  • Principle of Environmental Integration – Thoughts on the 7th EU Environment Action Programme

    Integration of environmental requirements into other policies is a priority objective of the new, 7th environmental action programme of the EU. Principle of environmental integration was developed by the international environmental policy; it was inserted into environmental policy principles and into provisions of the Founding Treaty at the establishment of the EC environmental policy. The aim of the environmental integration principle harmful environmental effects, thus to serve sustainable development. Objectives of the EU sustainable development and sustainable growth strategies cannot be realized without integration of environmental requirements: integration of economic, social and environmental aspects of development can ensure the establishment of a resource- efficient, competitive economy, free from environmental degradation, improvement of quality of human life, meeting the needs of present and future generations, and preservation of natural resources which serves as the fundament for development of the other two pillars. Environmental integration is a principle provided for in the Treaty on the Functioning of the European Union, binding the decision-makers and legislators of the EU and the Member States; failure of its application might lead to judicial review and annulment of an act.

  • The Effects of Anthropological Concept of the Legislator on the Interpretation of Law – The Conclusions of a Hungarian Research

    The paper tries to answer the question whether the principle of ’presumption of innocence’ is applied appropriately and consistently in the practice of Hungarian judges. In 2010 we studied the judicial activity of a chosen number of Hungarian judges by analyzing the text of roughly 300 judgements of Hungarian courts and by carrying out an on-line survey among Hungarian judges. As a primary result we could identify some major deficiencies concerning the application of the principle. The other lesson we learnt from the research is that serious principles play their part only if the legislator at the drafting of the law takes the actual knowledge and skills of the law applier into account.

  • The Basic Regulatory Issues of Agricultural Application of Precision Genome Editing and the Precautionary Principle

    The rapidly developing gene manipulation techniques (more recently „gene editing”) have long been controversial, which is reflected in the evolution of legal regulation in Europe. Hungaryʼs Fundamental Law (Art. XX.) clearly states that Hungarian agriculture desires to remain free from genetically modified organisms. According to the Hungarian Academy of Sciences (MTA resolution, 2017), the results of the new techniques (without transgenic implantation) are not regarded as GMOs (by the proper application of the genetic engineering law), these new techniques are not governed by the provisions of the Fundamental Law. Recently, a lawsuit was filed before the Court of Justice of the European Union in which the main question was whether GMOs should be considered the result of new techniques (if not, they do not need to be licensed). In the light of a detailed analysis of the precautionary principle, the study examines the question of whether genetic engineering or its results cover the scope of the legislation. According to the author, this question (as long as the revision of the regulation is not on the agenda) is not for the genetic technologists and plant breeders, but for the lawyers to decide. The conclusion of the study is that genetic engineering, respectively its results are subject to the regulation.

    The organizational issues of European public administration are especially apparent when the cooperation between the EU and its Member States is considered. The regulation of administrative institutions and bodies is fundamentally a subject of national competence. The European public administration for consular protection is based on the cooperation of the organs and authorities on both levels of European public administration. It is regulated as a framework which leaves a wide range of freedom for Member States to settle the missing details and also leaves too much room for voluntarism. All this makes the system unpredictable and despite the application of the principle of loyal cooperation and solidarity, the European administrative structure of consular protection is incompatible with the rule of law and the principle of good administration, and even with the principle of loyal cooperation and solidarity.

  • The Beneficium Novorum in the Light of the Hungarian Procedural Reform Movements of the 19th and 20th Centuries

    The study examines the historical development of the beneficium novorum in the 19th and 20th century. This legal institution means the right of the parties to make such submissions that had not been made in first instance proceedings. Act I of 1911 (the first Hungarian code of civil procedure) made it possible without any boundaries based on the appellatio of Roman law. Act 1930 of XXXIV, however, restricted the freedom of submission in time with the enforcement of the principle of contingent cumulation. The study has a practical approach since it examines the question through archive sources and high court decisions. It argues that the application of the principle of contingent cumulation in the appeal proceedings was a successful legislative move which led to their shortening.
