    In the legal terminology of private law several times the same definition is used for addressing the same legal institution (e.g. default penalty, in-building). In most of the cases there is no problem to separate these institutions and we can also give an explanation why legislator used the same terminology.

    The definition of accessory is used for a special group of article groups in the Hungarian Civil Code and also used in the Act I. of 1988. From the angle of judicature it is problematic as even if the definition of road accessory is build upon the general terminology of accessory in the Civil Code, the two legal institutions are not the same.

    In the essay we would like to emphasize that the safety of traffic does not give a decent reason why we have to restrict the proprietary rights with using the institution of road accessory. This restriction is in a close connection with not only the distance from the public road but the effect of the property to the safety of traffic. The valid regulations may cause illogical contradictions and judicature problem.

  • Liability for dameges caused by a person of lack of discretionary power

    The new Hungarian Civil Code also modernizes the non-contractual liability law in several aspects. Even if the so-called general clause of non-contractual liability reamains unchanged, its contstitutive elements are regulated in detail in the new Civil Code. The new Code also introduces some new provisions with regard to liability for dameges caused by a person of lack of discretionary power. The objektive of this survey is to present these changes and to examine its possible impacts on judicial practice.

  • The proprietary rights as the objects of contribution in kind and the occurring problems caused by the lack of unified rules

    According to the new Hungarian Civil Code, the funders of the legal entities have to make contributions to the authorised capital and the two forms of these contributions are the contribution is cash and the contribution in kind. The regulation states that proprietary rights can also be transferred to the capital of businness accociations, by those funders, who are entitled to demise them.

    The judicial practice unanimously defined the rules in those cases, when the object of contribution in kind is a certain proprietary right, especially when the right is connected to the real estate. On the other hand, the Civil Code does not contain a list of those proprietary rights, which can be transferred to the authorised capital and unfortunately, different acts contain different lists of these rights.

    The three mentioned acts are the following: the personal income tax act, the act about the fees and the accounting act. All of them contain a list of proprietary rights and some of the items are regulated by all the three of them but most of the items are different, which means it is impossible to create an accurate list of these rights. For example, the list in the personal income tax act contains only five items, on the other hand, the accounting act contains two lists and both of them are unfinised.

    Because of the lack of unified rules, it is impossible to define which proprietary rights can become the objects of contribution in kind and this misfortunate situation causes a lot of unwanted indefinability and states a lot of questions.

    In my essay I introduce this problem and I use a chart to illustrate the differences between the mentioned lists. In my opinion, this problem could be solved with an unified list, which is normative for every regulation in connection with the proprietary rights or the Civil Code should contain a list of those proprietary rights, which can be the objects of contribution in kind.

  • Civil law dogmatic deficiencies and legislative hiatuses in a private law legislation: Short case study

    Based on the Government Decree 383/2023 (VIII.14.) on the ministerial approval of lease contracts of companies directly or indirectly majority-owned by the state, the article presents a case study showing that the legislation suffers from numerous "legal errors" that violate the provisions of the Legislation Act and is not in line with the fundamental doctrinal principles of civil law. The case study describes in detail the provisions of Act CXXX of 2010 on Legislation that the Government Decree does not comply with and shows how imprecise wording leads to problems of interpretation. The paper points out the private law terminus technicus which the legislator did not apply correctly (the party of the lease contract, consideration, invalidity - ineffectiveness) and the author proposes to correct the errors and to clarify certain normative provisions.

  • The Notarial Examination of the Order for Payment Requests

    2010 marked the opening of a new chapter inthe more than 120 years history of the Hungarian order for payment procedure. Breaking with the Hungarian traditions, the notaries became competent to carry out these procedures instead of courts. The Hungarian Chamber of Civil Law Notaries established an accessible web-based computerised system for support of procedures. The registration of requests, the assignment of cases to notaries and the administrative handling of cases are carried out through this electronic network. The legislator’s aims when modified the regulation of this legal instrument was to reduce the duration of order for payment procedures and the workload of courts. In this paper I give an overview of the content of order for payment requests and of the practical experience of the notaries in connection with the examination of requests.

