Megtekintések száma:172In this study I examined the error, one of the grounds for the preclusion and termination of punishability. Grounds for the preclusion of punishability and grounds for the termination of punishability, mean that punishability shall be precluded. Error, as an obstacle of the preclusion of punishability, doesn’t happened as usually as other grounds for the preclusion of punishability, for example: insane mental state, constraint and menace. The error means- 27. §- the perpetrator shall not be punishable for a fact, of which he was not aware on perpetration. The person, who commits an act in the erroneous hypothesis that it is not dangerous for society and who has reasonable ground for this hypothesis, shall not be punishable. Error shall not exclude punishability, if it is caused by negligence, and the law also punishes perpetration deriving from negligence. I examined how often the judge accept an error, if the person commit a crime, for example: tax fraud, practise usury, bribe somebody. Is it exceptional or not? When can the perpetrator of a crime refer to error? What examine judge?

A szerződési szabadság gazdaságszabályozó szerepe
Megtekintések száma:283The freedom of contract has an economic regulating rule, both on individual and on communal level; secures either the enforcement of the law of the self-determination of the parts, or the possibility of market participation.
Gwartney and Lawson, elaborators of the conception of the economic freedom, said that the capstones of the economic freedom are the freedom for the decisions and for the acts of the persons, moreover the volunteering of the exchange, the freedom of the competition, the protection of the persons and their properties.
Several indicators are available for measuring the economic freedom. One of them is the index of the Canadian Fraser Institute Economic Freedom of the World; furthermore it is one of the most respected indicators. This index investigates the rate of the economic freedom by using 42 factors grouped to five parts. These five components are the legal system and the protection of the ownership, size of the state, reliable, so stable valued money, the freedom of the foreign trade, the capital market and the regulation of the business. The last four items can be identified as the freedom of the contract.

A fizetési meghagyás kibocsátása iránti kérelmek közjegyzői vizsgálata
14-20Megtekintések száma:2962010 marked the opening of a new chapter inthe more than 120 years history of the Hungarian order for payment procedure. Breaking with the Hungarian traditions, the notaries became competent to carry out these procedures instead of courts. The Hungarian Chamber of Civil Law Notaries established an accessible web-based computerised system for support of procedures. The registration of requests, the assignment of cases to notaries and the administrative handling of cases are carried out through this electronic network. The legislator’s aims when modified the regulation of this legal instrument was to reduce the duration of order for payment procedures and the workload of courts. In this paper I give an overview of the content of order for payment requests and of the practical experience of the notaries in connection with the examination of requests.

