    The Committee of the European Union after the issue of the Directive 98/71/EC found that the integrity of the internal market needs an easily accessible uniform protection of designs that covers the whole territory of the Community. For this reason was issued the 6/2002 EC regulation on Community Designs. The most important definitions and the grounds for invalidity are absolutely identical in the directive and the regulation. May aim by this short essay is to interpret the main definitions of design law by analysing some published cases of the Office for Harmonisation in the Internal Market (OHIM). The case law has important role in the field of design law since the requirements of protection and the grounds of invalidity contain a number of unique terms can be construed only by practice. As a consequence of the harmonised design law the practice of the Office can exercise a strong guiding effect not only on the application of community design law but national level design laws in the procedure of the national offices and courts. . 25 (1) point b) is the most used ground for invalidity in practice when a conflict with Art. 4-9. occurs. Within this point lack of novelty, individual character and prior disclosure shall be mentioned first of all. In the relation of novelty and individual character it seems of the cases that lack of novelty always excludes any further examination of individual character since individuality can be considered a narrower definition of novelty. By analyzing the overall impression produced by a design to an informed user the Office always underline that the difference must be instantly and obviously recognizable. The impression shouldn’t be based on through examination of the informed user. The invalidity division stated that any prior design in important databases on internet shall be deemed to be known by the specialised circles and can result the disclosure according to the regulation. In connection with features dictated solely by its technical function the Office stated that designs contain only elements of merely technical purpose (in this case an engine block and engine parts) specific position of such elements and the general impression of the whole enough to provide legal protection for such features. There is no ground for invalidity pursuant to this reason if the same technical function can be achieved by different design.

             In my essay I focused on the most the above mentioned most relevant parts of some definitions. My future plan is to analyse the differences between the legal practice of different European countries concerning this issue.

    The current, traditional Latin-type civil law notaries do not exist within the organisation of the Roman Catholic Church. However, the ecclesiastical “notary” and the concept, function and activities of the civil law notary may be related, and even made parallel, which may support the idea of some common origin or development. My article discusses the reason why we may still speak of persons having quasi notarial competence within the church. Also, it purportsto describe the diplomatic mission of the Vatican, the tasks of the embassy, touching on the issue of legalization as well; moreover, it draws a parallel between the ecclesiastical clerk and the civil law notary from the aspect of civil legal principles, such as impartiality and independence, comparing them also in terms of appointment and similar elements concerning attestations. It covers the rules governing the preparation of instruments and the certification of copies in more detail, as well as the procedural function of the ecclesiastical clerk, the similarities concerning archives and the custody of documents, and finally presents the issue of removability and termination of office.

    Act no XLII of 1870 reflected the constitutional arrangements of the Compromise of 1867. This was the first law providing a comprehensive regulation of the system of public administration, which remained, with minor amendments, determining in the entire dualistic era. The system of “virilims” was introduced, which restricted popular representation. The office of the Lord Lieutenant, as the representative of the centralistic endeavours of the government, was created, whereby central power could be enforced. The central government did all in its power to ensure that the self-government of municipalities was kept under control. The rights that local authorities had in the feudal period could no longer be granted, as this would have frustrated the operation of the central government. It was in accordance with the above that the provisions of the law had to be accepted, local policy influenced, and municipalities thereby reorganised.

    Significant changes have happened on the field of intellectual property law in the last few years. The emphasis placed on the material relations and economy became stronger. These changes caused that creations of the man came into the limelight. Of course the legal background became also very important.

    We can feel the re-regulation of this legal field. Legal institutions became regulated in new Acts to be adjusted modified circumstances. There were several causes of the necessity of these changes. First of all, the new economic and social environment after the change of the regime claimed to modify the legal materials. On the other hand the international environment changed rapidly and it is still in progress. So the Republic of Hungary had to face with the obligations that are stated in international treaties and we had to put a strong emphasis on our member status in the European Union: EU regulations and directives. By now we can tell that re-codifying this area is over, we can only expect to small modification in the near future.

    Modifications in most of the cases prepared for the future. But it does not mean that we can count on a very crystallized legal material. In the dynamically developing world of IP law it is not rare to use smaller modifications. We have to examine the legal practice too, that helps us finding the correct way in the fast changing economical and social relations. Performing the harmonization duty, legislator could not always take into consideration the national significances, legal practice. The lack of examining these circumstances can cause modifications in the legal material.

    The Patent Law Treaty adopted at Geneva on June 1st, 2000. The provisions of the Treaty and the Regulations shall apply to national and regional applications for patents for invention and for invention and for patents of addition, which are filed with or for the Office of a Contracting Party. The Patent Law Treaty became applicable on April 28th, 2005.

    Hungary joined the Treaty at the beginning, because of the need in 2008 to change the Hungarian patent law. The Treaty suggests the European Patent Convention, however in many ways it is the complementary. The Treaty gives types of applications permitted to be filed as international applications under the Patent Cooperation Treaty, divisional applications of the types of applications referred to in item.

    Earlier the rules of Hungarian patent law were complicated, the process of registry was less favorable for the patentee. The harmonization of process rules effects that the patentee cannot lose his patent rights. The new rules introduce an electronic process in patent law, which makes the process easier, cheaper, and faster. But not all the procedures became electronic: only the lodgment of petition. In the future that should be better to reach electronic procedure on every level.

    The harmonization of patent rules means liberalization, the notification will be easier and faster, which effected growth in the trust of business. Process rules need more harmonization in the future, and hopefully the final goal will be one global process at in all member states of the European Union.

