    My essay analyses the rules of the wage-rise in the Hungarian health service system performed in two stages in 2012 and 2013. The difficulties of applying the rules and the continuous changes in the law are presented from a practical viewpoint.

    The personal and material scope of the raise in the health sector was the same circle: higher education institutions and religious institutions performing public mission that provide for in- and out-patient care. The wage-rise affected the employees having service relations with the above mentioned institutes in civil servant and commissionaire positions.

    In 2012 altogether86.000 persons benefitted from the raise (67.978 of them were directly involved in the healthcare), and 95.000 persons in 2013. The Act LXXXIV of 2003 distinguishes three groups of employees regarding the continuous and retroactive (ex post facto) raise of wages: doctors, graduates, pharmacists and health workers. In the case of these groups no uniformed wage scale exists, so different rules must be applied.

    The retroactive wager is in the case of the doctors depended on their salary, and the continuous rise was realized by a new wage scale. Other graduates and pharmacists gained a fixed rise. The retro active rise of the health workers was also fixed, the continuous wage rise was realized through a new wage scale and it depended whether their legal relation with the employer was established before or after the 1st of the July 2012.

    The complicated and frequently inaccurate regulation was corrected by the legislator, when a uniformed wage scale was directed to each group of employees in the September of 2013. A new sectoral wage scale was applied for the doctors and the health workers, and for other graduates and pharmacists the old public wage scale must be applied.

    Contrary to the uniformed regulation, there still remained legal institutions where the day/night duty, readiness, shift bonus, overtime must be specified according to the legislations in force on the 30th of June, 2012.

    Summing up, the legislator finally prevented the emigration of the highly qualified specialists by the execution of the wage rise in the last two years.

    In the financing of the Public Health System, it has a particular significance on the one hand that those obligated do pay the required taxes and levies (Health contribution) in order, and on the other, to use the already available resources only to the purpose that laws allow.

    The institutes that provide public health care services maintain themselves in part or on the whole on the support of the central budget or the Health Insurance Fund. The criteria listed by Law indicate and limit on what the institutes may spend the amount of funds receivedwhich areas should they strive to develop.

    The question arises that how other chargessuch as expenses related to the quality management system, can fit into this well-defined scope. In my opinion, it would be possible to avoid the giving away of unrealistically large amounts of money to semi-, or fully illegal businesses with greater circumspection, because otherwise too many sources are distracted from Health Care.

    Man is a social animal, it is important for colleagues to meet, create a relationship with them, to communicate, ideas, exchanging information. Human relationships are determined by the identity of a specific person, place in society, so it should be a fundamental right for all people in contact with the law. However, in certain life situations exercising these rights is necessarily limited, undermined, need frameworks. One of those situations in life with participation in health care in which the patient has to adapt in health care provider operating schedule, however, the Trustee is required to ensure the exercise of the right contacts.

    The most prominent of patients' rights to human dignity, which is inferred from a mother right, from which a number of other important rights. One of these is the right to self-determination, which guarantees freedom of action of the human as an individual incapacity depending autonomous. For patient care recipients should be subject to the fundamental distinction that whether it is inpatient or outpatient care. In the latter case, it also suffers from significant limitations on the patient's right to self-determination , including personal freedom, opportunities for contact with other people. The right to self-determination in a specific part of the realization of rights is thus involved in the regulation of the contact, as during inpatient care plays an important role.

    In today's modern society, the means of communication, networks of past explosive development, get more involved in the exercise of the right to life, human relations than before, with the elimination of the technical obstacles the spatial and temporal obstacles easily can be prevented. Life situation of the theme chosen exercise of the right of communication is of particular importance, because the patient's recovery depends not only on only physical but also mental condition, recovery can define what social relations, quality, intensity.     The doctor-patient relationship requires set rules for liability considering the nature of professional norms on medicine and the protection of human life and health. According to these rules, the healthcare provideris vicariously liable for damages suffered as a consequence of healthcare servicesprovided to the patient. In such cases– on the grounds of labor law rules – the healthcare providermay transfer liability to its employee. Considering recent amendments of labor law regulations, it is essential to summarize and analyze relevant labor law norms relatedto medical liability.

    The employee’s liability for damages is based on the employment relationship between the healthcare provider and the employee. Despite of the healthcare provider’s liability for damages, the employee’s liability is always personal.

    According to the new labor code the employee’s liability for damages is only ascertainable if the tortfeasor did not act like a reasonable person would have actedunder given circumstances. This means that the tortfeasor’sintention or negligence is irrelevant in the course of ascertaining liability. The purpose of our study is to provide a review of the strict measure of due care in health care services, and to summarize rules about the healthcare professional’s liability for damages.

