    Man is a social animal, it is important for colleagues to meet, create a relationship with them, to communicate, ideas, exchanging information. Human relationships are determined by the identity of a specific person, place in society, so it should be a fundamental right for all people in contact with the law. However, in certain life situations exercising these rights is necessarily limited, undermined, need frameworks. One of those situations in life with participation in health care in which the patient has to adapt in health care provider operating schedule, however, the Trustee is required to ensure the exercise of the right contacts.

    The most prominent of patients' rights to human dignity, which is inferred from a mother right, from which a number of other important rights. One of these is the right to self-determination, which guarantees freedom of action of the human as an individual incapacity depending autonomous. For patient care recipients should be subject to the fundamental distinction that whether it is inpatient or outpatient care. In the latter case, it also suffers from significant limitations on the patient's right to self-determination , including personal freedom, opportunities for contact with other people. The right to self-determination in a specific part of the realization of rights is thus involved in the regulation of the contact, as during inpatient care plays an important role.

    In today's modern society, the means of communication, networks of past explosive development, get more involved in the exercise of the right to life, human relations than before, with the elimination of the technical obstacles the spatial and temporal obstacles easily can be prevented. Life situation of the theme chosen exercise of the right of communication is of particular importance, because the patient's recovery depends not only on only physical but also mental condition, recovery can define what social relations, quality, intensity. The correspondence law of the health care law more the privileges include such other persons entitled to take the patient's inpatient sanitation place either in writing or orally to maintain contact, to receive visitors, the people he set out to exclude the visit , prohibit the fact of his treatment or the other information related to medical treatment reveals other.

    The context of the law of correspondence can be said that relatively little addressed by legislators and by expanding the scope of the practice of law in the content, but would consider appropriate where more attention is added. It would be good detailed arrangements for the exercise of creating the right framework for the so - to clarify the scope of everyday objects, to establish rules for their use of health services that are appropriate for the task to allow the exercise of these rights - the first line telecommunications.

    Mediation or agreement between perpetrator and victim in criminal law is a special form of damage reparation. Contrary to the simple reparation – where is no need to have a formal contract between the parties – mediation means a meeting between the parties to make an agreement that suits to both of them.

    Development of mediation in criminal law has its roots in the birth of diversion. It was a formal legal procedure to rebuild the injured legal system and repair damages. The first programs of mediation have appeared in Canada and the United States.

    Differently from the conciliation in labour law authorities have to define guidelines about forms of procedures outside the trial, about the process and modes of harmonization to preserve the prestige of state’s power of punish.

    In the mediation process competence of making decisions are in the hand of the parties too. Parties have to order upon the agreement. This extra-jurisdictional form of agreement means that the potential victim gives up his right to accusation. This agreement frees the perpetrator from the criminal liability.

    We can say that fundamental principles of mediation are the same in any fields of law, but mediation in criminal law has the most interesting and numerable specification because of the state power.

  • Az MH-17 légi járat lelövésének nemzetközi jogi megítélése a nemzetközi polgári repülésről szóló Chicagói Egyezmény tükrében

    This paper addresses the downing of Malaysian Airlines flight MH-17 in 2014 from the perspective of the Chicago Convention on international civil aviation. Two issues are closely examined namely the applicability of Article 3bis on prohibiting the use of force by states against civil aircraft to the specific case and States’ obligation to close the airspace to civil aviation over conflict zones.

    If the assumption of the Joint Investigation Team is correct in that flight MH-17 was shot down from a territory held by separatist groups it will be a legally challenging task to prove the necessary link to Russia requried by international law to determine state responsability for the breach of Article 3bis. The fact that the International Court of Justice has never delivered a judgement on merits concerning aerial incident cases due to the lack of jurisdiction does not advance the prospect for a reassuring conclusion of the case concerning flight MH-17 from the perspective of international aviation law.

    The obligation to close the airspace by the state exercising sovereignty over the airspace over conflict zones is not spellt out explicitly in the Chicago Convention. States responsible for the airspace should however close their airspace if the airspace in question is not safe for civil aviation. The critical question remains whether the state responsible for the airspace has all the relevant information at its disposal when making the complex decision about closing the airspace. In case of a non-international armed conflict non-state actors are not obliged under the Chicago Convention to share aviation safety related information with the enemy state responsible for the airspace under international law over the conflict zone.

    It is hereby proposed that binding regulations should be adopted either in the field of international air law or humanitarian law to the effect that during an armed conflict non-state actors co-operate in information sharing for the sake of guaranteeing the safety of (international) air traffic.