  • The special rules of retail and high priority significance lawsuits in civil procedure

    My paper is about the preferential significance and minor value actions special rules in the civil proceeding. These types of actions have several special rules compared to the general rules and have specialities compared to each. The specialities are multiple the most important is the sum in dispute. This is under 1 M florins in minor value actions and above 400 M florins in preferential significance values. These worths are too low in minor value actions and too high in preferential significance actions. This is proven by that there are almost no cases where these rules are adaptable.

    These rules are simple and easy to use it but not common in civil proceedings. It is mistake because these are useful rules and these would make the actions more simple.

  • A new draft of classification of claims: Reinstating of Bankruptcy Rules in the Provisional Judicial Rules

    After the failure of the Hungarian Independence War of 1848-1849, the neoabsolutism which was the ruling of the Franz Joseph I from 1851 to 1860 reformed the Hungarian legal system. The emperor aimed at legal unification of Austrian Empire therefore he introduced the Austrian codes to Hungary. In 1860 the Austrian emperor eased the absolutistic government attitude with the issuing of the October Diploma and restored the Hungarian jurisdiction and public administration system which functioned before 1847. He charged the Lord Chief Justice, gr. György Apponyi who was recently appointed by him with the realisation of this restitution. That’s why Apponyi summoned a meeting for the Hungarian lawyers in 1861 which called the Conference of the Lord Chief Justice. This assembly specified the material and procedural law for the Hungarian courts.

    In this paper I examine the effect of this conference on the bankruptcy law, and I present the provisions of the Conference of Lord Chief Justice concerning bankruptcy law and the driving forces of the regulation based on the assembly’s records. The conference put into force the first Hungarian Bankruptcy Act (Act 22 of 1840) instead of the Austrian provisional bankruptcy procedure. The Hungarian literature typically includes about this regulation that the assembly only adjusted material and procedural rules of the Bankruptcy Act to the requirements of the civil era. I demonstrated with archival sources and views of conference’s participants that the modifications generated bigger changes in the Hungarian bankruptcy practice. In addition, the first appearance of the deed of arrangement without bankruptcy proceedings in Hungary was connected to the neoabsolutism of which the Hungarian lawyers expressed their opinions.

  • Thoughts about accessory private prosecution

    In Hungary the new code of criminal procedure established a new legal institution to the Hungarian legal system: accessory private prosecution. This kind of private prosecution gives opportunity to the afflicted person to continue penal procedure in case of negative sentences from investigation authorities. If the prosecutor or the investigation authority stops proceeding or the prosecutor sets aside, withdraws formal accusation, afflicted person can substitute them during a penal procedure and has a right to claim the continuation of it. Our valid code does not limit the field of crimes this legal institution of accessory private prosecution can be applied. But there are some strict reasons, which limit this right of the afflicted person. If the investigation authorities neglected formal accusation because of childhood, death, prescription, clemency, prohibition of ne bis in idem, accessory private prosecution cannot be applied.

    Pros of accessory private prosecution can be found in the rights of afflicted persons. Criminal power of the state cannot be absolute, so we have to give the right for the injured to judge whether he insists on taking the responsibility of the perpetrator despite the opposite opinion of public bodies. This legal institution can help omissions of prosecutors to be remedied. Practicing this right depends on the stadium of the procedure. During the investigation period or the period of formal accusation reasons for accessory private prosecution are different.

    According to the new rules of the code, applying an advocate in the procedure is an obligation for the afflicted person. This regulation ensures that the structure of penal proceedings cannot be changed basically. In a normal procedure there is always a professional expert, the prosecutor on the side of accusation. That is why the code does not permit accusation without applying an advocate.

    Costs are interesting question in case of accessory private prosecution. In popular action procedures costs are paid by the state. When the afflicted person practices the right of accessory private prosecution, state pays in advance, but if perpetrator is acquitted or the court stops proceeding, costs should be paid by the private prosecutor himself. There are some rules to ease this burden for the afflicted person: if he has bad financial capacity and he can certify this circumstance, court can authorize him not to pay for the fee of the advocate.

