Kelsen államelméletének alapjai
Megtekintések száma:55Hans Kelsen was maybe the most famous philosopher of positivism. He became known from various theories that he made in the philosophy of law. Evolution was the characteristic feature of his scienfitic achievement. We can see this development for example in the theories 'origin of the state' and 'will of the state'.
In 1925 Kelsen made a resume of his theories. This was the "Allgemeine Staatsrechte", which was followed by the "Grundriss einer allgemeinen Theorie des Staates" (Basic rules of the theory of the state) in 1926, which was the shorter form of the previous resume. The following summary can be made of these studies:
Kelsen made a thorough and detailed examination of the science of law, and realized that the point of view juristical a sociological theories are mostly influenced by the political tendencies. He criticized the dual system of the law of the rules and the law of the individual and he did not make difference between law and state.
State is somehow the order of the human behaviour. State can be only mentioned as order, where human facts and human behaviour are in symphony. When the rules of the state are dominant, people observe its instructions, sometimes in spite of the different rules of nature. The will of the state doesn't mean all the will of every human being of the state, it's different, it means, that all the rules are made by the state are valid.
State is not only some kind of authority and a valid order, which is followed by people of the state, it is also effective. This effective means, that people of the state observe the instructions of the state, they act according to these instructions. The system of the rules don't make this effinence on its own, it is helped by the psychologically processes of human beings, that they are obedient to these rules.
Law and state exist when its authority is felt, and this authority can be felt only in case, when law and state exist. Validity means, that rules must be followed. Validity doesn't depend of efficiency (if it is regularly followed by people). Anyway, the rule which is followed by nobody is not valid, but there is no rule, which is followed by everybody. Permanency is not the prerequisite of validity.
We can draw up the following question: why seems to be different the act of the state to other type of acts. Every act of the state is committed by a human being, nevertheless we consider this act to the state. Kelsen says, that 'state' is a fixed point of special human acts. We can consider an act as natural or normative one. An act is natural, when it is caused by natural processes. But an act, when it is committed by a human, and the same time it is the manifestation of the state, it corresponds to the order of norms. Norms are rules, and if we follow them, our acts can be considered as a normative act.
State can be considered as a group of acts, which can be obtained by force. Obtaining is not the way of enforcing the law, it has got only preventive and deterrent function.
Kelsen sets up the formal an the material definition of the state itself, the definition of state organization, and makes difference of them. Formal state is a larger category, it means the order of law, and all the legal acts. Material state is a smaller category, it contains only some types of norms, like applying the law, and the rules of administration. Material state organization is also a smaller category than formal state organization. It means those acts which are used for obtaining, and also means the function of administration.
In his studies Kelsen criticized the dual system of the law of the rules and the law of the individual and he said, that law and state is the same. State is equal to all the rules of law, and makes them valid. That is why state can be regarded as law.

Megtekintések száma:70The essay is about the clause of foreseeability in connection with damages for breach of a contract. This seems to be a constant problem throughout the history of law how and when it is reasonably to limit the amount of damages in case of breach.
The general principle of full compensation originates in the main purpose of private law, restoring the violated financial situation. At the same time in business relations it often happens that damages occurred as consequences of breach highly exceed the contractual interest of the party and generate indirect damages independent from the violator’s influence. This is considered to be the starting point of the dilemma about restricting the damages availably for compensation.
Full compensation and its relation to breach of a contract occurred in the Hungarian jurisprudence many times. Miklós Világhy suggested the reconsideration of full compensation in contract law in 1971. Attila Harmathy also suggested the implementation of foreseeability clause in the rules of contract law as the ‘best possible way to treat business relations between the parties’.
Due to the historic and social differences various forms of foreseeability are known in the legal systems.
The study examines the development of foreseeability, its first codification in the French Napoleonic Code Civil, its application in the law of the USA and some significant sentences of English courts. The first application of foreseeability was in the infamous Hadley v. Baxendale case, in which an English court worked out the meaning of contemplation rules. In the case of Victoria Laundry Ld. v. Newman Industries Ld. (1949) the court defined the meaning of foreseeability. According to the sentence of the case damages are limited to those that were foreseeable for the party at the time of entering a contract. The study also analyzes the German model of restricting damages of breach. The German theory ensures the possibility of exoneration for the violator if the other party failed to give proper information about the unusual danger of breach in the particular case. If the entitled party acted intentionally, the German law accepts exoneration. The essay demonstrates the adequate causality conception of the German law. This theory states that an act can only be the probable cause if – due to the normal and reasonable procession – it is able to cause such consequence. In our opinion foreseeability gives a stricter and much better solution of restricting damages with a more objective measurement for the obliged party on how to calculate his behavior in a certain contractual relation. The amount of risk can be predicted if the rules of damages for breach are based on foreseeability rather than adequate causality.
The new Hungarian Civil Code plans to establish objective liability in contract law. The only exoneration can be the successful reference to unavoidable external cause. Beside this stricter liability the new Civil Code also introduce the possibility of limitation in damages, the application of foreseeability clause. This seems to be a significant preference for the obliged party. As in the Hungarian legal history foreseeability clause was never used, it is an essential question how judicature will interpret the rule in practice. In our opinion for an adequate application of the new clause it is necessary to take a closer look at the United Nations Convention on the International Sale of Goods (CISG), the Principles of European Contract Law (PECL) and the interpretation in the American and English case law. This study tries to give some help for it.