A polgári eljárások egyszerűsítése az Európai Unióban, különös tekintettel a kis pertárgyértékű ügyek szabályozására
Megtekintések száma:117Introduced to reduce obstacles to the free movement of goods and persons, judicial cooperation in civil matters has become part and parcel of the new European area of justice. Creation of this area is meant to simplify the existing legal environment and to reinforce citizens' feeling of being part of a common entity. The Conclusions of the Tampere European Council state in this respect that “in a genuine European Area of Justice individuals and businesses should not be prevented or discouraged from exercising their rights by the incompatibility or complexity of legal or administrative systems in the Member States.”
At present, the judicial cooperation in civil procedures is based on the Hague Programme, adopted by the 2004 Europen Council in Bruxelles.The Hague Programme requires that the Commission should translate the Hague objectives into concrete measures. To this end, the Annex to the Communication from the Commission to the Council and the. European Parliament on the Hague Programme, consists of an Action Plan listing the main actions and measures to be taken over the next five years, including a specific set of deadlines for their presentation to the Council and the European Parliament.
The chapter dealing with this area is named „Strengthening justice”, and it includes amongst others the following tasks:
- Specific Programme on Judicial Cooperation in Civil and Commercial Matters (2007)
- Support by the Union to networks of judicial organisations and institutions (continuous)
- Creating a „European Judicial culture”
- Evaluation of quality of justice (Communication - 2006)
- Creation, from the existing structures, of an effective European training network for judicial authorities for both civil and criminal matters (2007)
The European Union has set itself the objective of maintaining and developing the European Union as an area of freedom, security and justice in which the free movement of persons is ensured. For the gradual establishment of such an area, the Community is to adopt, among others, the measures relating to judicial cooperation in civil matters needed for the proper functioning of the internal market.
The Community has among other measures already adopted Council Regulation (EC) No 1348/2000 of 29 May 2000, on the service in the Member States of judicial and extrajudicial documents in civil or commercial matters; Council Decision 2001/470/EC of 28 May 2001, establishing a European Judicial Network in civil and commercial matters; Council Regulation (EC) No 44/2001 of 22 December 2000 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters; Regulation (EC) No 805/2004 of the European Parliament and of the Council of 21 April 2004, creating a European Enforcement Order for uncontested claims; Council Directive 2002/8/EC, of 27 January 2003, to improve access to justice in cross-border disputes by establishing minimum common rules relating to legal aid for such disputes; Council Regulation (EC) 2201/2003, of 27 November 2003, concerning jurisdiction and the recognition and enforcement of judgments in matrimonial matters and the matters of parental responsibility, repealing Regulation (EC) 1347/2000; Regulation (EC) No 805/2004, of the European Parliament and of the Council of 21 April 2004, creating a European Enforcement Order for uncontested claims; Proposal for a regulation of the European Parliament and of the Council creating a European order for payment procedure; Proposal for a regulation of the European Parliament and of the Council establishing a European Small Claims Procedure.
The disproportionate cost of litigation for small claims has led many Member States to provide simplified procedures for claims of small value which are intended to provide access to justice at a lower cost, thus influencing one of the three factors that determine the rationales in dispute resolution. The details of these procedures have been investigated and documented in detail in studies prepared for the Commission. The evidence from these reports suggests that the costs and timescale associated with the domestic simplified measures, and thus their use and utility to claimants, varies widely. A 1995 study for the Commission found evidence of how costs of cross-border claims were significant compared to the size of most potential claims, and that these costs varied substantially between Member States. The total costs of pursuing a cross-border claim with a value of € 2.000 was found to vary, depending on the combination of Member States, from € 980 to € 6.600, with an average quoted figure of € 2.489 for a proceeding at the plaintiff’s residence. The study also showed that due to different and conflicting costing rules part of the costs have to be paid even by successful plaintiffs.
On 20 December 2002, the Commission adopted a Green Paper on a European order for payment procedure and on measures to simplify and speed up small claims litigation. The Green Paper launched a consultation on measures concerning the simplification and the speeding up of small claims litigation.
The European Small Claims Procedure is meant to simplify and speed up litigation concerning small claims, whilst reducing costs, by offering an optional tool in addition to the possibilities existing under the laws of the Member States. This Regulation should also make it simpler to obtain the recognition and enforcement of a judgment given in a European Small Claims Procedure in another Member State, including judgements which were initially of a purely domestic nature. In order to facilitate the introduction of the procedure, the claimant should commence the European Small Claims Procedure by completing a claim form and lodging it at the competent court or tribunal. In order to reduce costs and delays, documents should be served on the parties by registered letter with acknowledgment of receipt, or by any simpler means such as simple letter, fax or email. The procedure should be a written procedure, unless an oral hearing is considered necessary by the court. The parties should not be obliged to be represented by a lawyer. The court should be given the possibility to hold a hearing through an audio, video or email conference. It should also be given the possibility to determine the means of proof and the extent of the taking of evidence according to its discretion and admit the taking of evidence through telephone, written statements of witnesses, and audio, video or email conferences. The court should respect the principle of an adversarial process. In order to speed up the resolution of disputes, the judgment should be rendered within six months following the registration of the claim. In order to speed up the recovery of small claims, the judgment should be immediately enforceable notwithstanding any possible appeal and without the condition of the provision of a security. In order to reduce costs, when the unsuccessful party is a natural person and is not represented by a lawyer or another legal professional, he should not be obliged to reimburse the fees of a lawyer or another legal professional of the other party. In order to facilitate recognition and enforcement, a judgment given in a Member State in a European Small Claims Procedure should be recognised and enforceable in another Member State without the need for a declaration of enforceability and without any possibility of opposing its recognition. Since the objectives of the action to be taken namely the establishment of a procedure to simplify and speed up litigation concerning small claims, and reduce costs, cannot be sufficiently achieved by the Member States and can therefore be better achieved at Community level, the Community may adopt measures in accordance with the principle of subsidiarity as set out in Article 5 of the Treaty. In accordance with the principle of proportionality as set out in that Article this Regulation does not go beyond what is necessary to achieve those objectives.
The European Council underlines the need further to enhance work on the creation of a Europe for citizens and the essential role that the setting up of a European Area for Justice will play in thisrespect. A number of measures have already been carried out. Further efforts should be made to facilitate access to justice and judicial cooperation as well as the full employment of mutual recognition. It is of particular importance that borders between countries in Europe no longer constitute an obstacle to the settlement of civil law matters or to the bringing of court proceedings and the enforcement of decisions in civil matters.

