  • Principle of Environmental Integration – Thoughts on the 7th EU Environment Action Programme

    Integration of environmental requirements into other policies is a priority objective of the new, 7th environmental action programme of the EU. Principle of environmental integration was developed by the international environmental policy; it was inserted into environmental policy principles and into provisions of the Founding Treaty at the establishment of the EC environmental policy. The aim of the environmental integration principle harmful environmental effects, thus to serve sustainable development. Objectives of the EU sustainable development and sustainable growth strategies cannot be realized without integration of environmental requirements: integration of economic, social and environmental aspects of development can ensure the establishment of a resource- efficient, competitive economy, free from environmental degradation, improvement of quality of human life, meeting the needs of present and future generations, and preservation of natural resources which serves as the fundament for development of the other two pillars. Environmental integration is a principle provided for in the Treaty on the Functioning of the European Union, binding the decision-makers and legislators of the EU and the Member States; failure of its application might lead to judicial review and annulment of an act.

  • Integration of the Hungarian Water Utility Supplier from a Legal Aspect

    The present article focuses on the integration of water utility supplier operated public water utility supplies in Hungary. According to the new Hungarian law (namely Act CCIX of 2011 on water utility supplies), the integration is merely one element of the instruments of the decision-makers to achieve their goals. According to the preamble of the act, the goals are the followings: to establish the basic rights and obligations of water utility supply, to protect national water utility property, to provide sustainable development in water utility sectors, to fulfil the objectives of the protection of drinking water resources and to ensure the conditions of water utility supply serving the extensive promotion of consumer protection, furthermore to ensure the implementation of these objectives by detached and transparent regulations. Expectedly, the procedure will be finished only by 2016, however, the number of water utility suppliers having existed before the adoption of the new law (i. e. circa 400 suppliers) has been reduced to approximately one-tenth by begin of 2014.

    Sustainability or sustainable development as an objective or as a definitions is wirely used since the 1992 Rio Conference on Sustainable Development. There are many attempts to clarify the content of it, most of them covering inter- and intragenerational equity, integration, the different means and methods of long-term thinking. While it is still a controversial question, it is also difficult or even harder to specify the legal content of such a policy matter. The law of sustainable development shall be able to meet the challanges of clarity, enforceability, thus one should try to be more specific then it is acceptabel in the wider the political context. Several international documents, conventions, even EU legislation wants to come closer to the problem. If we wish to translate the content into the legal language, then there are some elements of such a legal system, which we would like to underline: inter-generational equity and right to environment, public participation, cooperation, integration, precaution and subsidiarity. There is also a newly emerging element of the legal understanding – imported from ecology –, which needs greater attention today, that is resilience.

    The majority of global environmental problems has remained unresolved mostly due to inadequate communication between natural and social sciences. This paper reviews the origin of the ecosystem services concept and presents the main valuation methods and emergence of that in legal terminology. The concept has ecological and economical roots thus can bridge environmental protection and development needs. It is clear that valuation and integration in decision-making of these essential ecological processes is one of the recent greatest scientific challenges.

In order to identify the european union you must define the aim, the instruments of the aim, the characteristics, the defects and the changes of these instruments.

    As a matter of fact nowadays the most vital topic is the stabilisation role of the EU. In view of governmental methods, coordinative and regulative governmental methods usually have more stabilisation effects in the EU than financial governmental method. Owing to the crisis, the coordinative and regulative governmental methods have undergone changes. The steps that were made by the EU in the field of financial governmental method are considerable – though further actions should be taken. The financial method with stabilisation function is insufficient. The EU budget cannot play stabilisation function because of limitation of EU revenues. If the EU holds on to the dream of economic and monetary union, the EU should strengthen the tools of economic governance to be able to reduce the shortcomings of one-armed economic governance not only at EU but also at Member State governmental level. Measures taken up until now show other way: they create the vision of a more multi-speed and „multi-way” process...

  • The Relationship Between Psychoactive Substance Users and Animals

    The purpose of the study is to present the wide-ranging relationship between psychoactive drug use and animal welfare based on a literature review. The relationship between drug users and animals is on the one hand under-researched, and on the other hand there are no developed protocols regarding the issue, even though the issue has significant human health and animal welfare effects. There is little awareness of how the positive health and psychological effects of animal keeping could be properly applied to the recovery of people suffering from addiction. There are encouraging initiatives, but there is a lack of a systemic approach to the issue from the side of academic life, professionals and the state, from the protocols, and from the training of people in the helping professions. In Hungary, both psychoactive drug consumption and animal keeping have a detailed and developed legal background, however, the mapping of their connections is still pending. While the literature focuses more on the aggressive actions that addicts may be prone to, practitioners tend to emphasize the supportive force that a companion animal can provide in recovery. In light of all of this, further studies on the subject are recommended, and it would be worthwhile to consider the systematic, more consistent and conscious integration of the use of animals at the legislative level and into some therapeutic protocols.

    The introductory part of the study presents the standing points related to the delimitation of typical and atypical contracts. The first part gives an overview of the debates on the integration of atypical contracts (e.g. leasing, factoring, franchise, etc.) into the Hungarian Civil Code with special regard to the fact that the proposal on the new Civil Code contains regulations on franchise contracts. The second part examines the rules on franchise contracts of the proposal which was elaborated by the Codification Committee and published in February 2012.

    The economic cooperation between the EU and EFTA states constitutes a special cooperation form in several ways: the actors of cooperation (economic integrations and their Member States), the legal and institutional framework and the budgetary relations also have unique features. In our study the rules and changes of the EEA and Norwegian Financial Mechanism, as well as the Swiss Contribution are analyzed from aspect of integration theories and financial law. In the framework of historical analysis and comparative method the financial instruments of EFTA states are compared with the EU Cohesion and Structural Funds with the help of evaluating statistical data.