20-28Megtekintések száma:249The “agreement on non-competition” is essentially the extension of the protection of the basic economic interest of the employer. While during the employment relationship several labor law provisions protect the interest of both parties, the “agreement on non-competition” is designed to protect the employer’s interests after the termination of the relationship. This means – in return for financial compensation – the former employee needs to refrain from any kind of business competition against his/her former employer. This necessarily involves financial compensation and may have several restrictions, such business or geographical area or time.
The previous Labor Code did not specify for detailed regulation of the issue and the law remained rather vague. It merely referred to the fact that parties – based on their own free will – may enter into such agreement. However the new Labor Code contains explicit regulations under title XVIII of the Act as “Particular Agreements Related to Employment”.
The “agreement on non-competition” belongs to the field of employment law. Unlike the previous Labor Code that categorized this possible agreement as of purely civil law in nature, the new Labor Code declares it to belong under the scope of the Labor Code. The previous regulation even ordered the provisions of the Civil Code to be applied to such agreements however the new legislation brought a conceptual change.
The currently effective regulation provides for a 2-year limitation on such conduct on the employee’s part that would create competition with the employer. The exact amount of the consideration payable for this obligation remains to be decided by the parties however the Labor Code suggests that it shall be based on how difficult the applied restrictions make it for the employee to find another job with his qualifications and experience. As a basic limit the law provides that the amount shall not be less than one-third of the base wage payable for the same period of time.
The “agreement on non-competition” is not to be confused with similar legal institutions. The paper points out two close similarities in the legal system. One being the employee’s obligation of confidentiality; this prevails after termination of the employment relationship as well without any time or similar restrictions and even without any financial compensation. The other one is the so called “non-compete” agreement from the field of competition law. This is applicable after takeovers where the seller shall refrain from engaging into business in the same area as the buyer.
In the field of labor law the time period for the “agreement on non-competition” is up to the agreement of the parties however the new law invokes an upper limit of two years that is following the termination of the employment relationship. This is a decrease from the previous regulation that provided for a period of three years. The agreement can be modified by the consent of both parties just like the employment contract or civil law agreements.
In case of violation of the agreement three cases are to be analyzed. The first is the case of the employee breaching the provisions of the contract. In this case the employee is liable for damages towards his/her former employer. The provisions of the new Civil Code and those of the Labor Code are to be applied to the damages. In the second case the employer may request an injunction to prohibit the employee from any conduct breaching the agreement while the third case involves the breach of the agreement on the employee’s part for which the rules of the Civil Code and the Labor Code are to be applied as well.

Megtekintések száma:121The most important human rights were firstly defined by the French Declaration from 1789. These rights are called as first generation rights, because they guarantee the most important civil and political rights of people. The states mostly act passive in order to protect them. They create acts on their protection, special mechanisms for enforcing them. We can state that every field of law is based upon them and helps protecting the human rights.
The right to a fair trial is a first generation human right. Its regulation scheme is very complex; therefore it is a hard and a complex task to define the importance and the key functions of this right, because the laws on it are varied. Besides civil procedural law, international law, EU-law and – within national legal systems – constitutional law has also been dealing with the right to a fair trial.
In the field of international law many international and regional treaties exist on the enforcement of procedural rights. In my paper I examined the European Convention on Human Rights (hereinafter: ECHR). The ECHR is an international treaty on the protection of human rights. It was born under the auspices of the Council of Europe in 1950, Rome. From 1959 its control mechanism is the European Court of Human Rights.
In my paper I examined the proper interpretation and the actual application of the ECHR art. 6. par. 1based on the work of the international court.The article 6 of ECHR is about the right to a fair trial. In par. 1 the Convention gives a list of the most common features of a fair trial: (1) a fair and public hearing; (2) with a reasonable time; (3) the tribunal must be established by law and must meet with the requirements of independency and impartiality; (4) and finally the judgement shall be pronounced publicly. It enshrines the principle of the rule of law, upon which such a society is based and built.
The first chapter deals with problem of the interpretation of the article. I tried to give the most convenient statements, which I defined upon the case law of the ECHR. After the question of interpretation is answered, the third chapter tries to give an overview of the applicability of article 6.In this section I cited many cases of the ECHR, because the Court has been developing the question of applicability in its case law. It is because it considers the Convention as a living-organism, so the article 6. needed to be interpreted again and again during these decades.

Megtekintések száma:295Contractual relations mean balanced cooperation between the parties. Right and obligations on both sides are equal. This seems to be a classic essential of contracts. As of many among the terms and condition in contract law, special situations clam for a different perspective. This essay is about a unique problem in contract law that origins from the ancient dilemma about the role of the state in private law relations.
State as a sovereign has original power and hierarchic connection to citizens. In the field of constitutional law, public administration law, criminal law it is necessary to transfer certain right to the state and allow it determining one-sided obligations that cannot be changed in a particular relation. The theory of state immunity failed in the 20th century in private law. Since jurisprudence makes a difference between the role of the state as a merchant and a sovereign, we cannot maintain the old immunity rights of the state anymore.
In the essay we examine three specific questions in connection with state participation in contracts. The first part of our study analyzes the strange legal arguments in a famous Hungarian case, called the Subway case. In this case the reasoning of the Supreme Court denied the balanced elements in a private contract and accepted a redefined theory of state immunity in private relations. Although there is a strong political content in the story and right after the criticized decision the Hungarian Civil Code was modified to clear the facts, we want to prove that even today state participation can cause interferences in the coherent theory of contracts.
A specific contract type is examined in the second chapter of the essay, the concession agreement. This contract is far from the balanced theory of party positions due to its unique nature and content. We emphasize many different aspects in mixing private and public law nature of provisions and rules. Concession agreement is an excellent example to demonstrate extra-rights on the side of the state.
Finally we spare some words on authority contracts in which state authorities can manage debates in public administration procedures with using the private law nature of contracts.

Megtekintések száma:52To describe the functions of principles we can say that all of them are fundamental basis of an area of law. They declare or solve concrete debates between the parties. If there is a problem with interpreting of a rule in the civil code, judges has this helping hand. In Germany the development of principles in the field of contract law has a really unique historical root. At the time of BGB’s birth, the German Civil Code did not accept any exculpation under the rule pacta sunt servanda. Moral philosophers acknowledged that a contract as private interest of the parties needs special protection from the state. It is not only a personal relationship, because self welfare leads to welfare of the public. The law has to regulate this field and give instruments of protection for both parties to ensure peace and equality in the field of public relations and moral.
After the First World War, Rechtsmark (German currency) had its deepest point in its history. The inflation was so high that the performance of a contract made before the war was absolutely unfair for the supplier. For the cost of one galloon gas anyone could buy the entire stock after the war. There was a too late and too small reaction from the state for this situation. An Act had been accepted in 1925 about revalorization. The main fault of this Act was the strict and very small applicability in the field of contracts. The regulations of it were applicable only for contracts with large economic potential.
German jurisdiction had to solve the problem. The most difficult part of this process was how to dissolve the strict paradigm of pacta sunt servanda. Oertmann, a German legal expert created the collapse of the foundation of the transaction. It meant that changed circumstances deprive the contract from its ground, the need of the party. Anybody who signs a contract has a need and tries to create all conditions of that specific contract to harmonize with his or her needs and interest. In case of an essential change of circumstances this interest modifies and the original transaction became tremendously onerous for him or her. The doctrine of Oertmann was insisted on pacta sunt servanda, so after the change of circumstances the whole contract failed.
Jurisdiction in Germany accepted Oertmann’s doctrine with a completion. Judges vindicated the right for themselves to modify the contract to be suitable for the new interests of the parties. This modification meant the implementation of clausula rebus sic stantibus into German contract law. It became applicable worldwide in the field of long term relationship of the parties.
In this essay I examine not only the development of these contractual principles in Germany but the effectiveness and functions of them. I describe and define the legal interest of regulating contracts and what is the connection between private and public interest in the field of the law of contracts. As a defect of the contractual procedure non-performance and other breach of a contract have special importance in civil law. Good faith is a basic principle of civil law in Hungary too and in most European civil codes. The interpretation of German good faith theory (Treu und Glauben) is significant from the viewpoint of the judicial modification of contracts. In case of clausula rebus sic stantibus if the party wants to ground his or her claim, he or she has to prove the good faith as a moral standard to be an exculpation under the heavy burden of pacta sunt servanda. The conclusion is that in Germany the basic element of private contracts is not the consent of parties but good faith of them. The socially excepted moral appears through the requirement of good faith of the parties. The law has to ensure that in any period of a contractual relationship this good faith exists.