    The rules of Hungarian Criminal Procedure Code related to summary proceedings aren’t newfangled. Probably, due to the criminal policy needs, arise from that, recent years these changed considerably and in a sense went through “volte-face”. To emphasise the strong connection between this special process and the investigation, I review the rules of some surrounding states that apply to this, in order to point out in a constructive way the problems of the operative Hungarian regulations. I’d like not only to line up these for the Reader but – in search of optimal key – also make de lege feranda proposals.

    The European Academies Science Advisory Council (hereafter: EASAC) and the Federation
    of European Academies of Medicine (hereafter: FEAM) published a study on „Direct-toconsumer
    genetic testing for health-related purposes in the European Union” in the summer of
    2012.
    This paper shows the results of the research of the working group of the two mentioned
    organizations. The main aim was to investigate the scientific, ethic questions and the
    questions in connection with the possible regulation. The second aim was to define principles
    and recommendations for the European Commission, the European Parliament, the Council of
    Ministers and the political decision-makers of the Member States.
    This paper also shows the results of the workshop – organized by the EASAC, the FEAM and
    the Science and Technology Options Assessment (hereafter: STOA) - in the end of 2012.
    Finally, there are some facts on the regulations on the genetic tests outside the EU.

    After demonstarting a short historical and national angle in my study, I would like to sketch a general survey about the rising and the operation of the capital local government between 1989 and 1994. This period was the beginning of establishing the system of local governments. This period resulted a remarkable turn to the direction of the capital level.

    Now this subject belongs to the history of public administration, but it is still a current question from many points of view. It is true that the relationship between the capital and the district local governments is rather contradictionary, as this is true for the relationship of the regime and the government.

    The development of the capital local government can be approached only if we examine the whole local government system. The governmental system and its contemporaries made influence to the operation of the capital local government too, especially in two fields, on the one hand the specific structure of the capital local governmental system, on the other hand the disintegrated structure of the capital agglomeration.

    The special structure of the capital local government influenced significantly the relationship of the local governments and the capital, and the relationship of the capital and the regime. The sharing of the tasks and the financial sources were a source of tensions between the capital and the districts. There was a great need to use long-term principles in sharing these sources. The conflicts became deeper and deeper, because the competencies were not clearly divided, and some investments failed because of the resistance of the district local governments.

    The relationship of the regime and the capital determines the special position of the capital, and the strong dependence on the state supports. This situation can be worse by the conflicts in the political principles of the capital local governments and the regime.

    The polluter pays principle is one of the basic principles of international environmental law
    mentioned directly firstly only in 1972, however the principle were declared in 1929 in the
    well-known Trail Smelter Case. The polluter pays is an economical principle, and in the
    meaning of this principle the costs of pollution shall be shared between industrial companies
    and consumers. Taking into consideration that after applying this principle price of products
    will be higher than before, industrial companies shall reduce their pollution in the interest of
    their (and their products’) competitiveness. Seeing the development of the principle in EU
    level, the polluter pays were mentioned first time in the first „programme of action of the
    European Communities on the environment” adopted in 1973. However it is questionable
    what polluter, pollution, obligation of polluter and costs of pollution mean exactly, and for
    this reason this principle cannot be applied automatically.
    In this study I try to examine how the polluter pays principle works in the Hungarian national
    law, especially in the Hungarian Civil Code. For this reason I examine the applicability of
    Article 345 of the Hungarian Civil Code („Damages Originating from Hazardous
    Operations”), with special regard to the case-law of the Hungarian civil courts. I also try to
    introduce the possibilities and obligations of the public prosecutor in environmental issues.

    A mesterséges intelligencia (MI) technológiája az elmúlt évtizedek, de leginkább évek során gyors ütemű fejlődésen ment keresztül, amelynek szabályozási kihívásaira az Európai Unió az MI Rendeleten, Magyarország pedig az ahhoz kapcsolódó jogszabályokon keresztül igyekszik választ adni. A tanulmány áttekinti az Unió, valamint Magyarország MI értelmezését, a kettő közötti értelmezési különbségeket és a definiálás körülményeit, különösen a generatív modellek, az általános célú, valamint az általános MI között. A cikk bemutatja az MI Rendelet cikk írásakor hatályba lépő legfontosabb rendelkezéseit, a fokozatos hatályba lépésből adódóan különös tekintettel a tiltott MI gyakorlatokra, valamint az általános célú MI modellekre vonatkozó előírásokra. Ezen kívül, ugyancsak annak időszerűsége miatt bemutatja és elemzi az MI Rendelet EU-szintű intézményrendszerét, valamint az ahhoz kapcsolódó, azt kiegészítő tervezett hazai szervezeteket, építve az új magyar MI Stratégia (MIS 2.0) elérhető dokumentumaira. A cikk célja, hogy betekintést nyújtson az olvasó számára az EU és Magyarország MI szabályozási törekvéseibe, különös tekintettel a jogalkotói válaszokra a technológia társadalmi és gazdasági kérdései kapcsán.

    Nowadays data has become one of the most important value which raises the question of protecting personal data. The European Union responds to the challenge by legal instruments: since 25 May 2018 it has been obligatory for the member states to apply GDPR. In the article, first I study the novelties of GDPR. Then I examine to what extent the provisions apply to libraries and archives.

    The novelties can be divided into several larger groups. Some of them belong to the data subjects (data portability, right to be forgotten, pseudonymisation), the other parts are principles like data protection by design and by default or the closely related accountability principle. The Regulation also introduces a new legal institution, the data-protection impact assessment and requires the notification of personal data breachConcerning the expected impacts, it is clear that the Regulation strengthens the rights of the data subjects but imposes new obligations on data controllers and strengthens the role of control. GDPR is a determinative law for the undertakings and business life, and it must also be applied by libraries and archives. For archiving purposes in the public interest, however, the Regulation allows for exemptions concerning libraries and archives. The provisions require libraries and archives to identify the risks that may occur while processing personal data as well as to examine their regulations.