    There is a special question in connection with accessory private prosecution: representation of the state. In these procedures the afflicted person is the state or one of the state bodies itself. There are two points of view to answer the question: who is authorized to represent the state as an accessory private prosecutor during a penal procedure. First we have to make difference between the injuries: if the injury is against the state while practising public authority, the injured party is the state itself. But if the injury hit the state as a civil legal entity, a possessor, the right to claim is in the hand of that public body, which was entrusted to handle the injured property. This theory means that in case of injuries against the public author state, only the prosecutor can represent it, so there is no chance for accessory private prosecution.

    The other solution for this problem has its starting point that in every crime against public property, accessory private prosecution can be applied. In this case the state can be represented by that part of it, which has interest. Although there are no jurisdiction in this question, because accessory private prosecution was established by the new code from 1st July 2003 after fifty years into the Hungarian legal practice. According to the regulations of the code, we can find the following sentence: afflicted person is whose right or legal interest was hurt or endangered by the crime. Analyzing this definition the argument can be read previously is decent for those situations, when we would like to find the legal representative of the state as an accessory private prosecutor.

    Accessory private prosecution is a good solution that fits to the new directions of law development, to increase rights of the afflicted person. Naturally, time needs to become a well-adopted legal institution in Hungarian legal system after half a century silence.

  • The Legal Aspects of the Hungarian Health Sectoral Wage Rise Through the Eyes of a Practising Labour Lawyer

    My essay analyses the rules of the wage-rise in the Hungarian health service system performed in two stages in 2012 and 2013. The difficulties of applying the rules and the continuous changes in the law are presented from a practical viewpoint.

    The personal and material scope of the raise in the health sector was the same circle: higher education institutions and religious institutions performing public mission that provide for in- and out-patient care. The wage-rise affected the employees having service relations with the above mentioned institutes in civil servant and commissionaire positions.

    In 2012 altogether86.000 persons benefitted from the raise (67.978 of them were directly involved in the healthcare), and 95.000 persons in 2013. The Act LXXXIV of 2003 distinguishes three groups of employees regarding the continuous and retroactive (ex post facto) raise of wages: doctors, graduates, pharmacists and health workers. In the case of these groups no uniformed wage scale exists, so different rules must be applied.

    The retroactive wager is in the case of the doctors depended on their salary, and the continuous rise was realized by a new wage scale. Other graduates and pharmacists gained a fixed rise. The retro active rise of the health workers was also fixed, the continuous wage rise was realized through a new wage scale and it depended whether their legal relation with the employer was established before or after the 1st of the July 2012.

    The complicated and frequently inaccurate regulation was corrected by the legislator, when a uniformed wage scale was directed to each group of employees in the September of 2013. A new sectoral wage scale was applied for the doctors and the health workers, and for other graduates and pharmacists the old public wage scale must be applied.

    Contrary to the uniformed regulation, there still remained legal institutions where the day/night duty, readiness, shift bonus, overtime must be specified according to the legislations in force on the 30th of June, 2012.

    Summing up, the legislator finally prevented the emigration of the highly qualified specialists by the execution of the wage rise in the last two years.

  • The Hungarian Regulation of Domestic Partnership and The Domestic Partnership Registry

    In recent decades, the number of the couples who live in domestic partnership and the number of children born to parents in a domestic partnership in Hungary and across Europe increased significantly. Because of these facts and reasons there was a need for a significant revision of the Hungarian regulation on domestic partnership that took place in the new Civil Code of Hungary of 2013. The notaries of Hungary have had a new role in the area of registration. In my work as a vice-notary, I often experience that couples who live in domestic partnership are entirely unconscious of the legal effects of choosing this form of living together.

    In this paper I give an overview of the past and present of the Hungarian regulation on domestic partnership. I pay particular attention to the Domestic Partnership Registry conducted by the Hungarian National Chamber of Civil Law Notaries. This summary gives me an excellent opportunity to give an account of my opinion about the registry and my practical experience with the conduction of the registry.