2-11Megtekintések száma:135Local governments may establish legal relationships governed by civil law in numerous ways, for example, through the creation of associations, various institutional agreements or they can also do so by means of enacting regulations. In line with the stipulations of the Fundamental Law of Hungary, local governments may adopt regulations on two legal bases: if authorized by law or if they want to regulate a local public affair; however, the regulation may not contradict any higher form of legislation. While in the first case it is not only the right but also the obligation of local governments to enact regulations that can even be sanctioned, in the second case it is almost completely optional. The scope of public affairs regulated by local governments is rather broad. While the smaller local governments typically limit their activities to the regulation of the most urgent matters, the larger local governments enact regulations in a wide range of issues also due to the volume of their responsibilities. In many instances a part of these regulations does not remain within the framework of supremacy but also includes numerous elements of civil law. These could include matters related to parking or municipal housing, as well as problems in connection with public services. Norms regulating peaceful public coexistence represent a separate subject area as in many cases they wish to regulate legal relationships pertaining to privacy. In the case of the latter issue, the clause stating that the local regulations shall not contradict any higher form of law is especially central, as it necessitates the extensive knowledge of civil and in some cases even constitutional law to ensure that such a regulation is enacted that fully complies with the laws.
This paper introduces and examines those local government regulations that include elements of civil law also and which typically cause problems, with special emphasis on the rules of peaceful public coexistence. Some of these problems are revealed within the scope of legal supervision practiced over local governments, while in other cases the body reviewing the regulation acts in response to citizens’ initiatives.

Az MH-17 légi járat lelövésének nemzetközi jogi megítélése a nemzetközi polgári repülésről szóló Chicagói Egyezmény tükrében
Megtekintések száma:84This paper addresses the downing of Malaysian Airlines flight MH-17 in 2014 from the perspective of the Chicago Convention on international civil aviation. Two issues are closely examined namely the applicability of Article 3bis on prohibiting the use of force by states against civil aircraft to the specific case and States’ obligation to close the airspace to civil aviation over conflict zones.
If the assumption of the Joint Investigation Team is correct in that flight MH-17 was shot down from a territory held by separatist groups it will be a legally challenging task to prove the necessary link to Russia requried by international law to determine state responsability for the breach of Article 3bis. The fact that the International Court of Justice has never delivered a judgement on merits concerning aerial incident cases due to the lack of jurisdiction does not advance the prospect for a reassuring conclusion of the case concerning flight MH-17 from the perspective of international aviation law.
The obligation to close the airspace by the state exercising sovereignty over the airspace over conflict zones is not spellt out explicitly in the Chicago Convention. States responsible for the airspace should however close their airspace if the airspace in question is not safe for civil aviation. The critical question remains whether the state responsible for the airspace has all the relevant information at its disposal when making the complex decision about closing the airspace. In case of a non-international armed conflict non-state actors are not obliged under the Chicago Convention to share aviation safety related information with the enemy state responsible for the airspace under international law over the conflict zone.
It is hereby proposed that binding regulations should be adopted either in the field of international air law or humanitarian law to the effect that during an armed conflict non-state actors co-operate in information sharing for the sake of guaranteeing the safety of (international) air traffic.

Megtekintések száma:62On the very swampy field of damages for non-pecuniary loss there is a special problem called claims of relatives. These claims are also known as claims of secondary victims or third parties. In this legal situation the injury itself hurts not the claimer himself. The claimer has non-pecuniary or moral loss because of his connection with the injured person. He is not the direct and suffering subject but the one who has a loss in his personal rights.
In Hungary the question is whether these claims can be permitted or not. During the changing structure of damages for non-pecuniary loss in the second half of the 20th century, this problem fitted to the actual judgement of moral damages. Now days the question is a little bit easier: in almost every decision courts admit the right of relatives to claim damages for an injury against there beloved relative, but in most of the cases they demand that plaintiffs has to demonstrate manifested losses not only the infringement of their personality rights.
In this essay beside the Hungarian jurisdiction I examine German, French, English, Belgian and Dutch legal points of view too. The most interesting and – in my opinion – the one that can be useful for the upcoming new Hungarian Civil Code is the Dutch system.
Dutch Civil Code limits the possibility of ‘third parties’ to claim damages for non-pecuniary loss as a result of the injury or death of another person. In typical cases the plaintiff would like to claim compensation because he suffered mental illness from witnessing the death of another person, namely a relative. This claim is not awarded by Dutch courts because of the prohibition of Civil Code, but the interpretation of the mentioned provision lives restrictively in jurisdiction. We can find two situations when the claim of third parties can be awarded. First of all, the claimant can only claim for damages, caused by a mental trauma because of being witness of an injury against another person, if he can establish that the aggressor (defendant) also committed an unlawful act vis-à-vis the claimant himself, which resulted in the trauma. It is really difficult to be demonstrated because of the causation required by BW. The process to verify that the aggressor, who committed an unlawful act against another person, causes the trauma is almost impossible in some cases. The second chance of the secondary victim to claim for compensation is if he verifies that the trauma amounts to physical or non-physical injury. If this is the case, the claimant can get compensation of his pecuniary loss (such as cost of medical treatment) and non-pecuniary loss on the basis of his non-physical personal injury.
A famous case in Dutch case law is ‘Taxi bus case’. A 5-year old little girl was riding her bike close to her home, when a taxi bus overruns her. The bus actually rides over the girl’s head. The mother was immediately warned by one of the neighbours and found her daughter with her face turned to the ground. First, the mother called the ambulance hoping that the girl was still alive. When the mother tried to turn her daughter’s head to look her in the face, she experienced that her hand disappeared into the skull of the girl. The mother noticed that the substance next to her girl’s head was not, as she considered, her vomit, but appeared to be the girl’s brain itself. The mother suffered severe mental illness because of the shock of this sight and the realization. Dutch law is consequent in the question that there is no claim for non-pecuniary damages subsequent to death of a relative. Taxi bus case was the first when Dutch Supreme Court awarded the right to compensation of non-pecuniary damages to somebody who lost his relative. The decision contained that the act committed towards the child, must also be regarded as tortuous towards the mother. The Court emphasized that there was a distinction between the consequences of the child’s death, for which no non-pecuniary damages may be awarded, and the consequences of the confrontation with the accident, for which damages may indeed be awarded. The mother received 14,000 Euros for non-pecuniary damages. This case shows that although in principle the plaintiff has a right to claim compensation for the exact damages he suffered, the courts are free to assess the damage in a more abstract way, if that corresponds better to its nature.
Examining this case it is obvious that extra conditions are demanded to claim for non-pecuniary damages because of the loss of a relative. Only the fact of losing a close relative is not enough for a successful action. There have to be special circumstances, which demonstrate that the unlawful act made a direct effect to the plaintiff, who became the primary victim.
The English solution is interesting because not only the relatives have right to claim but almost anybody who can verify a close relationship with the injured person. In my opinion this system ensures a more coherent and logical jurisdiction, because during the examination of authorization not only a legal fact – being a relative of the injured person – establishes the right to claim but a real emotional relationship.

