  • Additional Remarks on the Question of Civil Service Law as a Branch of Law

    The study focuses on the relationship between civil service law and labour law. In Hungary, there have been significant changes in the last decade regarding the regulation of civil service law. The types of the civil service legal relationships have increased, the forums and procedural rules for adjudicating civil service law related disputes have changed, and the number of public employees providing public services has rapidly decreased. This is of particular importance because the existence of these branches of the law is determined by legislation as well. The study concludes that the ability of civil service law to become an independent branch of law will be determined not by 'internal' developments but by legislative ambitions.

  • Organic laws and the principle of democracy in France and Spain

    During the last decades, several countries have entrenched a special subcategory of law, which is adopted by stricter procedural rules than that of the ordinary legislative process. These laws are enacted by qualified majority, by the consent of the two chambers of the legislature, and they are subject to mandatory constitutional review before their promulgation, or additional safeguards are implemented in the ordinary legislative process. In this study, I compare the experiences of two crucial legal systems, France and Spain, which provide two different frameworks of qualified law. My aim is to identify the most contested issues from the legal nature of qualified laws, and to seek the proper solutions of these issues, as well as an ideal model of qualified law. My contribution focuses on the relationship between qualified laws and the principle of democracy, and aims to open up new perspectives in this regard.

  • The International Legal Framework of Maritime Piracy

    Although maritime piracy is the oldest crime committed at sea, it is still present to this day and counts as a threat: it not only endangers human lives but also causes damage to international trade. Firm actions must be taken against this international crime and those international agreements which define the definition and the elements of conduct of maritime piracy and also contain procedural provisions to suppress it count as vital elements of these actions. Currently there are two agreements which contain anti-piracy regulations and they regulate several matters appropriately but they also have many shortcomings. In this article I examine the anti-piracy regulations of these agreements.

    The Statute of the International Criminal Court (ICC) was adopted at a diplomatic conference in Rome on 17 July 1998 and it entered into force on 1 July 2002. The ICC Statute contains rules regarding grounds for excluding criminal responsibility but this list is not exhaustive since other defences are recognized in international (criminal) law. This essay will not examine the special procedural defences and other obstacles of punishability which are explicitly rejected by the ICC Statute but focus on the substantial defences in international law: the lack of responsibility under a certain age; insanity and intoxication; justifiable defence; necessity and duress; mistake; superior orders; belligerent reprisals and military necessity.

  • The main factors influencing the level of the knowledge of law

    The paper deals with the level of legal knowledge among the Hungarian population measured with a representative survey asking questions regarding the knowledge of certain constitutional, civil, administrative and procedural legal rules releant in everyday life. Our findings are compared to a research carried out in 1965, using the same questions. Furthermore we analysed the relationship of knowledge level as a dependent variable with (i) socio-demographic (gender, age, education, etc.), (ii) media consumption (some 30 written, electronic and internet-based items), (iii) interaction with the legal system (read a law, consulted with a lawyer, participated in a trial) and (iv) civic activity. We found that the level of education is crucial, and interaction with the legal system has some additional significant impact, too. All other independent variables seem to have less significance or no impact at all. The relative strength of explanatory variables has largely changed in the past decades and in some cases even the direction of impact altered (for example women seem to be more educated about the law nowadays, in a sharp contrast to the 1965 data.)

  • Public Procurement Issues in the Field of Environmental Liability

    In public procurement, the principle of responsible management of public funds applies (Section 142 of the Public Procurement Act). This does not mean that only the techniques of fast-acting, quasi-abbreviated announcements or accelerated public procurement procedures are preferred, but on the contrary also direct tenders without general public procurement procedures are possible. The basis for efficient and transparent public expenditure at least are public procurement procedures that adhere to minimum procedural deadlines and create competition, i.e. facilitate the participation of as many bidders as possible. On the other hand, remedying environmental damage caused by third parties requires that the award of appropriate protection and remedial measures to the relevant contractors and the associated compliance with public procurement procedures do not cause delays that could contribute to extreme environmental degradation. In these cases, it is necessary to check whether there is a case of extreme urgency (imminent danger) and whether the award procedure can be omitted in whole or in part. In line with the above considerations, the present study, with reference to the Hungarian and EU regulations for public procurement, as well as comparative law with the inclusion of German and Austrian examples, examines whether the Hungarian legislator has additional leeway to prevent and quickly eliminate urgent or permanent serious environmental damage in accordance with procurement law.

  • The Right Answer to the Diesel Scandal? The latest Reform of German Collective Redress through the Eyes of Outsiders

    The aim of the article is the understanding of the development, experiences and barriers of the the German collective redress mechanisms – from the point of view of a foreign researcher. When establishing a possibility for collective redress the course of the whole procedure and almost all segments are concerned. The case known as Volkswagen-dieselgate made the issue particularly crucial. Through this case, the author  examines the new  procedure introduced in November 2018. She also gives a brief overview of the class action in the US, concluded by a settlement between the Volkswagen Group and consumers. She  tries to answer the question of whether the new law can be expected to provide an effective solution to the procedural issues that have arisen in this case. The analysis is also based on a review of previous sectoral regulation, which was  the main basis of the development of the new regulation introduced in 2018.

  • Withdrawal from the European Union: Article 50 TEU and Brexit

    The unilateral right of a member state to withdraw from the EU is an entirely new feature of EU Law introduced by the Lisbon Treaty. The practical application of the withdrawal clause was placed on the agenda as a result of the 23 June 2016 Brexit- referendum in the UK. The exit raises some non-legal and legal, theoretical and practical issues which – as we are talking about an unprecedented event – have to be elaborated on now. The paper analyzes Article 50 TEU by analytical methods, summarizing the incomplete frameworks, the main procedural rules, and those issues that require the interpretation of the Court of Justice of the European Union. The paper aims to highlight the points of the withdrawal clause that have interpretative gaps, which might not have been unintentionally left by the EU legislator.

