administration are especially apparent when the cooperation between the EU and its Member States is considered. The regulation of administrative institutions and bodies is fundamentally a subject of national competence. The European public administration for consular protection is based on the cooperation of the organs and authorities on both levels of European public administration. It is regulated as a framework which leaves a wide range of freedom for Member States to settle the missing details and also leaves too much room for voluntarism. All this makes the system unpredictable and despite the application of the principle of loyal cooperation and solidarity, the European administrative structure of consular protection is incompatible with the rule of law and the principle of good administration, and even with the principle of loyal cooperation and solidarity.

  • The Value of Personal Data in the Competition Law Assessment of the Facebook–WhatsApp Merger Case

    The European Commission fined Facebook 110 million euros for giving misleading information within the merger procedure on acquiring the messaging service WhatsApp in 2014. The case reached a crossroad of competition law, data protection and consumer law. This was the first time the Commission imposed a fine on a company for inaccurate information since the merger regulation rules were established in 2004. Some authors criticized not only the Commission’s decision from 2017 which imposed the fine, but also the decision from 2014 in which the Commission had decided not to oppose the transaction. Some authors oppose tackling data collection issues through competition law, but some authors raise the question: is competition law enough to consider the case when personal data are involved, too? The controversial part of the decision is not about data protection law, but about the value of personal data from the perspective of competition law.

  • In Contrast: Responsibility for Environment and Regulation in Finance

    The more environmental policy comes into the focus of fiscal policies of governments, the more prevailing are the interests in it influencing the governance as a whole. In the context of the European Union, the governmental role of the Member States’ increased less for initiating the (often invoked) environmental protection but such an increase is rather an end in itself. The responsibility for environment seems to represent the bright side, while the reality of financial regulations shows the dark side of government priorities.

    The present article examines the recent case law of the Hungarian Constitutional Court as regards the constitutional framework and the judicial practice of the application of EU law. After a short overview of the early precedents, the article focuses on the case law subsequent to the adoption of the new Fundamental Law in 2012. In the recent decisions the need for cooperation with the EU Court of Justice is of special importance so the article reflects on this issue as well. The first part scrutinizes the case law concerning the constitutional limitations and control measures of the application of EU law, including the landmark decision of 22/2016 (XII. 5.). The second part focuses on the decisions delivered in constitutional complaint proceedings, which determine the constitutional requirements of the preliminary rulings procedure and the judicial obligation to give a reasoned decision.

  • The Effect of the Jurisprudence of the ECHR on the Hungarian Criminal Procedure Act

    The case law of the European Court of Human Rights and the European Convention on Human rights set the minimum level for the protection of fundamental rights that has to be guaranteed by all contracting parties, although national laws can establish higher standards. Point II of the general explanations of Bill No. T/13972 on the new Act on Criminal Procedure states that “meeting the requirements of the Fundamental Law of Hungary and the obligations of international law and EU law obviously mean a safeguarding minimum.” In Hungary the case law of the ECHR is reflected more and more both in the judgements of Hungarian courts and in the guidelines of higher courts but the difficulties of establishing interpretations in harmony with ECHR case law are common. The paper analyses the judgments of the ECHR in Hungarian cases between 2013 and 2016 related to pretrial detention, effective defence and the circumstances of restraint.

  • Legal Regulation and Practice of the Non-Material Indemnification and Rehabilitation in the United Kingdom

    The article analyzes the specialties of the English legal system with a focus on the legal regulation and court practice of tort law, and especially the non material indemnification and rehabilitation of the bodily injured. The study starts with the description of the main characteristics of the tort law, the definition and jurisprudence of non material damages, like pain and suffering and loss of amenity and psychological damages are also reviewed in detail with respective court cases. The study also gives an analysis of the connection between tort law and insurance law, how one effects the other. Nowadays the indemnification process of the bodily injured cannot be full without rehabilitation. Like in most of the Western European countries, in the United Kingdom the rehabilitation process is a complex and centrally managed procedure with the help of state institutions and programs.