A szerv- és szövetadományozás polgári jogi érvényesíthetõsége, avagy jogi szabályozásának ellentmondásai
Megtekintések száma:62Developments in the last centuries in the fields of pharmacy and surgery have had a beneficial effect on the treatment of various diseases and injuries. As a result these two areas have attracted the support and admiration both of the scientific world and the general public.
The examination of the effects of taking part by human beings has become unavoidable in the healing process. This relationship is unusually complex regards scientific opportunities and fragile in respect of people’s defencelessness.
Important legal background material is available today relating to organ transplantations. It must be recognized, however, that this legal corpus has been a long time in the making and is still taking shape even today. Although people are trying to establish suitable legal framework for medical law, there are still some weak points and „prejudices”. Nowadays it is necessary to make an attempt at reconciling medical science and law not forgetting about the fact that their approaches are different.
Medical law is not just about damages. Informing about the topic, the rights and the possibilities, preventing the trials: all of these things are more important. First of all, this is a life-saving procedure and money can not „repair” the problem in that case. Although it sounds cliché, it is true: you can not replace the unpurchasable organ by money. On the other hand, this should be a teamwork between the donors and recipients. They have to cooperate. The „job” of the law – which tries to be objective while it makes rules- should be to consider both views.
It is well-known that the waitinglists are very long. What is the reason? What kind of solution is able to make the waiting-time shorter? These are very serious questions but the efficient transplantation is the most important. Transplantation is one thing and surviving it is another. And top of all that there is the problem of the „tragedy of the transplantation”: it is often said that donors have no rights. Which should/ can be preferred : the right to live or the right to voluntarism?! Can you decide which system (opt-in or opt-out donation system) gives better solution?!
Giving a right answer is not so easy. Opt-out system may increase the level of available organs but it does not mean necessarily that there will be more organs for donation with absolute certainty. That is why you can not say simply that the „donor-licence” is a bad idea. There are lot of „ingredients” you should consider: technical developments, public education and last but not least social acceptance. According to the law in the opt-out system doctors should not ask the relatives about their opinions but it is said they usually do it. Is this an efficient system?!
In my opinion an effective „dialogue” is needed -not only between law and medical science but between the organ donation systems, too- for the sake of a „flexible” legal background which can take part actively in our everydays in the 21st century.

A monista felfogás érvényesülése a szerzői jogi törvényben
Megtekintések száma:72Examining the history of copyright law, we can distinct two significant theories. The distinction is based upon the position of entitled parties. Two separated fields can be found among the rights of the author: personal and financial rights. It is no doubt that personal rights are inseparable from the author itself, these rights cannot become objects of commercial businesses. If we look at these rights a little bit closer, we can realize that personal rights of the author do not play significant role in earning money from an intellectual product. These rights ensure the integrity and originality of works. Separating the two theories we have to focus on financial rights. Trying to describe these rights we can see that no exact definition can be given to them because of the permanent development of printing and publishing technology. Due to the monist theory it can be said that financial rights are close to personal ones, they are inseparable from personality of the author. Transcribing this opinion to the language of law it means that the decent regulation should prohibit the transfer of these rights among living persons. In the Anglo-Saxon legal system experts think that financial rights have to take part in commercial trade if we want to acknowledge the achievement of authors.
In Hungary copyright law is on the point of the monist theory. The Act refers that financial rights of the author cannot be transferred and the author has no right to abandon them. If we get a closer look at the structure of the valid Act, we can say that monist theory is not consistent. It is possible to inherit financial rights. We need this rule if we would like to harmonize the system to the time of protection. The other relevant fact of crossing the prohibition is in connection with works created under labour frames. In this case the employer gets financial rights ex lege. To find the reason of this regulation we have to examine the nature and aim of labour relations. The employer gives payment to his employee, the author to establish and create works. In this situation it is natural that the author looses his financial rights. The problem is that in Hungary differences can be found between civil and labour law. If we try to give meaning to labour relations, misunderstandings and different point of views can reveal. The other problematic factor is that the Act does not bother with the question of succession.
In my study I present the pros and cons of both theories and gather those significant practical and theoretical fields of copyright law that can be limits of monist theory. I examine special rules for special works, rules of civil and labour law in connection with authors and give a short historical overview to see what can be the main directions of future developments.