  • Le présent et le futur de la réparation dans la procédure pénale hogroise

    A la deuxième moitié du XX ième siècle la victime a commancé á jouer un rôle important de nouveau dans les procédures pénales. Les legislateurs veulent assurer les droit de la victime et garantir qu’elle soit indemnisée le plus tôt possible et pour que tout le monde soit content du résultat.Ce sont les cadres de la juridiction restaurative qui en assurent les possibilités.

    Dans cet essai premièrement je présente le cadre de la constitution de partie civile dans la législation hongroise. C’est une procédure très intéressante parce qu’il faut appliquer d’un côté le droit civil et la procédure civile et de l’autre le drot pénal et la procédure pénale dans le cadre de la juridiction pénale (dans une procédure).

    J’ai analysé le terme de la victime, les règle appliquables et les décisions du juge. J’ai constaté qu’en Hongrie les tribunaux correctionnels ne délibèrent pas les décisions sur le fond dans les cas de partie civile mais ils renvoient les affaires devant les tribunaux civils.

    Ensuite, je présente les institution juridique hongroise qui vise á l’entremise dans la procédure pénale. On peut trouver deux institution juridique en vigeur. En premièr lieu il faut mentionner que dans les cadres de la procédure par constitution de partie civil (où la victime soutient l’accuation) il existe une audition personnelles des parties où le but est donc l’arrangement des parties.

    Il y a une autre institution juridique qui s’appelle l’ajournement de la mise en accusation. On peut l’appliquer si la peine ne mérite pas de trois ans de prison et il y a beaucop de circonstances atténuantes, le procureur peut décider l’ajournement de la mise en accusation d’une au deux ans. On peut prévoir différentes obligations et règlements du comportement pour le prévenu. Par example on peut prévoir de dédommager la victime avec l ‘accord des parties. J’ai examiné cette institution juridique et son efficacité dans la pratique aussi.

    Troisièmement j’ai analysé une institution juridique qui entrera en vigeur le 1er janvier 2007. C’est la médiation pénale. Il y a un cadre de décision européen (2001/220/IB) qui préconise aux États memnbres d’introduire la médiation pénale. Pour pouvoir appliquer cette institution juridique il faut modifier le Code Pénale et la loi de la procédure pénale. C’est le procureur qui aura le droit de la suspension du procès pour maximum six mois et renvoyer l’affaire devant un méditeur. Cette procédure devant le médiateur sera regie par une loi d’exeption.( Il y a déja une projet de la loi). Je présente les problèmes en relation la médiation pénale. En résumé on peut dire que la mise en place et la régulation de la médiation demandent du temps et de l’énergie. Je statue qu’il faut attendre beaucoup de temps en Hongrie pour que l’opinion publique et les justiciables acceptent et appliquent avec efficacité la médiation pénale.

    The article introduces the criminal liability of the medical doctors in a nutshell. The topicality of this theme is exemplified by the increasing number of criminal procedures against physicians as trends show. During the introduction of the criminal liability of the medical practitioners, the article considers drawing a line between the liability of civil and criminal law of importance. After describing the matters concerning the drawing of line, the study is going to elaborate the legal brief of endangerment committed in the line of duty, followed by a review connecting the prior and the medical profession, presenting some legal cases, respectively. It is very essential to explore the legal brief of prohibited abortion and charlatanry, in addition to delineating the concepts of active and passive euthanasia, and, after having explained the refusal of provisions, it is necessary to aspire to draw a line between the prior mentioned and the legal brief of the assistance in suicide.

    Időszakos vagy megosztott idejű tulajdonlás a közös tulajdon speciális esete új szabályként került a román polgári törvénykönyvbe 2011. október elsejétől.

    A tulajdonjog részjogosítványai nem feltétlenül egyformán és egyidejűleg gyakorolhatók. A tulajdon részjogosítványai közül a birtoklás annak ellenére folyamatosnak tekinthető, hogy egymást követő időszakok, szünetek vannak az ingóságok használatában.

    Külön fejezetben kerül bemutatásra az időszakos tulajdon fogalma, meghatározása.