    The idea of simplification of the law of criminal procedure has been an interesting topic in the science of law for a long time. Practical necessities, namely the overburdening of the criminal courts and the new challenges of the criminal law called this concept into life. Finishing up a procedure in a reasonable time limit is a very crucial interest – as it was pointed out several times by the Council of Europe, Committee of Ministers and also the Hungarian Constitutional Court. As the international principle declared in the Human Rights says everyone has the right to plead its case within a reasonable period and it can only be achieved that way.

    Because of the reasonable time limit required for a procedure, various simplifications of methods have been introduced into the national systems of criminal procedure. As a part of this process several legal institutions were introduced in the Hungarian law system aiming to accelerate the legal procedure. One of them, which is called special procedure against absent accused, is regulated by Chapter XXIV. of the Law of Criminal Procedure.

    This essay deals with this special procedure in details. Firstly I show through a short international outlook how the procedure against absent accused appears in the practice of the European Council and the European Union. Hereafter a certain case is examined in details where the European Court for Human Rights considered the necessity of the accused person’s appearance. The Court established a principle if the absence of the accused had hurt the requirements of the fair trial. According to this the appearance of the accused person is necessary if it could play a role in the forming of the Court’s opinion.

    Next, I examine the problems connected to the Hungarian regulations because recently serious constitutional worries have appeared related to this legal institution. As a result of this the Constitutional Court made its decision (n. 14/2004) and found many paragraphs of the then existing legal institution unconstitutional. Based on this Decision I go through in details all the problems and requirements related to this procedure. In the light of this, the regulation effective from the 1st of January, 2005 is described, which – according to my opinion – meets the requirements made by the Constitutional Court, so it is exceptional and provisional.

    In the next chapter certain practical experiences of the procedure against absent accused are examined. Here it is stated that the application of this legal institution is the rarest among the legal institutions aiming the acceleration of legal procedures. I explain it by the fact that this is a relatively young legal institution and there was not enough time since it was introduced to give certain conclusions, moreover the application is limited concerning the range of individuals. As a conclusion it can be stated that the application is more common in those cases where the accused is abroad but does not stay in an unknown place. I call the attention to some problems emerged in the practice as the protection of the accused, or the delivery of the copy of indictment and summons, etc.

    As a final conclusion it can be stated that using this legal institution is not so common but the importance of this will increase in the future by joining to the EU because of the easier way of crossing the boards. Hopefully the regulation, which suits to the requirements of the Constitutional Court, will be proper to gain its original aim, namely to simplify and accelerate the legal procedure.

    The shareholders agreement is considered a typical contract. This agreement is concluded by and between the members of the company in order to establish the rules of the cooperation among them, their behaviour towards and expectations from each other in connection with the company.

    The agreement is often used in the practice, since its flexible construction enables to rule various types of transaction. For example, in Hungary there is a growing tendency i.e.the major investments and joint venture agreements are being established in the frame of a shareholders’ agreement.

    On the other hand, drafting such a contract is a complex procedure. This type of agreement is not governed by specific law, therefore the general rules of the contract law may be linefore. Furthermore the shareholders’ agreement is located at the borderline between the civil and company law, and in a given case it might be complicated to enforce the provisions of the agreement. For example, if the member breaches the voting provision outlined in the shareholders’ agreement, then the resolution passed upon the contract breach cannot be challenged.

    Due to lack of a specific law, the practice created the adequate legal securities to ensure the enforcement of the cooperation structure outlined in the shareholders’ agreement.

    As the first analysed security, the purpose of the buy-out clauses (Russian Roulette, Texas Shoot-out, Dutch Auction, Put-Option, Call-Option) is to ensure the company’s permanent operation, if there is an insoluble dispute among the members, which obstructs the decision making, and consequently the operation of the company, as well. The concept of the buy-out clause is to settle the dispute in the way of taking over the participation of the involved member by another member.

    The exit clauses (Drag Along, Carry Along) aimed to encumber or to unburden the step out from the company. The entitled person is able to sell the shares of the remaining members to the buyer, or to oblige the seller to sell his own and the entitled person’s participations jointly to the buyer.

    The takeover clauses’ (Control Flip Over, Swiss Clause) duty is to enable the enforcement of the corporate legal obligations outlined in the agreement. If a member fails to fulfil his obligations, the entitled person may acquire his participation, which will enable him to pass the necessary resolution in the members meeting (general meeting). After the voting, the “seller” is entitled to buy back his participation at the same price.

    If the members want to exclude acquiring participation by third persons in the company without their approval, there are adequate securities to be specified in the shareholders’ agreement (for example the right of first refusal, option right).

    By the specific type of shareholders’ agreement the creditor makes investments in the company and becomes member in order to secure the transaction. If the company or the original owners of the company breach the contract, they will be held individually liable till the limit of the investmented amount.