62-68Megtekintések száma:95The Committee of the European Union after the issue of the Directive 98/71/EC found that the integrity of the internal market needs an easily accessible uniform protection of designs that covers the whole territory of the Community. For this reason was issued the 6/2002 EC regulation on Community Designs. The most important definitions and the grounds for invalidity are absolutely identical in the directive and the regulation. May aim by this short essay is to interpret the main definitions of design law by analysing some published cases of the Office for Harmonisation in the Internal Market (OHIM). The case law has important role in the field of design law since the requirements of protection and the grounds of invalidity contain a number of unique terms can be construed only by practice. As a consequence of the harmonised design law the practice of the Office can exercise a strong guiding effect not only on the application of community design law but national level design laws in the procedure of the national offices and courts. . 25 (1) point b) is the most used ground for invalidity in practice when a conflict with Art. 4-9. occurs. Within this point lack of novelty, individual character and prior disclosure shall be mentioned first of all. In the relation of novelty and individual character it seems of the cases that lack of novelty always excludes any further examination of individual character since individuality can be considered a narrower definition of novelty. By analyzing the overall impression produced by a design to an informed user the Office always underline that the difference must be instantly and obviously recognizable. The impression shouldn’t be based on through examination of the informed user. The invalidity division stated that any prior design in important databases on internet shall be deemed to be known by the specialised circles and can result the disclosure according to the regulation. In connection with features dictated solely by its technical function the Office stated that designs contain only elements of merely technical purpose (in this case an engine block and engine parts) specific position of such elements and the general impression of the whole enough to provide legal protection for such features. There is no ground for invalidity pursuant to this reason if the same technical function can be achieved by different design.
In my essay I focused on the most the above mentioned most relevant parts of some definitions. My future plan is to analyse the differences between the legal practice of different European countries concerning this issue.

A „távollétes ügyek” egyes elméleti és gyakorlati kérdései a büntetőeljárásban
Megtekintések száma:62The idea of simplification of the law of criminal procedure has been an interesting topic in the science of law for a long time. Practical necessities, namely the overburdening of the criminal courts and the new challenges of the criminal law called this concept into life. Finishing up a procedure in a reasonable time limit is a very crucial interest – as it was pointed out several times by the Council of Europe, Committee of Ministers and also the Hungarian Constitutional Court. As the international principle declared in the Human Rights says everyone has the right to plead its case within a reasonable period and it can only be achieved that way.
Because of the reasonable time limit required for a procedure, various simplifications of methods have been introduced into the national systems of criminal procedure. As a part of this process several legal institutions were introduced in the Hungarian law system aiming to accelerate the legal procedure. One of them, which is called special procedure against absent accused, is regulated by Chapter XXIV. of the Law of Criminal Procedure.
This essay deals with this special procedure in details. Firstly I show through a short international outlook how the procedure against absent accused appears in the practice of the European Council and the European Union. Hereafter a certain case is examined in details where the European Court for Human Rights considered the necessity of the accused person’s appearance. The Court established a principle if the absence of the accused had hurt the requirements of the fair trial. According to this the appearance of the accused person is necessary if it could play a role in the forming of the Court’s opinion.
Next, I examine the problems connected to the Hungarian regulations because recently serious constitutional worries have appeared related to this legal institution. As a result of this the Constitutional Court made its decision (n. 14/2004) and found many paragraphs of the then existing legal institution unconstitutional. Based on this Decision I go through in details all the problems and requirements related to this procedure. In the light of this, the regulation effective from the 1st of January, 2005 is described, which – according to my opinion – meets the requirements made by the Constitutional Court, so it is exceptional and provisional.
In the next chapter certain practical experiences of the procedure against absent accused are examined. Here it is stated that the application of this legal institution is the rarest among the legal institutions aiming the acceleration of legal procedures. I explain it by the fact that this is a relatively young legal institution and there was not enough time since it was introduced to give certain conclusions, moreover the application is limited concerning the range of individuals. As a conclusion it can be stated that the application is more common in those cases where the accused is abroad but does not stay in an unknown place. I call the attention to some problems emerged in the practice as the protection of the accused, or the delivery of the copy of indictment and summons, etc.
As a final conclusion it can be stated that using this legal institution is not so common but the importance of this will increase in the future by joining to the EU because of the easier way of crossing the boards. Hopefully the regulation, which suits to the requirements of the Constitutional Court, will be proper to gain its original aim, namely to simplify and accelerate the legal procedure.

Megtekintések száma:166In many cases, owners have problems recovering their rented or arbitrarily occupied real estate. News often report difficult situations in connection with the evacuation of real estate. More instructive cases have also drawn attention to the severity of the problem. The study describes the rules for (litigation and non-litigation) court proceedings for the evacuation of real estate and does not deal with the enforcement procedures ordered by a notary.
The possibility to initiate emptying real estate non-litigation procedure - according to Vht. 183rd-184th § - is not well known widely. According to most people, almost the only possible way to reclaim the real estate is to litigate, although the possibility of initiating the non-litigation procedure has been provided for years, provided the conditions of the law are met. Emptying of real estate in non-litigious procedure is possible in the case of real estates by arbitrarily occupied real estates, fixed-term tenancy agreemens of residential premises and other non-residential premises, as well as other types of properties specifically designated by law.
The study presents the possible ways of carrying out the real estate evacuation, the enforcement procedure following the litigation procedure and the enforcement procedure initiated on the basis of a court non-litigation procedure, focusing primarily on proceedings commenced after 1. January 2018. The study deals with the legal background to the non-litigation and litigation procedure, the order for enforcement, the issuing, the service of an enforceable instrument, the possibilities provided by law in the event of non-execution, the short presentation of remedies. It also deals with some of the innovations introduced by law CXXX of 2016 on Civil Procedure Rules, suspension of enforcement, as well as the applicability of the eviction moratorium in each case. In the emptying of real estate, debtors often face criminal law. The most frequent criminal cases during the emptying of the real estate are presented in the study too (breach of seal, assault on a public official).