    Az időszakos tulajdon több módon is keletkezhet, így megállapodással vagy végrendeleti örökléssel. Bemutatásra kerül, hogyan gyakorolhatja a tulajdonos ebben a tulajdonosi formában a tulajdoni részjogosítványokat. A polgári perrel kapcsolatos szabályok körében ismerhetjük meg a jogviták elrendezési lehetőségeit, így a társtulajdonos kérheti a közös tulajdon megszüntetését, de pénzbeli kompenzációt is követelhet a társtulajdonostól.

  • Functional Analysis of Damage Charges

    Replacing the legal institution for non-pecuniary damages burdensome by previous theoretical and practical contradictions, Act V of 2013 (Civil Code) introduces damage charges as a separate sanction for violation of personal rights, which has dual functions: on the one hand, it aims for the person being injured in its personal rights receive a monetary allowance that approximates or compensates for the non-material damage suffered. On the other hand, it can also be considered as a punishment under private law for the prevention of similar infringements, as a deterrent.

    According to the intended interpretation, the damage charge can only be applied if it is able to fulfill its function, i.e. if no non-pecuniary damage can be detected for which the damage charge is intended for proportional compensation (primarily), it has no place at all since in the case of infringements leaving the personality untouched, only the punitive function would be exercised, which is completely incompatible with the inherently remedial, corrective nature of private law. According to the unanimous opinion of the legal literature, the compensatory function should have priority and private punishment only take precedence of a secondary nature. On the basis of my work, it is noticeable that judges also consider damage charges as a legal instrument to repair the immaterial injuries suffered and to compensate for the lost pleasures of life, and to not order it upon preventive reasons solely, but in the plurality of cases, preventive function is being evaluated as a factor enhancing the amount of the damage. In my study, I wish to analyze from several aspects, how the dual function of the damage charge is assessed by the courts concerning present cases, by highlighting which nature is protruding concerning the amount or the legal basis. As the research is basically empirical, I will examine through as many judgments as possible, what aspects the courts evaluate in the framework of the compensational (e.g.: physical injuries, mental changes, age, family life of the victim, change in lifestyle, etc.) and of the preventive function (e.g. the gravity of the infringement, its protracted nature, etc.). Finally, I would like to answer the central question of my thesis: what function does practice attribute to the payment of damage charges.

  • Die Erweiterung der Zivilluftfahrt in das Europäische Emissionhandels-System

    Nach der Einführung des Emissionshandels auf gemeinschaftlicher Ebene vor etwa einem Jahr hat sich die Europäische Kommission für die Erweiterung des Anwendungsbereichs des Systems entschlossen. Da der Luftverkehr und damit die Emissionen aus dem Luftverkehr dermaßen – trotz der technischen Fortschritte – gestiegen sind, sind über die verschiedenen möglichen Instrumente nachzudenken, mit denen im weiteren die negativen Auswirkungen der Treibhausgasemissionen – anfangs nur die Kohlendioxid – aus dem Luftverkehr zu vermeiden sind. Hier können technischen, ökonomischen Lösungen in Frage kommen, doch scheint heute die Einbeziehung des Luftverkehrs ins Emissionshandelssystem am effektivsten zu sein. Damit kann ein Instrument, das sowohl regulatorische, als auch ökonomische Elemente enthält, eingeführt werden. Wegen der eigenartigen Eigenschaften des Luftverkehrs tauchen rechtliche Probleme auf, die von der Kommission baldmöglichst gelöst werden müssen. Solche sind die Kompatibilität einer eventuellen Einbeziehung in das Handelssystem mit dem Chicagoer Abkommen, das die internationale Zivilluftfahrt behandelt und damit Verpflichtungen nicht nur für die Vertragsparteien aus der Europäischen Union, sondern auch für weitere Staaten bestimmt. Die Kompatibilität der Einbeziehung ist auch im Zusammenhang mit dem Kyotoer Protokoll zu überprüfen, nach dem wegen dem Sonderstatus des internationalen Luftverkehrs die internationalen Luftverkehrsemissionen nicht den nationalen Emissionen der Vertragsstaaten des Kyoto-Protokolls zugeordnet sind.