    The shareholders’ agreement is an efficient option to rule major transactions, and with the help of the securities described in this study, the investor could feel his money in safe. On the other hand, there are still a lot of questions to be answered. For example the compliance of these securities with the strict provisions of the law. It is the duty of the practice to reveal the answers.

    The primary and outstanding legal policy objective of Act I of 2012 on the Labour Code (hereinafter Mt. with its Hungarian abbreviation) is to extend the opportunities of collective autonomy and the regulatory role of agreements concluded between entities subject to collective labour law. With a view to this, the content of the legal institution has been significantly altered, establishing a „complex system” of specific rules that are instrumental in generating a system. The Labour Code is very often characterised as an especially complex piece of legislation, a „law intended for lawyers”, though it is one of the laws that are widely referred to and used, applied by people other than lawyers, including the classic actors (entities) of collective labour law. Below I will underline five regulatory „contradictions” in the area of collective labour law, which due to the lack of sufficient clarity and various ways of possible interpretation might become the source of legal disputes and conflicts of interest between the entities of collective labour law. These critical observations and proposals - which are far from being exhaustive - are related to the conclusion, amendment and termination of collective agreements, and the exercise of certain trade union rights.

    Thus, in the paper I will analyse the issues related to the conditions of collective agreements concluded by multiple employers from the perspective of workers (trade unions); the contradictions of the situation of the trade unions becoming entitled to conclude collective agreements subsequently; the possibilities for a trade union losing its capacity to conclude collective agreements and its consequences for the workers (the rate of unionisation dropping below 10% at the employer concerned); the problems related to the various levels of hierarchy in trade union structures; and finally, I will discuss issues of establishing and calculating the working time allowance, the grounds for and problems of its application.

    In many cases, owners have problems recovering their rented or arbitrarily occupied real estate. News often report difficult situations in connection with the evacuation of real estate. More instructive cases have also drawn attention to the severity of the problem. The study describes the rules for (litigation and non-litigation) court proceedings for the evacuation of real estate and does not deal with the enforcement procedures ordered by a notary.

    The possibility to initiate emptying real estate non-litigation procedure - according to Vht. 183rd-184th § - is not well known widely. According to most people, almost the only possible way to reclaim the real estate is to litigate, although the possibility of initiating the non-litigation procedure has been provided for years, provided the conditions of the law are met. Emptying of real estate in non-litigious procedure is possible in the case of real estates by arbitrarily occupied real estates, fixed-term tenancy agreemens of residential premises and other non-residential premises, as well as other types of properties specifically designated by law.

    The study presents the possible ways of carrying out the real estate evacuation, the enforcement procedure following the litigation procedure and the enforcement procedure initiated on the basis of a court non-litigation procedure, focusing primarily on proceedings commenced after 1. January 2018. The study deals with the legal background to the non-litigation and litigation procedure, the order for enforcement, the issuing, the service of an enforceable instrument, the possibilities provided by law in the event of non-execution, the short presentation of remedies. It also deals with some of the innovations introduced by law CXXX of 2016 on Civil Procedure Rules, suspension of enforcement, as well as the applicability of the eviction moratorium in each case. In the emptying of real estate, debtors often face criminal law. The most frequent criminal cases during the emptying of the real estate are presented in the study too (breach of seal, assault on a public official).

    Évtizedek óta nem láttunk olyan áremelkedést Magyarországon, illetve Európában és általában a világon, mint amivel 2022-ben voltak kénytelenek szembesülni a fejlett világ lakói. Az infláció 2022 decemberében Magyarországon 24,5 % volt, 2023 januárjában pedig a mutató 25,7 %-on állt. Az írás összefoglalja az inflációval kapcsolatos lényeges fogalmakat, kitérve az infláció definíciószerű megközelítésén túlmenően annak fajtáira, illetőleg annak mérésére vonatkozó legfontosabb elvekre, módszerekre. A gazdasági fundamentumok alapvetően meghatározzák a magánjogi jogviszonyokat, jogintézményeket is. Ilyen esetben beindul a válságjogi jogalkotás, ami elsődlegesen azokat a területeket érinti, amelyek a gazdaság működésére, a fogyasztók mindennapjaira a leginkább kihatással vannak. A jelen írás áttekinti azokat a fontosabb civiljogi struktúrákat, és az azokat szabályozó Polgári Törvénykönyvbeli, illetőleg egyéb törvényi és kormányrendeleti szintű szabályokat, amelyek tartalmát egy tartós inflációs környezetben indokolt módosítani, de amelyek ezidáig nem kerültek a jogalkotó fókuszába, hangsúlyozva a magánjogi normáknak a megváltozott gazdasági környezethez történő igazításának szükségességét. Azokat a jogszabályokat tekinti át az írás, amelyekben a jogalkotó a jogszabály szövegében rögzít értékre, árra utaló adatokat, nominálisan meghatározva, számszakilag konkrétan megjelölve azt az árat, értéket, amely jelentős szerephez jut egy adott magánjogi jogviszonyban. Ez a fajta jogalkotás azonban egyáltalán nincs tekintettel az értékviszonyok változására, így arra, hogy inflációs környezetben a magánjogi normában nominálisan rögzített ár- és értékadatok nem igazodnak a gazdasági folyamatokhoz, azaz nincsenek összhangban a mindenkori, gazdasági fundamentumok által determinált árszínvonallal. A szerző javaslatokat fogalmaz meg, szabályozási technikákat vázol fel ezen jogszabályi rendelkezéseknek a megváltozott ár- és értékvisszonyokhoz történő igazítására irányuló jogszabálymódosításra.