A honi büntetőjogi felelősség megállapíthatósága körében kiemelkedő szerepet tölt be ezen fogalom. A rendszerváltást megelőző korszak szocialista büntetőjogában a társadalomra veszélyesség fogalma a büntetőjog “osztálytartalmának” kifejezésére szolgált. E fogalom a 90-es éveket követően – a büntetőjog tudományában, a jogalkotás és a jogalkalmazás területén egyaránt – megtisztult a szovjet jogból átvett, pártállami politika célokat szolgáló tartalmi elemektől. Manapság már olyannyira nincs ideológiai, párt-politikai jelentéstartalma a társadalomra veszélyesség meghatározásának, hogy a büntető-jogtudományban jártás jogtudósok jelentős része, és az ítélkezési gyakorlat is - a német dogmatikából átvett - materiális jogellenesség fogalmi megfelelőjeként tartja számon. Human relationships are determined by the identity of a specific person, place in society, so it should be a fundamental right for all people in contact with the law. However, in certain life situations exercising these rights is necessarily limited, undermined, need frameworks. One of those situations in life with participation in health care in which the patient has to adapt in health care provider operating schedule, however, the Trustee is required to ensure the exercise of the right contacts.
The most prominent of patients' rights to human dignity, which is inferred from a mother right, from which a number of other important rights. One of these is the right to self-determination, which guarantees freedom of action of the human as an individual incapacity depending autonomous. For patient care recipients should be subject to the fundamental distinction that whether it is inpatient or outpatient care. In the latter case, it also suffers from significant limitations on the patient's right to self-determination , including personal freedom, opportunities for contact with other people. The right to self-determination in a specific part of the realization of rights is thus involved in the regulation of the contact, as during inpatient care plays an important role.
In today's modern society, the means of communication, networks of past explosive development, get more involved in the exercise of the right to life, human relations than before, with the elimination of the technical obstacles the spatial and temporal obstacles easily can be prevented. Life situation of the theme chosen exercise of the right of communication is of particular importance, because the patient's recovery depends not only on only physical but also mental condition, recovery can define what social relations, quality, intensity. The correspondence law of the health care law more the privileges include such other persons entitled to take the patient's inpatient sanitation place either in writing or orally to maintain contact, to receive visitors, the people he set out to exclude the visit , prohibit the fact of his treatment or the other information related to medical treatment reveals other.
The context of the law of correspondence can be said that relatively little addressed by legislators and by expanding the scope of the practice of law in the content, but would consider appropriate where more attention is added. It would be good detailed arrangements for the exercise of creating the right framework for the so - to clarify the scope of everyday objects, to establish rules for their use of health services that are appropriate for the task to allow the exercise of these rights - the first line telecommunications.

Texas Shoot-out, avagy biztosítéki konstrukciók a szindikátusi kötelemben
118-129Megtekintések száma:73The shareholders agreement is considered a typical contract. This agreement is concluded by and between the members of the company in order to establish the rules of the cooperation among them, their behaviour towards and expectations from each other in connection with the company.
The agreement is often used in the practice, since its flexible construction enables to rule various types of transaction. For example, in Hungary there is a growing tendency i.e.the major investments and joint venture agreements are being established in the frame of a shareholders’ agreement.
On the other hand, drafting such a contract is a complex procedure. This type of agreement is not governed by specific law, therefore the general rules of the contract law may be linefore. Furthermore the shareholders’ agreement is located at the borderline between the civil and company law, and in a given case it might be complicated to enforce the provisions of the agreement. For example, if the member breaches the voting provision outlined in the shareholders’ agreement, then the resolution passed upon the contract breach cannot be challenged.
Due to lack of a specific law, the practice created the adequate legal securities to ensure the enforcement of the cooperation structure outlined in the shareholders’ agreement.
As the first analysed security, the purpose of the buy-out clauses (Russian Roulette, Texas Shoot-out, Dutch Auction, Put-Option, Call-Option) is to ensure the company’s permanent operation, if there is an insoluble dispute among the members, which obstructs the decision making, and consequently the operation of the company, as well. The concept of the buy-out clause is to settle the dispute in the way of taking over the participation of the involved member by another member.
The exit clauses (Drag Along, Carry Along) aimed to encumber or to unburden the step out from the company. The entitled person is able to sell the shares of the remaining members to the buyer, or to oblige the seller to sell his own and the entitled person’s participations jointly to the buyer.
The takeover clauses’ (Control Flip Over, Swiss Clause) duty is to enable the enforcement of the corporate legal obligations outlined in the agreement. If a member fails to fulfil his obligations, the entitled person may acquire his participation, which will enable him to pass the necessary resolution in the members meeting (general meeting). After the voting, the “seller” is entitled to buy back his participation at the same price.
If the members want to exclude acquiring participation by third persons in the company without their approval, there are adequate securities to be specified in the shareholders’ agreement (for example the right of first refusal, option right).
By the specific type of shareholders’ agreement the creditor makes investments in the company and becomes member in order to secure the transaction. If the company or the original owners of the company breach the contract, they will be held individually liable till the limit of the investmented amount.
The shareholders’ agreement is an efficient option to rule major transactions, and with the help of the securities described in this study, the investor could feel his money in safe. On the other hand, there are still a lot of questions to be answered. For example the compliance of these securities with the strict provisions of the law. It is the duty of the practice to reveal the answers.

A terrorizmus elleni védekezés
Megtekintések száma:100In the last decades of our globalized world terrorism has become a phenomenon that implies a worldwide challenge and can hardly be prevented, and that is difficult to combat against with means of national and international law. The international terrorism in the sense as we use it nowdays has a history of only one and a half centuries, but since the appearance of concrete terrorist attacks is always changing (and of course the ideology and supplier of the different groups) there has not been any consensus yet among states or within particular international organizations how to define it. But it should be taken into consideration that attacks not only affect the state where they are executed but also the whole society and even the international order. That is why it would be essential to define it in international terms, because without an exact definition the proper defence against it can not be determined either.
It has to be emphasized that it does not exist a common strategy that could be adapted any time in any case. It can not be forgotten that the terrorism itself is also an answer, so its political, economical and social roots should be taken into consideration whilst choosing the best way to prevent it. The different means (primarily legal and classical ones) should be combined and used by states in strict cooperation, because these don’t substitute but complete each other. It is also important to underline that it is not enough to react upon terrorist actions and restore its harmful effects, but it is also essential to prevent it by eliminating its causes. Unfortunately, proactive strategies are not common enough - mainly because of its costs - in spite of the fact that in the long run it would be worth using them.
It is important to act in conformity with international law, because this can legitimate the reaction after an attack. The main task for states is to elaborate an exact legal framework for it, because without global accords and without the acceptance of this policy within the nation an effective policy against terrorism cannot be realized. National criminal law should be aggravated, flow of information among intelligence services, cooperation among media and governments should be developed and it is also essential to inform the society properly and make it obvious that assistance at a terrorist attack is also to be punished. International measures should be taken in order to avoid financing of terrorist actions by preventing money-laundering. These means can be used even with certain restrictions on criminal law, but always respecting human rights either that of the victims or that of the delinquents.
To institutionalize international actions under the aegis of the United Nations numerous agreements were accepted, eg. Convention on the Prevention and Punishment of Crimes against Internationally Protected Persons (1973), Convention against Taking of Hostages (1979), Convention for the Suppression of the Financing of Terrorism (1999) and some conventions were signed on the Prevention Crimes committed in aircrafts, etc. The main problem is that these accords are not signed by all member states and hence their efficiency can be questioned. Of course not only the UN try to solve this problem with international conventions, so does the EU. Its activity has considerably increased since the attacks of Madrid, because this case made two things clear: even Europe is vulnerable and well-timed attacks can even lead to political changes.
To be able to meet the challenges that terrorism mean nowdays there are two things to emphasize: first of all a worldwide cooperation would be essential and secondly the provision of financial sources for each state so that it were able to ensure national and promote global security.