    Vor der Erweiterung des Systems ist auch der Kreis der Verpflichteten festzustellen, wobei auch an die geographische Reichweite des Luftverkehrs und die wettbewerbsrechtliche Aspekte zu denken ist. Als weiteres beschreibt der Aufsatz die Frage der Erhebung einer Mineralölsteuer auf Kerosin (sog. „Kerosin-Steuer”) auch für die gewerbliche Luftfahrt, damit die bisherigen steuerlichen Vergünstigungen für den Luftverkehr abgebaut werden könnten. Im Aufsatz wird von der ICAO (International Civil Aviation Organization) erarbeiteten drei Systeme vorgestellt, nach denen die Emissionen aus dem Luftverkehr in Betracht werden können, unter denen sich sowohl die ICAO, als auch die Europäische Gemeinschaft für das offenes System ausgesprochen haben.

    Schließlich werden die eventuellen direkten Auswirkungen der Einführung des Luftverkehrs in das Emissionshandelssystem behandelt.

  • Comparison of condemnation and declarative litigation, special conditions of declarative claims

    For the first, I think that it is necessary to make clear what action is.

    The action the application to the proposal of which the half interested in the debate is entitled and the court passes judgement on it. Bringing an action to the court is the prerequisite of the setting in motion of the civil action procedure.

    The plaintiff asks it for the restoration of his violated subjective right practically in the action of detaining to oblige the defendant. The object of the action of detaining the claim originating from the violated subjective right, the controversial material legal contractual relationship, his content though the plaintiff’s application, that let the court oblige it defendant onto a particular activity, abstaining from it.

    Basic rule: action of detaining expired in case of claims only enforceable. The action of assessment in so much action of detaining, that it positively aims at the court establishing it for the plaintiff’s right and the existence of the defendant’s asking to stay being mentioned.

    It being possible to initiate action of assessments has two conditions conjunctive: the legal defence for the claim of his necessity and the impossibility of the vindication. The content and the consequences of the action of assessment considering too narrower than the action of detaining.

    The plaintiff’s aim in the action of assessment, that the court clears up whether one of the contractual relationships exist with a judgement or not, it does not claim him accomplishing a defendant’s active behaviour beyond this. The deficiency of the execution follows from this, the giving onto an end which can be grown in the part of a judgement saying detaining in the legal charge only.

    Verifiable, that the action of assessment independent legal defence device quality actions. Categorically cannot be declared, if action of detaining possible, assessment one is not eligible. The clarification of the situation and correcting him wait for the legislator however.

  • The principle of the separation of power in the works of István Bibó

    The purpose of my study is to examine the theories of the separation of powers and its application in different periods. My investigation based on two monograph from Bibó: The Principle of the Separation of Power Sometime and at Present, and Lawfull and Effective Administration, Firm Executive Power.
    The ancient philosophers have already dealed with such theories. Among of them Aristoteles has the largest importance defining the three main powers: the legislation, the executive power, and the iurisdiction.
    The most substantial step in the Middle Ages was creating the moral basis for exercise of powers. The reformation and the development of civil society has improved this conception, Montesquieu attributed the powers with function, and emphasized the separation of them. Nevertheless István Bibó emphasizes not only the separation, but also the struggle against the concentration of power, and the abuse of power. The principle of the separation of powers could prevail clearly only in the USA, but not in Europe. István Bibó explains the causes of
    those in his monograph (The Principle of the Separation of Power Sometime and at Present).,for example the function of the monarcha or the principle of sovereignty.
    Bibó defined the obstructive factors in realisation of the principle of the separation of powers. These are: bureaucracy and the exorbitant state role in the economic and in the culture.
    In his other monography (Lawful and Effective Administration, Firm Executive Power) Bibó describes the necessary elements of lawful and effective administration, like loyality, professionalism and effective enforcement. At the same time, by realisation of these, the risk of the abuse of power could arise, creation of a new power would be therefor necessary. This power might be a regulatory power, which would be able to define the main criteria of exercise of power. Beforehand the church played that role, but in the twentieth century its function became vacant. I think the function of the new power would be similar to the role of the Constitutional Court at national level, or to the role of the European Court of Justice, of the International Court of Justice, and of the International Criminal Court at international level.

