  • Municipal Waste Management and the Hungarian Model

    There is an ongoing debate on how the role of municipalities should be changed in the local public service sector due to the financial problems present at local level. The debate is mainly related to determine the adequate level and function of local governments. The author introduces the basic elements of a model of public services that shows the relationship between the public actors (state/municipality), the service provider and the user, including how the need is determined, the service is provided, financed and the service provider is chosen. The author introduces the “Hungarian Model” and its main features: the co-existence of three different model (public, quasi private and mixed) of the waste treatment service sector differing in the relationships established among the stakeholders and in the financing system; and the right of municipalities to freely switch between them. It draws the attention to how the changes in the role of the state and the legal framework influenced the models and reshaped the relationships of the stakeholders without dealing with the consequences.

  • Additional Remarks on the Question of Civil Service Law as a Branch of Law

    The study focuses on the relationship between civil service law and labour law. In Hungary, there have been significant changes in the last decade regarding the regulation of civil service law. The types of the civil service legal relationships have increased, the forums and procedural rules for adjudicating civil service law related disputes have changed, and the number of public employees providing public services has rapidly decreased. This is of particular importance because the existence of these branches of the law is determined by legislation as well. The study concludes that the ability of civil service law to become an independent branch of law will be determined not by 'internal' developments but by legislative ambitions.

    Environmental liability legislation, both the ELD in Europe and CERCLA in US, is burdened with significant compromises, but even if so, they are too leniently implemented. Moreover, rather scarce data are available on the liability cases and on the status of polluted sites, therefore the system is unable to amend itself. There is no reason to be surprised: expenses of protection or remedy of the polluted sites are enormous, the concerned industries would get into a poor competition position in the market if faced with too stringent liability. In the exceptional cases when their deeds are revealed and enforcement actions start, they still might retreat behind the bastions of limited responsibility of their companies. In such situations public participation is a vital element of any progressive outcomes. In the present study we examine the efforts of J&E, a network of public interest environmental lawyers to contribute to moving out the European environmental liability systems from their stalemate position and enhance their effectiveness.

  • Change of Legal Relations: Consequences for Labour Law of the Restructuring of Public Services

    Changes in the organization of public services often have the consequence of changing the employment relationship of those employed among them. The change is often caused by the transformation of civil service legal relations into private employment law. In the background of changes are usually the legislature's intention to maintain legal relations with the successor employers. This intention is realized in Hungarian labor law and civil service law by various legal and technical methods. The paper reviews these in different areas of public services.

  • European Public Administration of Consular Protection

    The organizational issues of European public administration are especially apparent when the cooperation between the EU and its Member States is considered. The regulation of administrative institutions and bodies is fundamentally a subject of national competence. The European public administration for consular protection is based on the cooperation of the organs and authorities on both levels of European public administration. It is regulated as a framework which leaves a wide range of freedom for Member States to settle the missing details and also leaves too much room for voluntarism. All this makes the system unpredictable and despite the application of the principle of loyal cooperation and solidarity, the European administrative structure of consular protection is incompatible with the rule of law and the principle of good administration, and even with the principle of loyal cooperation and solidarity.

  • Trends, Directions, Legislative Efforts: the Abolition of the Civil Servant Status

    One of the most spectacular changes to the Hungarian employment system in recent years is that many former civil servants (‘közalkalmazott’) have lost their status and come under the scope of the Labour Code or have been subject to newly created status laws. As the Act on Civil Servants (‘Kjt.’) applies now only a few groups of civil servants,  having been emptied out by successive reforms, it is not surprising that the future existence of the Act and of the autonomous status of civil servants is being called into question. But what factors have led to the gradual, and in recent years accelerating, decline of the Kjt.? Is the 'disappearance' of civil servants the result of internal processes that rationally follow from the development of the law, or is it the result of independent economic and political considerations? What was the original role of the Kjt. in the system of employment relationships and how can its ‘emptying’ be understood in an international and historical context? The study argues that this process is not an inevitable consequence of legal doctrinal developments, but rather the result of legislative efforts to abolish the uniform legal status of human service providers. Hungarian legislation is no exception to the neoliberal and neo-Weberian trends, while the comparative advantages previously enjoyed by civil servants are eroding and the regulation is becoming highly fragmented.

  • About the Costs of Public Procurements

    This study summarizes the basic types of costs which are related to public procurements and which are based on expressed legal regulations. It analyses the costs of tender documentation, the experts, the tender guarantee, the mandatory examination of the notice and the following legal institutions which are related to the legal remedies: the administrative service fee and the fine. The article compares the solutions of other countries: it examines the regulation of fees and the consideration of tender documentation. The Polish, the Austrian and the german examples show that the Hungarian legislator could improve the Hungarian regulation.

    Labor law has not been able to dispose of the shackles of the locatio conductio for a long time; the system of traditional labor law was built on this contract. However, new forms of employment are beginning to break down this structure. Outsourcing and employment by digital platforms have broken the dominance of the employment contract and the contractual structure is shifting towards private law. The study seeks to answer the question of what all this means in terms of protecting the worker and the responsibility of the employer. Finally, does the theory of the personal employment contract offer a solution?