1-9Megtekintések száma:127Regulation (EC) No 261/2004 depending on the circumstances of the travel disruption, requires air carriers to: provide passengers with assistance, such as meals, refreshments, telephone calls and hotel accommodation; offer re-routing and refunds; pay a flat-rate compensation of up to €600 per passenger, depending on the flight distance; and proactively inform passengers about their rights.
Under the Montreal Convention (as translated by Regulation (EC) No 2027/97 into EU law), a passenger may be entitled to compensation in case of mishandled baggage (but with a limit of about €1200), except if the airline can demonstrate it has taken all reasonable measures to avoid the damages or it was impossible to take such measures. Airlines often fail to offer passengers the rights to which they are entitled in instances of denied boarding, long delays, cancellations or mishandled baggage, in particular under Regulation (EC) No 261/2004 ("the Regulation") and Regulation (EC) No 2027/97. Case law has had a decisive impact on the interpretation of the Regulation. The Commission Communication of 11 April 2011 reported on the varying interpretation being taken on the provisions of Regulation (EC) No 261/2004, due to grey zones and gaps in the current text, and the non-uniform enforcement across Member States. Furthermore, it is difficult for passengers to enforce their individual rights. With regard to Regulation (EC) No 261/2004, the European Parliament asks the Commission to propose a clarification of the passengers' rights, in particular the notion of ‘extraordinary circumstances’. On 13 March 2013, the European Commission made a proposal for a regulation of the European Parliament and of the Council amending Regulation (EC) No 261/2004 establishing

common rules on compensation and assistance to passengers in the event of denied boarding and of cancellation or long delay of flights and Regulation (EC) No 2027/97 on air carrier liability in respect of the carriage of passengers and their baggage by air. This paper takes a closer look at this proposal. The proposal aims to improve enforcement by clarifying key principles and implicit passenger rights that have given rise to many disputes between airlines and passengers in the past; and by enhancing and better coordinating the enforcement policies carried out on a national level. A kényszermunka tilalma és a hátrányos megkülönböztetés tilalma összefüggései az Emberi Jogok Európai Bírósága esetjogában
Megtekintések száma:75The European Convention on Human Rights sets forth a number of fundamental rights and freedoms, including prohibition of slavery and forced labour (Article 4.) and the prohibition of discrimination (Article 14.). However, the European Convention on Human Rights prohibits discrimination only in relation to the enjoyment rights protected in the text of the Convention and did not originally include a provision proclaiming the equality of all before the law. As the European Court of Human Rights stated in Abdulaziz case: „Article 14 ... has no independent existence since it has effect solely in relation to „the enjoyment of the rights and freedoms” safeguarded by those provisions. Although the application of Article 14 does not necessarily presuppose a breach of those provisions - and to this extent it is autonomous -, there can be no room for its application unless the facts at issue fall within the ambit of one or more of the latter.”
In this study we examine only the relationship between Article 4. and Article 14 of the Convention. There is only one case, in which the applicant could call upon Article 4 and Article 14 together with success before the European Court of Human Rights: the case of Van der Mussele versus Belgium. For this reason we introduce not only this basic case, but lots of other cases, in which there were no discrimination in connection with Article 4. The applicants should find another group of persons are in analogous situations, which worsens the position of applicants seriously because of the difficulty of this condition.
In the above mentioned Van der Mussele case the applicant Belgian lawyer stated that Belgian lawyers are subject to less favourable treatment than that of members of a whole series of other professions, because in legal aid cases lawyers have to work without any remuneration, but the State accords remuneration to judges, registrars and interpreters in these cases. The Court emphasized that everybody could know the conditions of a profession in advance, and in the light of these conditions could choose it or not, and nobody compelled the applicant to be a lawyer. For this reason legal aid cases cannot be considered as forced labour, independently the remuneration of these cases.

A CISG és a UPICC gyakorlati jelentőségének megítélése
21-40Megtekintések száma:259Jelen tanulmány elsődleges célja a jogirodalom által kifejezetten jelentősnek titulált, a nemzetközi kereskedelmi jog területén megalkotott jogi szabályozók közül a Bécsi Vételi Egyezmény (CISG) és a Nemzetközi Kereskedelmi Szerződések Alapelvei (UPICC) értékelésének útján annak megállapítása, hogy a vizsgálat tárgyává tett jogi instrumentumoknak mekkora a tényleges gyakorlati relevanciája, alkalmazási volumene. A kitűzött célok megvalósítása érdekében a tanulmány a CISG tekintetében a rendelkezésre álló empirikus kutatások eredményeire, míg a UPICC vonatkozásában az elérhető esetjogi kivonatokra támaszkodik. A Bécsi Vételi Egyezmény esetében megállapítható, hogy az Egyezmény gyakorlati alkalmazásának volumene mérsékelt, elmarad attól a sikerességtől, amit a jogirodalom tulajdonít a számára, míg a UPICC közzétett joggyakorlatának a revíziója eredményeként egyértelműen rögzíthető, hogy az UNIDROIT Alapelvek elsődlegesen a nemzeti jog, valamint a nemzetközi egyezmények értelmezését, kiegészítését hivatott elősegíteni, a felek hajlandósága a UPICC elsődleges alkalmazása iránt rendkívül csekély mértékű.A tanulmány továbbá foglalkozik a jogi szabályozók nemzeti jogalkotásra gyakorolt hatásaival is, mely körben mindkét instrumentum vonatkozásában megfigyelhető a jelentős mértékű befolyás az egyes országok polgári anyagi jogi kodifikációja tekintetében.