  • The legal basis and the conduct of probate proceeding, particularly the distribution of the tasks in the proceeding and some of the possibilities of appeal

    As the title suggest, the study intends to provide a summarized overview on the regulation of probate proceeding. The legal nature of out-of-court proceeding and the various stages of the procedure are briefly presented in this study. The procedural steprelated to the task of inventory taking and each stage of the proceeding related to the notary public are explained too.     A szerződések joga a polgári és kereskedelmi jog egyik legdinamikusabban fejlődő jogterülete napjainkban. A szerződéskötési technikák, a szerződések teljesítése, valamint a szerződéstípusok köre is új tartalommal telítődik. A jogterület fejlődésének és népszerűségének alapköve a római jogban gyökerező szerződési szabadság mai napig fenntartott tétele. A szerződési szabadság négy fő aspektusa (szerződéskötés szabadsága, partnerválasztás szabadsága, típusszabadság, tartalom szabadsága) biztosítja, hogy a szerződések jogának szabályai könnyen alkalmazkodnak a társadalmi, gazdasági változásokhoz. A szerződő felek jogviszonyukat személyre szabottan alakítják, az e köré keretet építő kontraktus szabályait nagyfokú szabadsággal formálhatják. A szerződések jogának alapelve a modern jogrendszerek alappillére, azonban értelmezése, megítélése államonként és időszakonként változik. Ez a változás sosem tekinthető visszalépésnek, vagy az alapelv lényegi jelentését átértékelő, lerontó változásnak. Az azonban kétségtelen, hogy a szerződési szabadság alapelvi szintű elismertsége egyes nemzetek jogrendszerében valódi operatív alapelvként jogvitát eldöntő, joggyakorlatot fejlesztő mozgatórugó, míg más nemzetek jogalkotásában és jogalkalmazásában az állandóság megtestesítője e gyorsan változó jogi környezetben.

    A tanulmány a szerződési szabadság aspektusainak jelentéstartalmát elemzi a kontinentális és az angol-amerikai jogrendszerek írott szabályainak és jogalkalmazási gyakorlatának függvényében. A jogtudomány értelmezései, konkrét jogesetek szentenciái, valamint az írott jogforrások indokolása adja a tanulmány kiindulópontját. A szerződési szabadság korlátlan érvényesülését „lerontó” szabályok (pl. szerződéskötési kötelezettség, formakényszer, stb.) az alapelv céljának és létének fényében kerülnek vizsgálat alá. Az angolszász rendszerekben az alapelv által generált jogfejlesztő értelmezés a kontinentális jogok lassan változó szemléletével ütközik.

    A tanulmány célja, hogy a szerződési szabadság alapelvének funkcióját megvilágítva bemutassa azt a lineáris jogfejlődést az európai jogi tudományosságban, mely a mai tartalommal ismert alapelvet alkalmassá teszi a szerződések jogában fejlődést generáló és iránymutató szerepkör betöltésére.

    Almost all modern civil legal systems respect property rights as a privileged and fundamental right, which means the property rights of individuals cannot be restricted or taken away without due process of law. In the case of insolvency proceedings, the person's right to property is violated, as the debtor is deprived of this right, at least partially. In such situations, the property rights of the debtor and the creditor are strained against each other, even to such level that the debtor's livelihood and alimentation is threatened by the satisfaction of the creditor's demands. During insolvency proceedings, we should restore the property rights relationship that was broken on the part of the creditor as a result of the debtor's behavior at the expense of the debtor's assets, ensuring that the debtor's interests are also protected, and that the proceedings take into account the interests of both parties. National lawmakers should, therefore, take several aspects into account to create the material and procedural legislation on the basis of which property of private individuals can also be subject to insolvency proceedings. Lawmakers should act in an environment where, due to the impact of globalization, it is no longer evident that the debtor and the creditor are citizens of the same country. This is the reason it is also important to examine how the European Union regulates insolvency proceedings in the case of consumer over-indebtedness in a manner that crosses national borders and still remains inside the Union.