  • A személyes szabadsághoz való jog érvényesülése a Bűnvádi Perrendtartásban

    In this study, first of all I am dealing with the question, how the right to personal liberty prevails in the Bűnvádi Perrendtartás, however at the beginning I would like to introduce how the law for the personal liberty formed and how it appeared in Hungary and in the international documents, so in the British, American and French law as well.

    The most serious barrier of the personal liberty is the criminal law, so i find it especially important to examine that for this reason what kind of safeguards were placed into the Bűnvádi Perrendtartás.

    In general it can be said that the most important guarantees of the personal liberty are found in the principles of the criminal law, for example presumption of innocence, and through this it prevails in the Bűnvádi Perrendtartás' system.

    Firstable the limitation of the personal liberty has to be looked in the coercive measures, so I studied the pre-trial detention institution, that besides the basic principle what kind of safeguards were brought in by the legislature.

    In the end, it can be said that the right to personal liberty influences the whole Bűnvádi Perrendtartás, and in the cases where there were limitations, they always solved it with a safeguard.

    The effect of armed conflict on bilateral international treaties of the belligerent parties has undergone a considerable change in the past century. From the concept of termination as the effect of armed conflict by the time of World War II practice of the States had reached the position of suspension of application or no effect at all. This question is regulated solely under customary international law, but the practice of states and doctrine is not readily available and sometimes may be contradictory.
    Suspension in the case of armed conflict considerably differs from the rules set out in the 1969 Vienna Convention on the Law of Treaties. The lengthy procedure which is based on the negotiation of the parties of the relevant bilateral treaty is almost impossible in the circumstances of an armed conflict, especially with respect to the hostile relationship between the parties.
    When dealing with this issue one finds that in the practice of States non-application of treaties during an armed conflict exists, however from the viewpoint of principles of international law, namely the principles of pacta sunt servanda, good faith, ex injuria jus non oritur and rule of law this practice - to say the least - is questionable.

    I examine one of the grounds for the preclusion of culpability and grounds for the termination of culpability: error. Grounds for the preclusion of culpability are the followings: infancy, abnormal mental condition, constraint and menace, error, negligible degree of danger to society of an act, self-defence, extreme necessity (emergency), absence of private motion, other grounds defined in the Act. Grounds for the termination of culpability are: the death of the perpetrator, prescription, remission, cessation or becoming negligible of the dangerousness for society of the act, other grounds defined in the Act.

    Grounds for the preclusion of culpability and grounds for the termination of culpability mean that culpability shall be precluded.

    Error - as an obstacle of the preclusion of culpability – is not as usual as other grounds for the preclusion of culpability, for example: insane mental state, constraint or menace. Error means - 27. § of the Hungarian Criminal Code – that the perpetrator shall not be punishable for a fact of which he was not aware on perpetration. The person, who commits an act in the erroneous hypothesis that it is not dangerous for society and who has reasonable ground for this hypothesis, shall not be punishable. Error shall not exclude culpability, if it is caused by negligence and the law also punishes perpetration deriving from negligence.

    I examine error’s ruling from Roman law to now days. One of the most important books was written by Nandor Bernolak: The Error doctrine. I succeeded Bernolak’s method to search how error was regulated in different ages. Bernolak wrote his essay in 1910, so he described the rules of error as it appeared in Code Csemegi. I follow his method during the examination of 1950.:II. Criminal Code of General Part, 1961. IV. Criminal Code and finally 1978. IV. Criminal Code.

    I found many differences and similarities between Criminal Codes, Propositions, and finally I compiled a table about the changes of the development in error’s legal history.

    There is a rule that is known generally from Roman law: „ignorantia facti, non iuris excusat”, which means: ignorance of the law means no excuse.