A terhelt vallomásának szerepe a büntetőeljárásban
111-117Megtekintések száma:158According to our criminal procedure rights which are in force at persent we have to keep in mind the equality of the tools of argumentation and tehir parity. In the sense of this thesis all the proofs must be measured with the same weight excluding the fact that we make distinction between their values, „straingths” from any aspects.
Examining the practise of criminal produred law we can see that they are in total contrast, namely in the balance of argumentative tools there is still an argumentative tool of personal nature, which breaks this order, this parity. This is nothing else but the statement of the accused person.
When I chose this topic I thought of the above mentioned ambivalent consideration of the ambivalent statement of the accused person.
First I would like to outline briefly the connection between the confessions of the accused person and the other argumentative tools, then I want to examine the fact that the accused person must be warned to their right to silence in connection with the „Miranda – decision”.
After that I would like to describe the right to statement and to silence of the accused as well as the special procedural froms which are in force concerning my topic.

A beteg önrendelkezéshez való jogának törvényi tartalma és megjelenése a bírói gyakorlatban
145-172Megtekintések száma:410A tanulmány célja a beteg önrendelkezéshez való jogának vizsgálata, jogértelmezési kérdéseinek bemutatása. Az önrendelkezési jog kiemelten fontos betegjog, mivel a tájékoztatáshoz való jog mellett együttesen biztosítja, hogy a páciens ne egy információhiányban szenvedő, kiszolgáltatott szereplője legyen az egészségügyi ellátásnak, aki helyett más hoz döntést, hanem egy tájékozott fél, aki a kapott információk birtokában képes saját érdekének és értékrendjének megfelelően dönteni a kezelésével kapcsolatban.
A vizsgálat középpontjában az önrendelkezési jog legszűkebb értelmezése, azaz a beavatkozásokba történő beleegyezés, ennek korlátai, illetve a jog helyettes döntéshozók általi gyakorlása áll. A jog törvényi tartalmán és értelmezésén túl fontos, hogy az utóbbi néhány év ítélkezési gyakorlatából is említsünk példákat, és az ezekben szereplő jelentősebb megállapításokat megjelenítsük. Az önrendelkezési jog vizsgálata aktuális és indokolt, tekintve, hogy az ezzel kapcsolatos jogviták, kárigények napjainkban is folyamatosan jelen vannak, így a jogértelmezés is fejlődést mutat ezen a területen.

Benedikt Carpzov két műve a debreceni levéltárban
1-11.Megtekintések száma:250Jelen tanulmány célja, hogy kultúrtörténeti adalékkal gazdagítson egy a 18. századi magyar büntetőjogtörténet szempontjából fontos kutatási témát. Benedikt Carpzov a 17. századi neves szász jogtudós magyar büntetőjogra gyakorolt hatásának mélyebb feltárása az egyes magyar bírói fórumok esetjogában a 18. századi magyar büntető jogtörténeti kutatások egyik érdekes irányaként határozható meg. Az eddig vizsgált büntetőperanyag alapján Carpzov műveit Debrecen szabad királyi városban is alkalmazták és két munkája fenn is maradt a Magyar Nemzeti Levéltár Hajdú-Bihar Megyei Levéltárában. Jelen kutatás erre a két kötetre (közülük is elsősorban a büntetőjogtörténet szempontjából jelentősebbre) fókuszál és próbál meg minél több részletet feltárni különösen azzal kapcsolatban, hogy mikor kerülhettek a kötetek Debrecenbe. A művek vizsgálata, a debreceni büntetőperanyag elemzésén túl, azért lehet hasznos a „carpzovi hatás” kutatása szempontjából, mert a kötetekben található bejegyzések, aláhúzások és más szövegkiemelések vizsgálata segítheti annak megértését, hogy hogyan értelmezték a debreceni jogalkalmazók Carpzov műveit. Jelen írás bevezető tanulmányként a Carpzov-kötetekben található bejegyzések mélyebb vizsgálatát kívánja megalapozni és előkészíteni.

