    The Constitution of the Republic of Hungary declares that under the right of association everyone has the right to found organisations – for purposes not prohibited by law – respectively join to them.

    More and more citizens and legal entities have utilized the possibilities guaranteed by the constitution since the regime change thus, the number of the associations and trusts has been increasing annually.

    The purpose of this essay is to present the past, the present and the possible future of trusts and non-govermental organizations with a special focusing on the condition of registration of the public benefit of organisations (PBO), and the rules of the management, operation, economic advantages and supervisions of these PBOs.

    As for the right to a fair trial sanctioned by the convention, our most determining deficiencies arise regarding the compliance with a reasonable period of time. Despite of the relatively small number of the Hungarian infringements of the European Convention on Human Rights, the expectation of sufficiently efficient dispositions eliminating the prolongation of the judicial procedures applies for Hungary as well.

    In general, it can be concluded that the Hungarian legal system provides the basic human right to fair trial. This claim is supported by the low number of infringements in Hungary. In this study I sought to present the data related to the Hungarian cases proceeding at the European Court of Human Rights, as well as elementswarranting the emergence of the right to a fair trial assured by Article 6, together with the aspects during the monitoring of the cases of the prolongation of the judicial procedures respected by the Court of Strasbourg. Finally I aimed to delineate the aforesaid apropos of a representative and an exceptional case in respect of the practice of the Court as well.

  • On Law as a Multidisciplinary Phenomenon

    The article introduces the limits of conceptual analysis of law, and the possibilities of functional and multidisciplinary approaches to law. It sketches some stations of the history of legal philosophy emphasizing spreading multidisciplinary tendencies of the philosophy of law. It illuminates some connection of various scientific approaches on the basis of a concrete research relating to the religious roots of Roman law. Finally it outlines vertical and horizontal structures of multidisciplinary legal research, which are based on the ontological levels of reality and special scientific interests.