    In Denmark until around 1850-1870 most ordinary people used patronymics instead of surnames, however, in 1812 the Danish government passed a law requiring families to choose a fixed surname that future generations should continue to use. In 1826 patronymics were abolished by law. It took several decades for patronymics to disappear.

    Constantly changing names had given reasons for this regulation. The patronymics (as family names) were not favourable for property circumstances and registration.

    Today the Danish name system bases on the Danish Act on Names. This act contains regulation of last names, middle names, first names, procedure of giving names and the changing of names, private international law relations and penal provisions.

    This Danish act is very permissive, because it allows using traditional patronymics and in the same time encourages individuals to choose a new surname. So a name which is not used as a last name in Denmark can be adopted as a last name but some conditions must be effective.

    In Denmark last names borne by 2,000 individuals or less are protected and cannot be adopted by other individuals. This is an unusual form in protection of names.

    There is a lot of similarity between Hungarian and Danish right of name, enough to think about the first names. Either in Denmark and in Hungary a first name cannot denote the opposite gender in relation to the individual who will bear the name. There is a list of names for boys and girls, which is identical with the Hungarian list of first names compiled by Hungarian Academy of Sciences.

    Why can this Danish act be interesting for a Hungarian lawyer?

    In Hungary the regulations of names were very scattered, so the rules were on every level of the sources of law. Since 2004 this situation is not so unfavourable, but we still do not have one unified act on names as it is in Denmark. So the Danish act can be a good example to examine how we can establish a similar unified regulation in Hungary.

  • A terrorizmus elleni védekezés

    In the last decades of our globalized world terrorism has become a phenomenon that implies a worldwide challenge and can hardly be prevented, and that is difficult to combat against with means of national and international law. The international terrorism in the sense as we use it nowdays has a history of only one and a half centuries, but since the appearance of concrete terrorist attacks is always changing (and of course the ideology and supplier of the different groups) there has not been any consensus yet among states or within particular international organizations how to define it. But it should be taken into consideration that attacks not only affect the state where they are executed but also the whole society and even the international order. That is why it would be essential to define it in international terms, because without an exact definition the proper defence against it can not be determined either.  

    It has to be emphasized that it does not exist a common strategy that could be adapted any time in any case. It can not be forgotten that the terrorism itself is also an answer, so its political, economical and social roots should be taken into consideration whilst choosing the best way to prevent it. The different means (primarily legal and classical ones) should be combined and used by states in strict cooperation, because these don’t substitute but complete each other. It is also important to underline that it is not enough to react upon terrorist actions and restore its harmful effects, but it is also essential to prevent it by eliminating its causes. Unfortunately, proactive strategies are not common enough - mainly because of its costs - in spite of the fact that in the long run it would be worth using them.

    It is important to act in conformity with international law, because this can legitimate the reaction after an attack. The main task for states is to elaborate an exact legal framework for it, because without global accords and without the acceptance of this policy within the nation an effective policy against terrorism cannot be realized. National criminal law should be aggravated, flow of information among intelligence services, cooperation among media and governments should be developed and it is also essential to inform the society properly and make it obvious that assistance at a terrorist attack is also to be punished. International measures should be taken in order to avoid financing of terrorist actions by preventing money-laundering. These means can be used even with certain restrictions on criminal law, but always respecting human rights either that of the victims or that of the delinquents. 

    To institutionalize international actions under the aegis of the United Nations numerous agreements were accepted, eg. Convention on the Prevention and Punishment of Crimes against Internationally Protected Persons (1973), Convention against Taking of Hostages (1979), Convention for the Suppression of the Financing of Terrorism (1999) and  some conventions were signed on the Prevention Crimes committed in aircrafts, etc. The main problem is that these accords are not signed by all member states and hence their efficiency can be questioned. Of course not only the UN try to solve this problem with international conventions, so does the EU. Its activity has considerably increased since the attacks of Madrid, because this case made two things clear: even Europe is vulnerable and well-timed attacks can even lead to political changes.

    To be able to meet the challenges that terrorism mean nowdays there are two things to emphasize: first of all a worldwide cooperation would be essential and secondly the provision of financial sources for each state so that it were able to ensure national and promote global security.