A személyes adatok és az adatvédelem szerepe a piaci versenyt érintő európai uniós platformjogszabályokban
205-227Megtekintések száma:15Az online platformok hatalmát a személyes adatok alapozták meg, amit először az általános adatvédelmi rendelet (GDPR) rendelkezéseivel, a természetes személyek védelme szempontjából igyekezett az Európai Unió fékezni, de úgy, hogy egyúttal ezen adatok szabad áramlását is céljai közé emelte. A platformok – kihasználva a GDPR alkalmazásával kapcsolatos bizonytalanságokat, a nem mindig hatékony betartatását – a big data kezelésével és a tisztességtelen piaci magatartással olyan erőfölényhez jutottak, amellyel képesek visszaélni, ezért a hagyományos versenyjogi vizsgálatok és az összefonódás-ellenőrzési vizsgálatok tapasztalatai arra késztették az Európai Uniót, hogy célzott rendeletekkel ex ante szabályozza ezeket. Valójában a személyes (és nem személyes) adatok kezelésének platformokra vonatkozó, piaci versenyt érintő szabályozási igénye hívta életre a platformjogszabályokat, amelyeknek számos rendelkezése a GDPR-ból nőtt ki. Jelen tanulmány a személyes adatok és az adatvédelem szerepét vizsgálja a platformjogszabályokban.

A vétőképtelen személy károkozásáért való felelősség

Even if the so-called general clause of non-contractual liability reamains unchanged, its contstitutive elements are regulated in detail in the new Civil Code. The new Code also introduces some new provisions with regard to liability for dameges caused by a person of lack of discretionary power. The objektive of this survey is to present these changes and to examine its possible impacts on judicial practice.

Gondolatok a pótmagánvádról
Megtekintések száma:178In Hungary the new code of criminal procedure established a new legal institution to the Hungarian legal system: accessory private prosecution. This kind of private prosecution gives opportunity to the afflicted person to continue penal procedure in case of negative sentences from investigation authorities. If the prosecutor or the investigation authority stops proceeding or the prosecutor sets aside, withdraws formal accusation, afflicted person can substitute them during a penal procedure and has a right to claim the continuation of it. Our valid code does not limit the field of crimes this legal institution of accessory private prosecution can be applied. But there are some strict reasons, which limit this right of the afflicted person. If the investigation authorities neglected formal accusation because of childhood, death, prescription, clemency, prohibition of ne bis in idem, accessory private prosecution cannot be applied.
Pros of accessory private prosecution can be found in the rights of afflicted persons. Criminal power of the state cannot be absolute, so we have to give the right for the injured to judge whether he insists on taking the responsibility of the perpetrator despite the opposite opinion of public bodies. This legal institution can help omissions of prosecutors to be remedied. Practicing this right depends on the stadium of the procedure. During the investigation period or the period of formal accusation reasons for accessory private prosecution are different.
According to the new rules of the code, applying an advocate in the procedure is an obligation for the afflicted person. This regulation ensures that the structure of penal proceedings cannot be changed basically. In a normal procedure there is always a professional expert, the prosecutor on the side of accusation. That is why the code does not permit accusation without applying an advocate.
Costs are interesting question in case of accessory private prosecution. In popular action procedures costs are paid by the state. When the afflicted person practices the right of accessory private prosecution, state pays in advance, but if perpetrator is acquitted or the court stops proceeding, costs should be paid by the private prosecutor himself. There are some rules to ease this burden for the afflicted person: if he has bad financial capacity and he can certify this circumstance, court can authorize him not to pay for the fee of the advocate.
There is a special question in connection with accessory private prosecution: representation of the state. In these procedures the afflicted person is the state or one of the state bodies itself. There are two points of view to answer the question: who is authorized to represent the state as an accessory private prosecutor during a penal procedure. First we have to make difference between the injuries: if the injury is against the state while practising public authority, the injured party is the state itself. But if the injury hit the state as a civil legal entity, a possessor, the right to claim is in the hand of that public body, which was entrusted to handle the injured property. This theory means that in case of injuries against the public author state, only the prosecutor can represent it, so there is no chance for accessory private prosecution.
The other solution for this problem has its starting point that in every crime against public property, accessory private prosecution can be applied. In this case the state can be represented by that part of it, which has interest. Although there are no jurisdiction in this question, because accessory private prosecution was established by the new code from 1st July 2003 after fifty years into the Hungarian legal practice. According to the regulations of the code, we can find the following sentence: afflicted person is whose right or legal interest was hurt or endangered by the crime. Analyzing this definition the argument can be read previously is decent for those situations, when we would like to find the legal representative of the state as an accessory private prosecutor.
Accessory private prosecution is a good solution that fits to the new directions of law development, to increase rights of the afflicted person. Naturally, time needs to become a well-adopted legal institution in Hungarian legal system after half a century silence.