The study describes, among other things, the nature of family law legislation, the conceptual approach to family and marriage, the legal protection and solution of extramarital partnerships, such as de facto partnerships and registered partnerships, and the status of children in the countries studied.

  • Fiscal Conditionality in EU Law

    This paper analyses the evolution, objectives, and instruments of fiscal conditionality legislation of the European Union. The author provides a detailed analysis of the relevant elements of the existing legislation, as well as the recent judgments of the Court of Justice of the European Union on the subject. The paper demonstrates that the Financial Conditionality Regulation is not an instrument for protecting the rule of law in general, but its general purpose is to protect the EU budget by enforcing the fundamental requirements deriving from the rule of law.

    In view of the special nature of the employment relationship, subordination of the parties results in a weaker legal position on the employees’ side. Certain guarantees of protection are absolutely necessary to compensate for this asymmetry, thus, among other things, the effectiveness of employees’ enforcement plays a key role. This is why our research seeks to answer the question whether some crucial employment-related directives of the European Union, as well as the broader European Union legal corpus also including legal practice. Furthermore we try to find the answer to the question that, how do these legal sources appear in the domestic legal practice, primarily in the relevant judgments of the Curia of Hungary, and the extent to which these references facilitate the effective enforcement of the workers’ rights.

  • Constitutional Foundations of EU Membership in Hungary Before and After the new Fundamental Law

    The paper examines the Hungarian constitutional framework which determines the relationship between domestic and EU law. The constitutional foundations changed in 2011 when the new constitution, the Fundamental Law was adopted. The former 1989 Constitution contained in Article 2/A the so-called ’European clause’ adopted before EU accession, which was referred to as the main constitutional basis of Hungary’s EU membership by the Constitutional Court. The new Fundamental Law contains a seemingly similar ’European clause’ in Article E. The paper scrutinizes the question whether the former and the new clauses are truly similar and concludes that opposite to the Constitutional Court’s point of view the new European clause should be interpreted differently from the former, which might lead to a different, less Europe-friendly approach towards EU membership.

    The case-law developed by the European Court of Justice aims to ensure consistency and legal certainty in the registration of EU three-dimensional trademarks. It interacts closely with the legislative amendments introduced by the trademark reform, which aim to make the registration procedure for EU trademarks more flexible and transparent, thanks to the European Court of Justice's work in interpreting and developing the law. The problem of the definition and registration procedure of three-dimensional marks is an important issue in EU trademark case law, as this category of marks is the most popular of the non-traditional marks for which the trademark reform provides a legal framework, but also overlaps with other forms of intellectual property protection.

  • 60th Anniversary of the European Social Charter: Some Proactive Dilemmas

    The European Social Charter is a human rights treaty of the Council of Europe. For 60 years, the Charter has been protecting the social and economic rights of citizens across Europe. During these years, the Charter has been revised and new rights have been included to take into account the challenges facing our modern societies. But the Charter has remained at the heart of the Council of Europe’s statutory goals: human rights, rule of law and democracy, which cannot be realised without respect for social rights. However, sixty years after the adoption of the Charter, and thirty years after the adoption of the Turin Protocol of 1991 reforming the supervisory mechanism, the Convention has yet to realise its full potential. In this article the Charter’s two supervisory mechanisms are analysed and some proactive dilemmas and possible solutions are outlined.

  • Judicial Review in Emergency Situations: the Relevant Case Law of the European Court of Human Rights

    Emergencies are mostly sudden, and in most cases states need special measures to deal with them. For this reason liberal democracies have standing constitutional or special legal powers to derogate human rights for the sake of order. Those democracies that do not have such powers, use impromptu ones. It is possible for authoritarian governments to abuse emergency powers in order to stay in power, to derogate human rights and to silence the opposition. Therefore it is essential for a liberal democracy to have strict limits for the duration, circumstance and scope of emergency powers. There are human rights regimes (for example: the European Convention on Human Rights) which have to respect the member states’ duty and responsibility in such cases. This article tries to examine this special case law of the European Court of Human Rights. The question is whether a European Human Rights regime is capable of becoming the guardian of human rights in cases of national emergencies, or the sovereignty of states also means that there is very narrow margin to prove legality above security?