    Az örökléshez való jogot az Alaptörvény elismeri, a részletes anyagi jogi szabályok a Polgári Törvénykönyv Hetedik Könyvében kerültek rögzítésre. Az utóbbi években a jogalkotó a magánjogi kódexünkön túlmenő egyéb jogszabályokban anyagi jogi öröklési szabályokat fogalmazott meg. A bejegyzett élettársi kapcsolatról szóló törvény szerint a házastársra vonatkozó szabályokat a bejegyzett élettársra is megfelelően alkalmazni kell, ami azt jelenti, hogy a bejegyzett élettárs is törvényes örökös. A mező- és erdőgazdasági földek tulajdonjogának végintézkedéssel történő megszerzésének speciális szabályait rögzíti a földforgalmi törvény (2013. évi CXXII. törvény). 2023. január 1-jén lép hatályba egy újabb törvény (2021. évi CXLIII. törvény), ami a Ptk-beli öröklési jogi rendelkezéseket egészíti ki, az osztatlan közös tulajdonban álló termőföldek több örököstárs általi közös törvényes öröklése esetére. Az államot az öröklési jogi jogviszonyokban képviselő állami szerv kijelöléséről egy külön miniszteri rendelet rendelkezik. A jelen írás azt elemzi, hogy mindezen összetett, szórt szabályozás hogyan nehezíti a jogalkalmazást, mennyiben akadályozza a hagyatéki eljárások gyors lefolytatását. A jelen írás kritikával illeti a fragmentált szabályozást és javaslatot tesz a külön törvények szabályainak a Ptk.-ba történő integrálására, ugyanis ez hozzájárulhat a hatékonyabb jogalkalmazáshoz.

    A tanulmány megállapítja, hogy a szellemi alkotásokra vonatkozó szabályozásban a polgári jogi szabályok dominanciája érvényesül. A régi Polgári Törvénykönyv kifejezte a kapcsolódást a szellemi alkotások jogával és szabályozta a know-how jogvédelmét, a joganyag ugyanakkor az ahhoz szervesen kapcsolódó külön jogszabályokban volt fellelhető. Az új Polgári Törvénykönyv, a 2013. évi. V. törvény már nem a szellemi alkotásokhoz fűződő jogok, hanem a „szerzői jog és iparjogvédelem” címet viseli, a know-how pedig az üzleti titok egyik fajtájaként részesült védelemben. A szerzői jog homogén jellegét megtöri a 2016. évi XCIII. törvény, amely a közös jogkezelésről rendelkezik. Az iparjogvédelem területén a legproblematikusabb jogintézmény a know-how volt. Az új Polgári Törvénykönyv szabályai után megszületett 2018. évi LIV. törvény új fejezetet nyit a know-how szabályozása terén. Ezzel kapcsolatban a törvény a 2016/943/EU Irányelvet ülteti át a magyar jogba. A jogalkotó tehát azt a megoldást választotta, hogy az üzleti titok védelmére vonatkozó új fogalmi megközelítést, jogintézményeket és eljárási szabályokat nem a Polgári Törvénykönyvben, hanem egy új jogszabály megalkotása útján tette azokat a nemzeti jog részévé. Ezzel a természetes és jogi személyek magántitkai változatlanul személyiségi jogi védelmet, míg az üzleti titok és a know-how a szellemi tulajdonjogi védelem logikájára és szankciórendszeré épülő védelmet élveznek majd.

  • A helyi önkormányzatok és az Alkotmány a pénzügyi jog aspektusából

    In my study I deal with the connection between the local governments and the Constitution in the aspect of Financial Law.

    The local governments’ essential rights have been laid down  in the Constitution in a separate (IX.) chapter. The defence of the local governments is different from the defence of fundamental human rights. The latter has the test of necessity and proportionality. The local governments’ constitutional rights can be restricted until the infringement of its fundamental contents.

    I examined the rights of the local governments connected with the Financial Law, so I was engaged mainly in the financial support of it and the right of property and tax assessment. The Constitutional regulation of the financial support is most unique. The difference is that this paragraph (44/A. § (1) c) is not a rule of competence and jurisdiction however an obligation for the state to guarantee the self income and the proper state support to the local governments. The most important own sources are the taxes, which are necessary to discharge the duties. The authority to issue taxes derives from the Constitution - 70/I. § and 44/A. § (1) d. These paragraphs  prescribes that every natural and legal person must contribute to rates and taxes depend on their income and estate.

    The local governments may issue taxes within the framework of law, but their legislation is wide-ranging within it, for this reason there are a lot of instructive judgements of the Constitutional Court.

  • Considerations on legal remedies in Romanian civil proceedings

    In the system of the Romanian Code of Civil Procedure the legal remedies that can be exercised against judgements are: the appeal, the second appeal, the appeal for legal contest in annulment and review. The appeal is the only ordinary remedy, while all the others are classified as extraordinary remedies.

    The reasons for which the legal remedies may be exercised vary depending on this qualification, which means that the appeal is applicable for any dissatisfaction of the parties, whereas the second appeal, the legal contest in annulment and the review may be exercised only for reasons explicitly defined by the law.

    The extraordinary legal remedies cannot be exercised as long as one may lodge an appeal.

    A legal remedy can be exercised against one judgement only once, if the law provides the same term of exercising the legal remedies for all existing grounds on the date of declaring that specific remedy.