Az egészségügyi ágazati béremelés jogi aspektusai egy gyakorló munkajogász szemével
Megtekintések száma:232My essay analyses the rules of the wage-rise in the Hungarian health service system performed in two stages in 2012 and 2013. The difficulties of applying the rules and the continuous changes in the law are presented from a practical viewpoint.
The personal and material scope of the raise in the health sector was the same circle: higher education institutions and religious institutions performing public mission that provide for in- and out-patient care. The wage-rise affected the employees having service relations with the above mentioned institutes in civil servant and commissionaire positions.
In 2012 altogether86.000 persons benefitted from the raise (67.978 of them were directly involved in the healthcare), and 95.000 persons in 2013. The Act LXXXIV of 2003 distinguishes three groups of employees regarding the continuous and retroactive (ex post facto) raise of wages: doctors, graduates, pharmacists and health workers. In the case of these groups no uniformed wage scale exists, so different rules must be applied.
The retroactive wager is in the case of the doctors depended on their salary, and the continuous rise was realized by a new wage scale. Other graduates and pharmacists gained a fixed rise. The retro active rise of the health workers was also fixed, the continuous wage rise was realized through a new wage scale and it depended whether their legal relation with the employer was established before or after the 1st of the July 2012.
The complicated and frequently inaccurate regulation was corrected by the legislator, when a uniformed wage scale was directed to each group of employees in the September of 2013. A new sectoral wage scale was applied for the doctors and the health workers, and for other graduates and pharmacists the old public wage scale must be applied.
Contrary to the uniformed regulation, there still remained legal institutions where the day/night duty, readiness, shift bonus, overtime must be specified according to the legislations in force on the 30th of June, 2012.
Summing up, the legislator finally prevented the emigration of the highly qualified specialists by the execution of the wage rise in the last two years.

A csalás értelmezési lehetőségei az osztrák büntetőjogban

This should be interesting to examine on which grounds and points the two systems differ from each other. To achieve this challenge, provisions of fraud – as an ancient legal institution – could be a perfect starting point. The essay would like to stress the most important significances of fraud in Austria from both scientific and practical viewpoints.

