    This study presents the product warranty, a new element of the Hungarian system of law. The author describes the main features of product warranty in comparison with warranty and product liability. The author states some comments on the regulation. In the end the importance of product warranty is presented by stating a case.

     

    Egy új jogi szabályozás megjelenésekor adott a lehetőség az elméleti és gyakorlati szakemberek számára, hogy a korábbi normaszöveghez történő hasonlítással tárják fel és elemezzék a változásokat. A Polgári Törvénykönyvről szóló 2013. évi V. törvény (Ptk.) nem vitásan érinti a civiljog teljes spektrumát, új elemekkel frissítve a már kialakult magánjogi intézményrendszert. Jelen írás a termékszavatosság szabályainak elemző bemutatására tesz kísérletet.

    A magyar jogi szabályozásban előzmények nélküli jogintézményről van szó, ezért a meghatározó jellemzők bemutatása más, a hibás teljesítéshez kapcsolódó jogintézményekhez történő hasonlítással történik meg. Ennek során a kiindulási alapot a hibás teljesítésből eredő igények „anyajogának” tekinthető kellékszavatosság jelenti, ezen túlmenően a hibás teljesítéssel okozott károk megtérítésére (a továbbiakban: kártérítés), valamint termékfelelősségre vonatkozó szabályok kapnak szerepet.

    A termékszavatosságra vonatkozó rendelkezések a Ptk.-nak a kötelmi jogi szabályokat tartalmazó hatodik könyvében, annak XXIV. fejezetében, a hibás teljesítésre vonatkozó rendelkezéseknél szerepelnek a kellékszavatosságra és kártérítésére vonatkozó szabályokkal együtt. A hibás teljesítésből eredő fogyasztói igények körében további igényérvényesítési lehetőséget teremtő termékfelelősségi szabályok ettől eltérően a szerződésen kívül okozott kárért való felelősséggel szabályai között, a LXXII. fejezetben kaptak helyet.

    Nowadays in these economical hard times it is very important to manage the public money efficiently. On the one hand it is a demand in the memberships countries and in the budget in the Europian Union.  On the other hand it is a requirement from the oridnary people too.

    Actually the Europian Union takes part in the struggle against corruption. In fact the Europian Union has a strategy of struggle against corruption and cheating.  The EU focuses on two fileds of strugggle against corruption, one of both is the budget of EU and the other is the public procurements.

    In this study I am dealing with the strategy of struggle against corruption, the main institutes and the main regulations.

    2010 marked the opening of a new chapter inthe more than 120 years history of the Hungarian order for payment procedure. Breaking with the Hungarian traditions, the notaries became competent to carry out these procedures instead of courts. The Hungarian Chamber of Civil Law Notaries established an accessible web-based computerised system for support of procedures. The registration of requests, the assignment of cases to notaries and the administrative handling of cases are carried out through this electronic network. The legislator’s aims when modified the regulation of this legal instrument was to reduce the duration of order for payment procedures and the workload of courts. In this paper I give an overview of the content of order for payment requests and of the practical experience of the notaries in connection with the examination of requests.

    Hungary lies in the route of the stream of refugees coming from the Balkan. It is a transit country, so the refugees do not typically intend to stay here, they rather wish to travel torwards to West- and North Europe. Particular sections of Hungary's border also mean the external borders of the European Union, the area of freedom, security and justice, which has a common asylum system. Significant part of illegal immigrants presents asylum claim only to avoid the aliens procedures.

    From the 1st of January 2013, the legislature terminated the aliens detention against asylum applicants. From 1st of July 2013 the Hungarian legislature reintroduced the possibility of detention of applicants. The new regulation has been placed in Act LXXX of 2007 on the Right of Asylum, Sections 31/A-31/H by Act XCIII of 2013 on the Amendment of Particular Laws Concerning Law Enforcement. The introduction of asylum-seeker detention and the practice of its application have raised dust. In my essay I am introducing the connections between the reasons of ordering asylum-seeker detention in the Act on Asylum and its backgroud in the EU Directive. I am not dealing with the question of compatibility of asylum detention and human rights and with problematic procedural issues, because I consider it more important to review the substantive conditions of asylum-seeker detention and the certain practical questions of its application therefore I am focusing on this segment of jurisdiction.

    The aim of the current study is to examine the jurisprudence of the European Human Rights Mechanism (hereafter: EHRM), focusing on the three most common issues that indigenous peoples living on the European Continent has to face. First, the modern economic activities, which affect their traditional livelihoods. Second, the difficulties of proving their land claims due to the unwritten nature of their culture. Finally, the threat of relocation, which causes severe problems considering their close links to the traditionally occupied lands. Regarding the first issue the author examines how the EHRM developed its jurisprudence from the initial negative attitude of the European Commission on Human Rights (hereafter: ECHR) – which ceased to exist in 1998 – to the more receptive attitude of the European Court of Human Right (hereafter: ECtHR). The main question regarding the second issue is the ability of the EHRM to accept the laws and traditions of a significantly different society as equal. Until the recent times, the ECtHR – and former ECHR – only accepted written proof as authentic. Last, but not least the author introduces three cases in which indigenous peoples had been removed from their ancient lands,  and have not been allowed to return ever since. Considering their close relation with their lands – which serves as basis of cultural identity for them – the result is devastating.

    Having regard to the above mentioned jurisprudence, three questions arise. First, has the jurisprudence of the EHRM evolved over the years; second – which forecasts the answer for the first question – why does granting effective protection for indigenous peoples still cause problems to the ECtHR? Third, are there any signs of change in the jurisdiction? The answer is complex: the jurisprudence of the ECtHR is definitely evolved; however it still does not reach the level of protection offered by the Inter-American System, which acts as a pioneer on the field of protecting indigenous rights, closely followed by the African System. The attitude of the EHRM is mainly attributable to historical and social reasons creating serious obstacles for the ECtHR. Considering the example of the Inter-American and the African Systems the main question is whether the judges of the ECtHR and the policy makers have the determination to exceed these barriers.

    The doctor-patient relationship requires set rules for liability considering the nature of professional norms on medicine and the protection of human life and health. According to these rules, the healthcare provideris vicariously liable for damages suffered as a consequence of healthcare servicesprovided to the patient. In such cases– on the grounds of labor law rules – the healthcare providermay transfer liability to its employee. Considering recent amendments of labor law regulations, it is essential to summarize and analyze relevant labor law norms relatedto medical liability.

    The employee’s liability for damages is based on the employment relationship between the healthcare provider and the employee. Despite of the healthcare provider’s liability for damages, the employee’s liability is always personal.

    According to the new labor code the employee’s liability for damages is only ascertainable if the tortfeasor did not act like a reasonable person would have actedunder given circumstances. This means that the tortfeasor’sintention or negligence is irrelevant in the course of ascertaining liability. The purpose of our study is to provide a review of the strict measure of due care in health care services, and to summarize rules about the healthcare professional’s liability for damages.
