    It has been ten decades now since the luxurious, unsinkable ship started its first and last voyage. The centenary of the tragedy has put ancient shipwrecks into the centre of attention and denoted the legal gaps and anomalies of national and international legal efforts to regulate their legal status and to protect them from treasure hunters. The essay aims to define the legal status of R.M.S. Titanic as being one of the most famous shipwrecks of our time, its story and legal situation might be the object-lesson for the problems and deficiencies of the legal issue of international protection of underwater cultural heritage, the sovereignty and ownership of historical objects found at sea and the anomalies of customary international law concerning shipwrecks.

  • The Legal Status of the Inventor in the First Hungarian Patent Act

    The first Hungarian Act on Patents was adopted in 1895. The study examines the regulation of the inventor’s legal status in this act and the problems the legislature had to solve. In the first part of the study the inventor’s rights are described regarding the inventor’s personal and valuable rights and interests. By the beginning of the 20th century license became the most important valuable right and interest, although its regulation could not be found in any act. In fact, a decision of the Patent Court in 1928 declared the regulation of leasehold valid, which raised greater and greater difficulties in legal application from the second half of the 20th century. The second part of the study examines the inventor’s obligation of payment and functioning. The latter is one of the special features of the intellectual property system which is regulated by the Industrial Property Union.

Which way the eu seems to choose? to be able to answer some of these questions preliminary studies are necessary. In order to identify the european union you must define the aim, the instruments of the aim, the characteristics, the defects and the changes of these instruments.

    As a matter of fact nowadays the most vital topic is the stabilisation role of the EU. In view of governmental methods, coordinative and regulative governmental methods usually have more stabilisation effects in the EU than financial governmental method. Owing to the crisis, the coordinative and regulative governmental methods have undergone changes. The steps that were made by the EU in the field of financial governmental method are considerable – though further actions should be taken. The financial method with stabilisation function is insufficient. The EU budget cannot play stabilisation function because of limitation of EU revenues. If the EU holds on to the dream of economic and monetary union, the EU should strengthen the tools of economic governance to be able to reduce the shortcomings of one-armed economic governance not only at EU but also at Member State governmental level. Measures taken up until now show other way: they create the vision of a more multi-speed and „multi-way” process...

  • The General Theory of the State and the Relativity of the Force of Law – Comment on the Theory of Georg Jellinek

    This paper makes an in-depth examination of the theory established by Georg Jellinek who – extending the perspective of the jurisprudence of state law based on legal methods – was concerned with issues of public law within the frames of general theory of the state. The author will demonstrate the claim that the special concepts of Jellinek’s general and descriptive theory – like the „presupposition of factual validity” or the idea of the „state’s self-obligation to law” – are the results of Jellinek’s idea that there were no alternatives to the institutional system of the constitutional monarchy.

  • The Effects of Anthropological Concept of the Legislator on the Interpretation of Law – The Conclusions of a Hungarian Research

    The paper tries to answer the question whether the principle of ’presumption of innocence’ is applied appropriately and consistently in the practice of Hungarian judges. In 2010 we studied the judicial activity of a chosen number of Hungarian judges by analyzing the text of roughly 300 judgements of Hungarian courts and by carrying out an on-line survey among Hungarian judges. As a primary result we could identify some major deficiencies concerning the application of the principle. The other lesson we learnt from the research is that serious principles play their part only if the legislator at the drafting of the law takes the actual knowledge and skills of the law applier into account.

    The study deals with the system of the impact assessment of environmental legislation in Hungary. The system can be divided into three parts, these are the environmental aspects of general impact assessment, the environmental impact assessment of legislation and the strategic environmental assessment. The aim of the study is to evaluate these tools and to draw up the possible ways of legal interpretation and development. The study offers an evaluation of the theoretical basis with consideration to a practice-oriented approach.

  • About the Costs of Public Procurements

    This study summarizes the basic types of costs which are related to public procurements and which are based on expressed legal regulations. It analyses the costs of tender documentation, the experts, the tender guarantee, the mandatory examination of the notice and the following legal institutions which are related to the legal remedies: the administrative service fee and the fine. The article compares the solutions of other countries: it examines the regulation of fees and the consideration of tender documentation. The Polish, the Austrian and the german examples show that the Hungarian legislator could improve the Hungarian regulation.

    An annotated bibliography of recent Hungarian legal science books is published regularly (twice a year) in our journal. The annotation is a short, factual description of the usefulness of the book, which, in addition to bibliographic information, defines the genre and briefly outlines the subject matter and the results presented. The authors of the annotations are members of the Faculty of Law of the University of Debrecen (lecturers, PhD students or gradual students). The current issue presents the third part of the book descriptions of books published in 2013.