A civil szervezetek program- és jogalkotásban való részvételének egyes kérdései Magyarországon
10-26Megtekintések száma:225Among the tools of including the concerned elements of society into the decision making processes the government operating since 2010 rather prefers the non-legal ones (i.e. those which do not constitute direct obligations for the government); rather solutions outside of the legal system are put into focus. Therefore the so-called national consultation, which – among others, such as sectoral, professional and other negotiating forums – introduced in Hungary a previously unknown political technique: within two years – in ordinary mail – each citizen received two surveys with possible answers to choose from, furthermore, – as a method not really used before in Hungary – an information booklet was sent to all citizens with the right to vote which presented the newest pieces of legislation.
Looking beyond political slogans and pathetic forms it may be well observed that the government expects from the method of crowdsourcing – which may be considered traditional in other countries – as well as from different online consultations and the introduction of new means (surfaces) of information the establishment and deepening of discussion (cooperation) with society. Among the new means of information we shall mention that the government of Hungary created its websites civil.kormany.hu and kozhasznusag.kormany.hu related to the civil sector (in broader sense about legislation related to the civil sector). The websites – according to the intentions of the government– are part of the process of changing the attitude aimed at with the new act on the civil sector (Act CLXXV of 2011 on right of association, non-profit status, operation and support of NGOs), through which the government wishes to establish transparent connections with the civil sector.
In Article 7 of the new Act CXXX of 2010 on legislation the two basic form of social compromise are described, general negotiation and direct negotiation. The former one provides opportunity for sharing opinion on the website of the organisation publishing concepts, drafts (in a way which obliges the organisation which asks for the opinion, e.g. through confirmation obligation or through preparing summaries on the merits), while the latter one allows the concerned minister to directly request persons and organisations to give opinion. A specific form of direct negotiation – creating obligations on the side of the minister – is the institution of strategic partnership, the framework of which is settled in a thorough agreement. One material weakness of the regulation, however, is that Article 13 paragraph (2) of the act only lists in an exemplary way those with whom such partnership may be concluded, by mentioning forms of organisations (e.g. church, trade union, civil organisation). -
Az (orvos)szakértői bizonyítás a büntetőeljárásban
95-113Megtekintések száma:191A Be. a szakértői bizonyítás szabályait jelentős mértékben átalakította, így pl. az eljárások elhúzódása megakadályozása érdekében a szakértők kirendelésének és a szakvélemények értékelésének folyamatát a megfontolt és időszerű döntés érdekében észszerű mederbe igyekszik terelni. A törvény hatálybalépése óta eltelt idő már lehetővé teszi, hogy vizsgáljuk a jogalkalmazói gyakorlatot. Úgy vélem, hogy a legnagyobb változtatás a magánszakértői vélemény szabályozásából adódik, ami lehetővé teszi azt, hogy a terhelt illetve védője hasonló, a fegyverek egyenlőségének alapelvéből is következő jogosítványokkal rendelkezzen a büntetőeljárásban. Mindez pedig általánosságban is az eljárás tisztességességét erősíti, ami pedig garanciája lehet az anyagi igazsághoz is közelítő bírói ítéletek születésének.

A véleménynyilvánítás szabadságának alkotmányos tartalma a büntető ítélkezésben
71-100Megtekintések száma:13A véleménynyilvánítás szabadsága a demokratikus országok jogrendszerében az egyes jogágakban is alkalmazott alkotmányos alapkő. A véleménynyilvánítás szabadságának alkotmányos tartalmát és a büntető jogvita esetén vizsgálandó szempontokat a rendszerváltást követően hamar kifejtette határozataiban az Alkotmánybíróság, melyet nehezen lehetett beilleszteni a büntető anyagi jog dogmatikájába.
A perbíróságok alkalmazni kezdték a követendő iránymutatásokat, az érdemi döntéseikkel az Alkotmánybíróság hol egyetértett, hol megsemmisítette azokat anélkül, hogy szakjogi kérdésekbe bocsátkozott volna.
A joggyakorlatban folyamatosan merülnek fel olyan esetek, jogviták, melyek szükségessé teszik az Alkotmánybíróság megszólalását, ugyanis a véleménynyilvánítás szabadságának alkotmányos joga ütközhet más alapjogokkal is.
A tanulmány a kollízió mikéntjét kívánja bemutatni.

A Kúria önkormányzati rendeleteket felülbíráló jogköre esetjogi megközelítésben
63-74Megtekintések száma:184The Council of Self-Government Affairs of the Curia of Hungary, which was established in 2012, has the power to review judicial norms beside the Constitutional Court of Hungary in order to abolish the collision between them. The division between the issues of the collision is determined up on the fact whether the question is statutory or a constitutional. The specific interpretation of the Curia and its consistent, conceptual statements that have already been made, leads to the conclusion, that such an institution was created that is able to promote the autonomy of the legislation of self-governments in the right direction. This is the issue that I would like to focus in my paper the most, and to examine what are those most important and conceptual statements, which are also important from a practical perspective. I extended my observation particularly on the legal standards regulating the basic rules of coexistence, where I examined the standards in respect of the most common dilemmas from a case-lawpoint of view.