  • Implementation of the European Small Claims Procedure in the Member States of the European Union

    It has been seven years since the european Small Claims Procedure was introduced as a sui generis european procedure and an alternative to existing national civil procedures. However, it works in close interaction with national laws, as the regulation leaves many aspects of the procedure to national legislation. The article analyzes the legal instruments that serve the implementation of regulation 861/2007/ EC in member states, particularly the issues of mutual recognition and enforcement of ESC judgments, communication between the court and the parties, review and appeal of the judgment, and other specific issues. It concludes that knowledge of national procedural law is often vital to succeed in an ESC procedure in a foreign country. Smooth and efficient functioning of the procedure requires cooperation mechanisms not only among member states, but also among judges, lawyers, and enforcement officers.

  • Changes of substantive and procedural law concerning the register of non-governmental organizations

    Provisions concerning the societies and foundations raise difficulties for judges, lawyers and judicial staff proceeding in the interest of registration of non-governmental organizations for a long time. The study examines the registration of non- governmental organizations with a view to provisions of substantive and procedural law and attempts to demonstrate problems being the cause of legal uncertainty. Finally the author puts forward a proposal for correction of regulation concerning the non-governmental organizations and suggests introducing methods in the interest of predictable application of law.

  • Public Hearing as a Safeguard of Fair Trial in Criminal Proceedings

    The primary aim of my paper is to examine the questions related to the institute of public hearing. As we know, publicity is one of the most important safeguards of fair trial in criminal procedure. In my opinion, it is necessary to examine these procedural questions in a scientific depth in the light of both the case decisions of the High Courts and the practice of the European Court of Human Rights. The study examines one of the important pledges of a fair trial, the effectiveness of the basic principle of publicity in the criminal procedure. It explores the principle from a dogmatic point of view, and also in the light of both the European standards and the regulations currently in force. It mentions the limitation and exclusion of publicity, and the legal consequences of violating publicity in a great detail. Classic legal institutes are shifted into new dimensions by the technical improvements of the modern world and the media broadcasts from courts, and the paper points it out that for the sake of having an undisturbed court hearing and verification, some modifications on certain legal regulations may be justified. The study also mentions the standpoints of legal literature regarding the notion of publicity in detail, and by summarizing them it attempts to define the notion of the given basic principle as per aspects of law science, considering the characteristics of the 21st century. After the establishment of law theory principles, besides introducing the regulation in force and touching upon court practice, my paper analyzes questions that are more and more current, especially due to the reports by the electronic media, which sometimes cannot only disturb the order of the court, but also the procedure of verification. So, after the examination of basic hypotheses and the legal institute, it draws the conclusion that the development of the legal institute justifies the modification of the procedural law in the future, especially in connection with informing the press.

  • The Beneficium Novorum in the Light of the Hungarian Procedural Reform Movements of the 19th and 20th Centuries

    The study examines the historical development of the beneficium novorum in the 19th and 20th century. This legal institution means the right of the parties to make such submissions that had not been made in first instance proceedings. Act I of 1911 (the first Hungarian code of civil procedure) made it possible without any boundaries based on the appellatio of Roman law. Act 1930 of XXXIV, however, restricted the freedom of submission in time with the enforcement of the principle of contingent cumulation. The study has a practical approach since it examines the question through archive sources and high court decisions. It argues that the application of the principle of contingent cumulation in the appeal proceedings was a successful legislative move which led to their shortening.

  • Less is Sometimes More? The Guaranteeing Role of the Scope of the Second Instance Review in the first Hungarian Code of Criminal Procedure (Act XXXIII of 1896)

    At the time of the codification of first Hungarian Code of Criminal Procedure, the legal literature regarded the limited scope of second-instance revision as a limitation of appeal in favour of the defendant, and placed it in this sense inside the procedural doctrinal system. This idea, which is quite alien to contemporary procedural thinking, which focuses on speeding up and facilitating proceedings, raises the question: what are the principles on which the limited scope of review is considered as a guarantee for the defendant? In order to answer this question, my aim in the present study is to explore the system of principles that shaped the turn-of-the-century jurisprudence concerning the legal power of the second instance to grant review.

  • Multilevel System of Fundamental Rights Protection in Practice, in the Light of the Dismissal of Government Officials without Justification

    Today, in the European multi-level and cooperative constitutional area the European Convention on Human Rights, the constitutional value provisions of the EU Treaties together with the Charter of Fundamental Rights of the EU, as well as the constitutions of the member states of the EU function as parallel constitutions. The legal remedies offered by international forums by nature are subsidiary, because it is desirable that legal issues of human rights be solved by the states at national level. The obligation of the exhaustion of domestic legal remedies as a procedural precon- dition is needed in order that the national level should have the chance to remedy the violation of human rights within its own legal system.

    The present paper focuses on Art. 8 para. (1) of Act LVIII of 2010 on the legal status of government officials, which states that the employer has the right to terminate the contract of goverment officials by two months’ notice period without any justification. The research is of considerable interest because the dismissed officials – who, in my opinion, de facto suffered injury by violation of human rights – were forced to turn to international forums because of the fact that the Hungarian legal system was not able to grant them adequate reparation. Therefore, the examination also evaluates the current level of fundamental rights arbitration and the jurisdiction using fundamental principles in Hungary.