    The judgement is subject only to the remedies provided by the law, under the respective terms and conditions, regardless of the particulars of its statement of reasons.

    Az „ideális bíró” nem ismeri az érzelmeket. A bírói székben ülve minden érzelmet kizárva objektíven és racionálisan hozza meg döntéseit. A jogelméleti gondolkodásban egészen az elmúlt pár évtizedig ez az egyelten lehetséges bírói ideál élt és tagadhatatlanul nagyon erősen van jelen mind a mai napig. Azonban az 1960-as évektől kezdődően az angolszász jogi kultúrában, elsősorban az Amerikai Egyesült Államokban, szemléletváltás indult el. Gyors fejlődésnek indultak a jogot interdiszciplináris igénnyel vizsgáló irányzatok. Önálló irányzattá vált a jogelméleti gondolkodáson belül a Critical Legal Studies mozgalom. Emellett óriási előrelépés történt az érzelmek tudományos vizsgálata terén is, ahol mind a pszichológia, mind az idegrendszert vizsgáló neurotudományok komoly eredményeket értek el. Mindezen tényezők együttesen alapozták meg a jog és érzelem mozgalom (Law and Emotion Scholarship) megjelenését. A mozgalom egy kialakulóban lévő interdiszciplináris terület, amely a jog, pszichológia, irodalom, közgazdaságtan és filozófia területéről egyesíti azokat a tudósokat, akik határozott érdeklődéssel fordulnak a jog jelenségei és az érzelmek kölcsönhatásának vizsgálata felé. Kutatásomban elsősorban a mozgalom bírói ítélkezéssel kapcsolatos megállapításaira koncentrálok, vizsgálva azt, hogy hogyan kaphatnak szerepet az érzelmek a bírói döntéshozatalban. Hiszen a jog és érzelem mozgalom képviselői – a hús-vér bírák valóságát figyelembe véve – megkérdőjelezik annak gondolatát, hogy létezhet érzelemmentes bíráskodás.

  • Az agrárgazdaságok átadásáról szóló törvény egyes magánjogi aspektusai

    A tanulmányban az agrárgazdaságok átadásáról szóló törvényt vizsgálom meg, alapvetően azon rendelkezésekre fogok kitérni, amelyek a magánjoggal összefüggésbe hozhatók. A törvény megalkotásának célja a generációváltás megkönnyítése volt az agrárium területén, véleményem szerint az agrárgazdaságok átadásának hatékony eszközei lehetnek a gazdaságátadási szerződések, azt jelenleg azonban még nem tudni, mennyiben lesznek valóban alkalmazott módszerek, és mennyiben tudják beváltani a hozzájuk fűzött reményeket.

    The paper introduces the most recent processes taking place within the Hungarian public administration from a special aspect and follows the system of the authorities of the misdemeanor law from the 19th century to nowadays. It presents the system of the monarchy, the councils and the period after the change of regime. The Constitutional Court with its Resolution no. 63/1997 (XII. 12.) declared the dual nature of offences – being against public administration and bagatelle cases pertaining to criminal law – and although with a different legal reasoning, it prescribed the right of access to court in both cases. The mentioned separation has resulted in conceptual problems exerting their influence to this day, at the same time the majority of authors dealing with this field instead of the majority opinion accepted the concurrent explanation of László Sólyom, to which Constitutional Court Judges János Németh and Tamás Lábady also joined. In 2012, however, several important changes took place simultaneously. The new Act on Offenses shifted towards criminal law while it terminated the right of local governments to regulate offenses. In parallel with this, the Act on Local Governments at the beginning provided an opportunity for the local governments to sanction anti-social behavior which was revoked by the Constitutional Court in the same year. The paper investigates the effect of the decisions of the Constitutional Court and analyzes the opportunities of public administration within the present legal framework to apply sanctions and defines those criteria on the basis of which the legislator could settle the current situation.