    A tanulmány egy szélesebb körű kutatás részeként, az Alaptörvény XX. cikkében is elismert testi és lelki egészséghez való jog, s kiemelten az egészségügyi ellátás megszervezésével kapcsolatos állami kötelezettségek vonatkozásában készült. Az egészséghez való jogot, mint emberi jogot, napjainkban is fennálló jogérvényesítési dilemmájára tekintettel, többek között a Gazdasági, Szociális és Kulturális Jogok Nemzetközi Egyezségokmánya állami jelentéstételi mechanizmusában a 2009-es évben bevezetett közvetlen alkalmazhatósági indikátor és azzal összefüggő állami visszajelzések alapján vizsgáltam. Az említett indikátort ugyanis hosszabb távon a jogérvényesítés előmozdítására alkalmas kezdeményezésnek tartom abban a folyamatban, amelyet Buza László a nemzetközi jog programjellegű normáinak teljes értékű jogszabályokká alakításaként határozott meg.

    Ennek hazai vonatkozásban elengedhetetlen kiegészítőjeként tekinthetünk az Alaptörvény XX. cikk Alkotmánybíróság általi értelmezésére. Ezt az Alaptörvény elfogadásának tíz éves jubileuma mellett egyrészről alátámasztja, hogy a legutóbbi évek gyakorlatáról az államjelentések még nem reflektálnak. Másrészről, a testület által kimondottan, bár az alkotmányossági elbírálás alapját az alaptörvényi rendelkezések képezik, az mégsem zárkózik el feltétlenül a releváns nemzetközi és európai (jog)politikák, megközelítések vizsgálatától sem. Ezért elsőként a közvetlen alkalmazhatóságot és annak alkotmánybírósági gyakorlat által meghatározott akadályait, majd az államjelentések által nem érintett részkérdést tekintettem át.

    In my study I say about that change, which became at the area of biotechnology. The revolution of DNS technology contain a lot of chance, but it has more danger. We need select from the modes.

The first observation that the changes faster than other territories, and these changes are complex and interrelated. The post control and correction are also important. It’s got to be introducing the health nutrition compliance. The new products will not harmful for the human and animal health. The legal condition shall prescribe the human defense of human and animal body. One of the most important international convention in that question the European Union Council about the biomedicine. It said need consent of the persons concerned for the biotechnological research. Create new human species, and cloning of human beings, human body use for commercial is prohibited by this convention.

    In my opinion that need promoting the knowledge and biotechnical awareness of consumers. Must be regulated the relations between public order and public morality and biotechnical inventions. It is also necessary to ensure the patentability of biological matter. „Biological material” means any material containing genetic information and capable of reproducing itself or being reproduced in a biological system. Inventions which concern plants or animals shall be patentable if the technical feasibility of the invention is not confined to a particular plant or animal variety. The discussion on the patentability of sequences or partial sequences of genes is controversial. The 98/44/EK Directive, the granting of a patent for inventions which concern such sequences or partial sequences should be subject to the same criteria of patentability as in all other areas of technology: novelty, inventive step and industrial application. Whereas the industrial application of a sequence or partial sequence must be disclosed in the patent application as filed.

    The biotechnical patent need particular importance in the legislation. The Hungarian rules are conforms to the European Union legislation. However, certain additional rules should be laid down. Have to think about the control test in the patent process. The expert can see the applicability just on the test.

    In Hungary there are two types of punishments: principal punishments and supplementary punishments. I examined the labour in the public interest, which is one of the principal punishments. Judges use this punishment barely than imprisonment, fine. Difficult to use this punishment, because it needs many preliminary works. I examined the labour in the public interest’s ruling from the 1950.:II. Criminal Code of General Part to nowadays.

    In Hungary a person sentenced to labor in the public interest is obligated to perform the work defined for him in the court sentence. Only such work may be ordered as work in the public interest which the convict, in light of his health condition and education, is presumed to be capable of performing. There are many problems in rule of the labour in the public interest, for example one day of work in the public. As rule of the Criminal Code punishment shall be six hours of work, but other rule is, punishment shall be 4-8 hours of work for one day.

    Other interesting rule is, the imprisonment substituting labour in the public interest or the remaining part thereof shall be established in such a way that one day of labour in the public interest shall correspond to one day of imprisonment. In my opinion it would be better, if the imprisonment substituting labour in the public interest or the remaining part thereof shall be established in fine.

    On the other hand I suggested to use this punishment if a person younger than 18 years old. I think if a person is 16 years old, this punishment can be more effective than other punishments.

    I found many differences, and many similarities between Hungarian and international Criminal Codes, Propositions, and finally I wrote some important, new point to change the rules.