  • Current Challenges of Confidentiality and Publicity in the View of Information Security

    The paper analyses the issues of confidentiality and publicity, arising from current information security legislation in Hungary. First of all the information security as a state task is analyzed. In Hungary, the information security controls of state and local government entities are regulated. Afterward, on the one hand, the information security as a tool for data protection regulation, state secrets and freedom of information were discussed. On the other hand, information security can be an object of the law, when the protection of security controls is required. One of the main findings of the research was that the information security controls applied at state entities are generally public data (according to freedom of information regulation). Thus it might not stay confidential. We formed proposals to solve this issue.

  • Decentralization of Welfare Services in France

    The principle of decentralization is widely applied in public administration. Despite the conceptual insecurity decentralization is often linked to the principles of democracy, participation, efficiency providing a normative value for the principle. Practical experiences, however, show that the advantages and disadvantages of decentralization are influenced by historical, economical, social, institutional and cultural context. Decentralization policy to increase the effectiveness of French welfare services could not change the institutional structure with strong historical roots and to improve the service quality. The strengthening of task and competences of the county level led to the failure of decentralization due to the lack of funding, personal and coordination problems.

  • Censorship as a Tool Against State Disinformation: Media Freedom Implications of the Russian-Ukrainian War

    Disinformation campaigns originating from Russia have been frequently debated in recent years. Disinformation also plays a major role in the Russian–Ukrainian war that started in February 2022. The issue has been on the agenda in the European Union in recent years, so it is not surprising that among the many sanctions the EU introduced against Russia, action against disinformation was also added. This paper sets out to describe the previously unprecedented ban on Russian media service providers, including the problems the provision creates for freedom of expression. In particular, it will examine the content of the Decision and the Regulation, which prohibited the distribution of the Russian media outlets concerned and the consequences of the EU legislation. It will then go on to critically analyse the provisions from the perspective of freedom of expression, and finally, the relevant judgments of the Court of Justice of the European Union.

  • Expanding Zoo? Judgments of the EU Court of Justice on Participation of Slovakian NGOs in Environmental Administrative Proceedings

    The Aarhus Convention guarantees access to information, public participation and access to justice in environmental matters. The Convention as a so-called mixed-agreement has been ratified by the EU as well as by its Member States. The Convention-related case-law of the Court of Justice of the EU (CJEU) especially relating to Slovakia (see, C-240/09 – Slovak bears, C-243/15 – Slovak deers) shows that the Court has broadened the locus standi of NGOs before national courts using them in order to facilitate the enforcement of EU law. The activism followed by the Court in these judgements could be considered as environmental-specific expression of the objective of broader law enforcement before national courts. However it depends on national courts whether this kind of CJEU judgments could acquire cross-border relevance by their application of national judges.   • Digitization at Work: Expanding Horizons with Loopholes

    The focus of the study is on the emergence and spread of digitization in employment. In this context, the study presents the forms of work that use digitization. On the other hand, it describes the labour market effects of digitalization. The study looks in detail at how COVID-19 has changed the role of teleworking and the home office in employment. This is followed by the presentation of the Hungarian labour law regulation, which deals exclusively with telework. The study makes two proposals to address the codification gap. On the one hand, in connection with application-based work, the introduction of the status of a person with a similar legal status to an employee, which was regulated in the draft of the Labour Code. On the other hand, to impose employer obligations (retraining, job offers) in connection with the spread of automation and robotics in order to prevent dismissal.

This study therefore examines the constitutional and family law foundations of family protection in seven Central European countries. The study describes, among other things, the nature of family law legislation, the conceptual approach to family and marriage, the legal protection and solution of extramarital partnerships, such as de facto partnerships and registered partnerships, and the status of children in the countries studied.

    In Hungary from the 1990s in line with the international tendencies a number of studies were published in the literature urging the reform of the criminal law dealing with juvenile crime. Simultaneously one can establish that among others due to the increasing criminal rate the reasoning for the reduction of the lower age limit of punishability to the age of 12 has started. During the codification process a number of arguments were given for and against the alteration of the age limit of punishability. However setting the lower age limit of punishability below fourteen can be found in the criminal law regulations of Hungary and also of other European countries. This paper examines the antecedents, reasons and possible amendments of the regulation of the new Criminal Code on the age of punishability.

    A szlovákiai ügyészség alkotmányos jogállása és törvényi szabályozása hosszú ideje vita tárgya. Az érdeklődés egyik oka kétségkívül az, hogy az ügyészség tevékenységének, hatáskörének szabályozása a szakmai és a laikus nyilvánosságot is érinti. A figyelem elsősorban az ügyészség alkotmányos helyzetére, az ügyészség egyes szintjei, továbbá az ügyészség és a közhatalom más szervei közötti viszonyokra, valamint a büntetőügyek területén érvényesülő, s azokon kívüli hatáskörre irányul. Ez a tanulmány is e viszonyok tisztázására, a Szlovák Köztársaság ügyészségére vonatkozó régi és újabb közjogi rendelkezések bemutatására vállalkozik.