    This paper aims to present the case law of the European Court of Human Rights (ECtHR) regarding minorities’ rights. Even though minority rights as such are not listed in the European Convention on Human Rights (ECHR), the ECtHR has developed an evolving minority rights protection under it. This paper describes the concrete cases of minority rights protection and shows how the case law evolved throughout the years. The ECtHR recognized the right to self-identification, the right to culture, the right to use minority languages, the right of assembly and the freedom of expression regarding minorities. This paper argues that there might be a shift towards a greater diversity protection in the future under the ECHR.

  • Implementation of the European Small Claims Procedure in the Member States of the European Union

    It has been seven years since the european Small Claims Procedure was introduced as a sui generis european procedure and an alternative to existing national civil procedures. However, it works in close interaction with national laws, as the regulation leaves many aspects of the procedure to national legislation. The article analyzes the legal instruments that serve the implementation of regulation 861/2007/ EC in member states, particularly the issues of mutual recognition and enforcement of ESC judgments, communication between the court and the parties, review and appeal of the judgment, and other specific issues. It concludes that knowledge of national procedural law is often vital to succeed in an ESC procedure in a foreign country. Smooth and efficient functioning of the procedure requires cooperation mechanisms not only among member states, but also among judges, lawyers, and enforcement officers.

  • The right to strike in the case-law of the ECtHR

    The right to strike has been long recognized as an important labour right in the European countries protected by constitutions and international conventions on labour and social rights. However, these international conventions mainly contain mere declarations to only pursue the right to strike and do not have an effective protection mechanism. Nevertheless, in the last few decades a human rights perspective on labour law gained ground and thus international organizations and international courts started to derive labour rights like the right to strike from civil and political rights and therefore some of these labour rights enjoy the same level of protection as the first generation human rights. In its recent judgements, the European Court of Human Rights stated that the right to strike is protected under Article 11 of the European Convention on Human Rights and developed a case law on the requirements of a lawful strike action, secondary strike actions and the restrictions of the right to strike.

  • New attempts in EU law for the improvement of the consular protection of EU citizens in third countries

    The right of EU citizens to consular protection in third countries, where their Member State is not represented, is one of the most significant rights attached to the European citizenship. With the existing legal basis laid down in the Treaty on European Union and the Treaty on the Functioning of the European Union, the right to consular protection of EU citizens has all the conceivable chances to be established uniformly by union actions and under the supervision of the European Court of Justice. The aim of the Council Directive (EU) 2015/637 is to lay down the cooperation and coordination measures necessary to further facilitate consular protection to unrepresented citizens of the European Union. Nevertheless the directive does not affect consular relations between Member States and third countries. The present paper focuses on the actions had been taken in this field from the treaty establishing the European Economic Community until the achievements of the Treaty of Lisbon and the aforementioned Council Directive.

  • The Basic Regulatory Issues of Agricultural Application of Precision Genome Editing and the Precautionary Principle

    The rapidly developing gene manipulation techniques (more recently „gene editing”) have long been controversial, which is reflected in the evolution of legal regulation in Europe. Hungaryʼs Fundamental Law (Art. XX.) clearly states that Hungarian agriculture desires to remain free from genetically modified organisms. According to the Hungarian Academy of Sciences (MTA resolution, 2017), the results of the new techniques (without transgenic implantation) are not regarded as GMOs (by the proper application of the genetic engineering law), these new techniques are not governed by the provisions of the Fundamental Law. Recently, a lawsuit was filed before the Court of Justice of the European Union in which the main question was whether GMOs should be considered the result of new techniques (if not, they do not need to be licensed). In the light of a detailed analysis of the precautionary principle, the study examines the question of whether genetic engineering or its results cover the scope of the legislation. According to the author, this question (as long as the revision of the regulation is not on the agenda) is not for the genetic technologists and plant breeders, but for the lawyers to decide. The conclusion of the study is that genetic engineering, respectively its results are subject to the regulation.