Az Endorois ügy, egy hosszú út eredménye – avagy az afrikai emberi jogvédelmi mechanizmus joggyakorlata és az őslakos népek jogainak védelme
Megtekintések száma:149The aim of the current article is to analyse the protection of indigenous peoples’ rights offered by the African human rights mechanism by introducing the Endorois Welfare Council vs. Kenya case[1] (hereafter: Endorois case). The author briefly introduces the preliminaries of the Endorois case, namely how the African mechanism was established and in doing so, he refers to the achievements of the African Commission on Human and Peoples’ Rights (hereafter: Commission) in the field of protecting the rights of the African indigenous peoples, also touching upon the critiques regarding its functioning. Then he briefly introduces why the Ogoni case[2]can be regarded as a milestone concerning the rights of indigenous peoples on the African Continent. In the second part, the author focuses on the Endorois case and analyses it in detail: he introduces both the matters of fact and the legal issues; furthermore he pays attention to the implementation of the decision. Finally, in the third part of the article, the author draws his conclusions based on the above mentioned and makes his recommendations.
The author has the opinion that the African mechanism has followed in the footsteps of the Inter-American System and has interpreted the already existing substantial norms in an evolutiv manner, thus achieving tremendous results in the acknowledgement and protection of indigenous rights. They did so with such success that now the “master” – namely the Inter-American Commission on Human Rights – is quoting the student. It follows from the above mentioned that – according to the firm opinion of the author – the African mechanism worth the attention both present time, both in the future, because new trends regarding indigenous rights could arise from the practice of the African Commission.

Kétoldalú nemzetközi szerződés alkalmazásának felfüggesztése fegyveres konfliktus miatt
28-32Megtekintések száma:75The effect of armed conflict on bilateral international treaties of the belligerent parties has undergone a considerable change in the past century. From the concept of termination as the effect of armed conflict by the time of World War II practice of the States had reached the position of suspension of application or no effect at all. This question is regulated solely under customary international law, but the practice of states and doctrine is not readily available and sometimes may be contradictory.
Suspension in the case of armed conflict considerably differs from the rules set out in the 1969 Vienna Convention on the Law of Treaties. The lengthy procedure which is based on the negotiation of the parties of the relevant bilateral treaty is almost impossible in the circumstances of an armed conflict, especially with respect to the hostile relationship between the parties.
When dealing with this issue one finds that in the practice of States non-application of treaties during an armed conflict exists, however from the viewpoint of principles of international law, namely the principles of pacta sunt servanda, good faith, ex injuria jus non oritur and rule of law this practice - to say the least - is questionable. -
Skócia és Anglia – reform a tisztességtelen kereskedelmi gyakorlatok terén
35-42Megtekintések száma:92After the implementation of the 2005/29/EC Directive on unfair commercial practices (hereafter: UCPD) in the United Kingdom is has been discovered that the misleading and the aggressive practices are targeting many people. Some of them moreover damage the reputation of the traders who act legally, and the reputation of the market.
So, the Scottish Law Commission and the Law Commission for England and Wales want to create a new system on remedies. Because of this aim the two commission started a consultation in April, it ended in July.
Presently, The Consumer Protection from Unfair Trading Regulations 2008 (hereafter: CPRs) – which was one of the regulations which have implemented the rules of the UCPD – contains rules on the liability for unfair commercial practices, and - according to the rules – the realization of the practices is an offence.
But in respect of civil law the rules don’t have unity: the rules of misrepresentation are applied in the case of misleading practices, but in the case of aggressive practices there aren’t rules.
The two commissions want to create a new consumer protection act, which will complete the rules of the CPRs. In this act there will be two levels of remedies:
- on the first level the main aim will be the restoration of original condition (before the contract)
- on the second level the main aim will be the compensation.
The commissions hope that after the reform the following will be:

Megtekintések száma:71In Hungary the new code of criminal procedure established a new legal institution to the Hungarian legal system: accessory private prosecution. This kind of private prosecution gives opportunity to the afflicted person to continue penal procedure in case of negative sentences from investigation authorities. If the prosecutor or the investigation authority stops proceeding or the prosecutor sets aside, withdraws formal accusation, afflicted person can substitute them during a penal procedure and has a right to claim the continuation of it. Our valid code does not limit the field of crimes this legal institution of accessory private prosecution can be applied. But there are some strict reasons, which limit this right of the afflicted person. If the investigation authorities neglected formal accusation because of childhood, death, prescription, clemency, prohibition of ne bis in idem, accessory private prosecution cannot be applied.
Pros of accessory private prosecution can be found in the rights of afflicted persons. Criminal power of the state cannot be absolute, so we have to give the right for the injured to judge whether he insists on taking the responsibility of the perpetrator despite the opposite opinion of public bodies. This legal institution can help omissions of prosecutors to be remedied. Practicing this right depends on the stadium of the procedure. During the investigation period or the period of formal accusation reasons for accessory private prosecution are different.
According to the new rules of the code, applying an advocate in the procedure is an obligation for the afflicted person. This regulation ensures that the structure of penal proceedings cannot be changed basically. In a normal procedure there is always a professional expert, the prosecutor on the side of accusation. That is why the code does not permit accusation without applying an advocate.
Costs are interesting question in case of accessory private prosecution. In popular action procedures costs are paid by the state. When the afflicted person practices the right of accessory private prosecution, state pays in advance, but if perpetrator is acquitted or the court stops proceeding, costs should be paid by the private prosecutor himself. There are some rules to ease this burden for the afflicted person: if he has bad financial capacity and he can certify this circumstance, court can authorize him not to pay for the fee of the advocate.
There is a special question in connection with accessory private prosecution: representation of the state. In these procedures the afflicted person is the state or one of the state bodies itself. There are two points of view to answer the question: who is authorized to represent the state as an accessory private prosecutor during a penal procedure. First we have to make difference between the injuries: if the injury is against the state while practising public authority, the injured party is the state itself. But if the injury hit the state as a civil legal entity, a possessor, the right to claim is in the hand of that public body, which was entrusted to handle the injured property. This theory means that in case of injuries against the public author state, only the prosecutor can represent it, so there is no chance for accessory private prosecution.
The other solution for this problem has its starting point that in every crime against public property, accessory private prosecution can be applied. In this case the state can be represented by that part of it, which has interest. Although there are no jurisdiction in this question, because accessory private prosecution was established by the new code from 1st July 2003 after fifty years into the Hungarian legal practice. According to the regulations of the code, we can find the following sentence: afflicted person is whose right or legal interest was hurt or endangered by the crime. Analyzing this definition the argument can be read previously is decent for those situations, when we would like to find the legal representative of the state as an accessory private prosecutor.
Accessory private prosecution is a good solution that fits to the new directions of law development, to increase rights of the afflicted person. Naturally, time needs to become a well-adopted legal institution in Hungarian legal system after half a century silence.