In diesem Beitrag werden die am öften vorkommene Fehler analisiert, die an der Arbeitvertragsschliesung tauchen auf. Fünf solcher Fehlertypen werden in diesem Beitrag verhandelt. Diese Vehlertiepen tauchen am öften bei den arbeitvertragsahnliche dauerhafte Unternehmens-, und Mandatsvertrage, genau so wie, bei dem Konkrenzabziehendsvertrag auf. Auserdem die Analisierung dehnt auf solche Vertragsproblemen auch aus, die bei der Arbeitzeitbestimmung und bei der handlungsfahikkeit der Verttragsparteien, eben so wie bei dem „Reservatio mentalis” auftauchen.

A kontinentális és angolszász jogrendszer kölcsönhatása a FIDIC Sárga Könyv tükrében

FIDIC Könyvek az építési beruházások vonatkozásában, a projekt típusa szerint különböző szerződéses mintákat tartalmaznak, melyeknek az elsődleges célja a legjobb gyakorlat összefoglalása, és az arányos kockázatmegosztás. A FIDIC Könyvek a legnépszerűbb joganyagnak minősülnek világszerte az építési projektek vonatkozásában. A Sárga Könyv a második leggyakrabban használt szerződéses minta, melynek lényege, hogy a vállalkozó kötelezettsége a tervek elkészítésére és a kivitelezésre is kiterjed. A Sárga Könyv az angolszász jogrendszer jogelveit és jogintézményeit alkalmazza, melyből következik, hogy a szerződéses minta kontinentális jogi környezetben való alkalmazása számos jogértelmezési és jogalkalmazási problémát vet fel. A tanulmány a Sárga Könyv kontinentális jogi környezetben való értelmezésének a bemutatását követően a vállalkozó késedelemből eredő károkért való felelősségének kérdésével foglalkozik. A szerző a vizsgálódás középpontjába azt az esetkört állítja, amikor a vállalkozó késedelmét a megrendelő okozta. A szerző ebben a körben konkrét jogalkalmazási javaslatot fogalmaz meg.

After the presentation on the children of the information society, – the "Z" generation currently living its childhood –, their specific problems and their living space, and after discussing the psychological and sociological background, legal history, and last but not least, the statistics, – I am looking for answers in my study such as what factors, data, precedents motivated the legislature to modify the punishable age for crime, furthermore, whether the more than three years since the entry into force of Law C of 2012 have confirmed the decision to be correct. I will also make mention of victims because of the considerable overlap between the perpetrator and the victim circles characterizing juvenile crime, showing the process which broadens the victims’ rights besides the ever stricter penal policy.
Have hopes regarding the new regulations proven right? What else can the legislature do, and what can we do for our own children?

Kiút az egyenlőtlenségből – A 2023/970 irányelv újításairól
101-126Megtekintések száma:13Az egyenlő bánásmód követelménye, valamint annak markáns leágazását jelentő egyenlő vagy egyenlő értékű munkáért egyenlő bér elve (továbbiakban: egyenlő bér elve) napjainkban sem mondható elhanyagolható problémának annak ellenére, hogy az annak átfogó szabályozására irányuló törekvések már évtizedek óta a közösségi jogalkotás napirendi pontjai között szerepelnek. Az egyenlő bér elve az elmúlt néhány évben ismételten a figyelem középpontjába került. A COVID-19 világjárvány következtében a munkaerőpiacot ért negatív hatások a férfi és női munkavállalók bére közötti különbségek ismételt növekedésnek indultak, amelynek következtében a nyugdíjkülönbségek is csak magasabbra kezdtek kúszni. Tekintettel arra, hogy a bérek közötti különbség teljes megszüntetésére eddig még nem került sor, a hátrányos helyzetet első sorban kezelni kell, majd a csökkentésre irányuló intézkedéseket kell eszközölni, majd jövőre irányuló célkitűzésként a különbségek megszüntetését kell megfogalmazni, ezt követően pedig ennek érdekében minden szükséges intézkedést kell megtenni. Előzetesen már megállapítható, hogy a 2023/970 irányelv nagy volumenű jogalkotási feladatot tűz újításaival a tagállamokra. Tanulmányban az Európai Unió Bírósága esetjogának a téma szempontjából leginkább releváns döntéseit ismertetem, amelyeket követően az újonnan megszületett irányelv újításait mutatom be.