    Jelen tanulmány elsődleges célja a jogirodalom által kifejezetten jelentősnek titulált, a nemzetközi kereskedelmi jog területén megalkotott jogi szabályozók közül a Bécsi Vételi Egyezmény (CISG) és a Nemzetközi Kereskedelmi Szerződések Alapelvei (UPICC) értékelésének útján annak megállapítása, hogy a vizsgálat tárgyává tett jogi instrumentumoknak mekkora a tényleges gyakorlati relevanciája, alkalmazási volumene. A kitűzött célok megvalósítása érdekében a tanulmány a CISG tekintetében a rendelkezésre álló empirikus kutatások eredményeire, míg a UPICC vonatkozásában az elérhető esetjogi kivonatokra támaszkodik. A Bécsi Vételi Egyezmény esetében megállapítható, hogy az Egyezmény gyakorlati alkalmazásának volumene mérsékelt, elmarad attól a sikerességtől, amit a jogirodalom tulajdonít a számára, míg a UPICC közzétett joggyakorlatának a revíziója eredményeként egyértelműen rögzíthető, hogy az UNIDROIT Alapelvek elsődlegesen a nemzeti jog, valamint a nemzetközi egyezmények értelmezését, kiegészítését hivatott elősegíteni, a felek hajlandósága a UPICC elsődleges alkalmazása iránt rendkívül csekély mértékű.A tanulmány továbbá foglalkozik a jogi szabályozók nemzeti jogalkotásra gyakorolt hatásaival is, mely körben mindkét instrumentum vonatkozásában megfigyelhető a jelentős mértékű befolyás az egyes országok polgári anyagi jogi kodifikációja tekintetében.

    The regulation of expropriation law is indicative of the sound of rule of law. It shows how the state treats vulnerable groups, and people adversely affected by expropriation. In this paper I will give a short overview of the rules concerning compensation for expropriation, from the inception of expropriation law, right up to 2014. I pay particular attention to the characteristics of the regulation in the socialist era between 1948, and the regime change in 1989/1990. I expand on how Hungary tried to free itself of the burdensome heritage of the socialist regulation of that law, after the regime change of 1989/1990. Then I review the current status of legal regulation concerning compensation for expropriation that gives me a great opportunity to and explain suggestions de lege ferenda.

    In the 19th Century the results of the natural sciences – physics, chemistry –, the technical
    achievements incorporated in the medical science, and made the medical science an intensive
    progress. This article presents the scientific results, which have the largest relevance regard
    the criminal law and which have a significant impact on the science of criminal law and its
    affiliates.
    The advance of medical science results the appearance on the one part the expansion of the
    medical knowledge and medical tasks, on the other hand new offenses and new types of
    evidence. The practical application of the results of medical research into the criminal
    procedure (blood tests, DNA test, etc.) allows primary the faster detection in the investigative
    stage of criminal proceedings, and the making of more reasonable judgments. On the territory
    of psychiatry are very important the results of research of the state of consciousness, that
    influence the offenders culpableness, because they give an answer to the question, in what
    consciousness was the offender at the time of the crime.
    This article submitted the most important correspondences of the medical science and
    criminal law, and it is established, that the results of the medical science support the further
    development of the criminal law and its affiliates.

    The current, traditional Latin-type civil law notaries do not exist within the organisation of the Roman Catholic Church. However, the ecclesiastical “notary” and the concept, function and activities of the civil law notary may be related, and even made parallel, which may support the idea of some common origin or development. My article discusses the reason why we may still speak of persons having quasi notarial competence within the church. Also, it purportsto describe the diplomatic mission of the Vatican, the tasks of the embassy, touching on the issue of legalization as well; moreover, it draws a parallel between the ecclesiastical clerk and the civil law notary from the aspect of civil legal principles, such as impartiality and independence, comparing them also in terms of appointment and similar elements concerning attestations. It covers the rules governing the preparation of instruments and the certification of copies in more detail, as well as the procedural function of the ecclesiastical clerk, the similarities concerning archives and the custody of documents, and finally presents the issue of removability and termination of office.

    A csíravonalas génszerkesztés az utóbbi évtizedekben robbanásszerű fejlődésen ment át: a genetikai beavatkozás képes lehet arra, hogy emberi életeket, sőt, az egész emberiséget drasztikusan érintő változásokat idézzen elő. E fejlődést azonban a jogi, és különösen a büntetőjogi szabályozás nem követte, a génszerkesztés fejlődésére adott büntetőjogi válasz idejétmúlt, nem eléggé kifinomult és a büntetési tétel elrettentő ereje sincsen arányban a cselekmény tárgyi súlyával. Dolgozatomban nagy vonalakban bemutatom a géntechnológia fejlődését, annak etikai-társadalmi kockázatait, az ezekre reflektáló nemzetközi, illetve egyes államok belső regulációját, a hazai szabályozást és hiányosságait, valamint utóbbiak orvoslására – mintegy tapasztalataim szintéziseként – de lege ferenda javaslatot fogalmazok meg, törekedve a lehető legmegfelelőbb büntetőjogi szabályozás megalkotására. Javaslatom célja elsősorban a csíravonalas génszerkesztés specifikusabb, korszerűbb és bizonyos szempontból szigorúbb büntetőjogi tényállások révén történő regulációja, mely egyszerre óvja az egyént, a társadalmat, az emberiséget és a veszélyeztetett társadalmi érdekeket a humán csíravonalas génszerkesztés küszöbön álló elterjedése miatt várható veszélyektől.
