Hedges beyond the Edge - Overview of Potentials and Risks of Hedge Funds

Therfore, the role of legal regulation is crucial at this field. Avoiding the effect of the afore mentioned regulations is however still intended by many funds that operate all over the world. This paper intends to offer a deeper insight in to the world of hedge funds and the regulatory background. In light of the 2007-2009 financial crisis the topic seems to be evergreen and the future of hedge funds largely depends on the application of the regulatory reforms based on the recent experiences.

Agents and Insiders – The Relationship Between Agency Costs and Insider Trading
54-64Views:255This paper examines insider trading regulation regulations from the viewpoint of agency costs. An overview is given regarding the different definitions of insider trading in jurisprudence which helps establishing the essence of this behaviour. The author also aims to give an insight to the agency problem and agency costs which arise in a business organisation with separate ownership and management. Only through that can be the effects of insider trading demonstrated on agency costs. The article aims to give a balanced overview by enumerating reasons whether insider trading increases or decreases agency costs. If it raises agency costs then prohibition is justified. If it decreases agency costs, e.g. it serves as a more efficient compensation mechanism, then allowing insider trading might be more beneficial.

Le présent et le futur de la réparation dans la procédure pénale hogroise
Views:148A la deuxième moitié du XX ième siècle la victime a commancé á jouer un rôle important de nouveau dans les procédures pénales. Les legislateurs veulent assurer les droit de la victime et garantir qu’elle soit indemnisée le plus tôt possible et pour que tout le monde soit content du résultat.Ce sont les cadres de la juridiction restaurative qui en assurent les possibilités.
Dans cet essai premièrement je présente le cadre de la constitution de partie civile dans la législation hongroise. C’est une procédure très intéressante parce qu’il faut appliquer d’un côté le droit civil et la procédure civile et de l’autre le drot pénal et la procédure pénale dans le cadre de la juridiction pénale (dans une procédure).
J’ai analysé le terme de la victime, les règle appliquables et les décisions du juge. J’ai constaté qu’en Hongrie les tribunaux correctionnels ne délibèrent pas les décisions sur le fond dans les cas de partie civile mais ils renvoient les affaires devant les tribunaux civils.
Ensuite, je présente les institution juridique hongroise qui vise á l’entremise dans la procédure pénale. On peut trouver deux institution juridique en vigeur. En premièr lieu il faut mentionner que dans les cadres de la procédure par constitution de partie civil (où la victime soutient l’accuation) il existe une audition personnelles des parties où le but est donc l’arrangement des parties.
Il y a une autre institution juridique qui s’appelle l’ajournement de la mise en accusation. On peut l’appliquer si la peine ne mérite pas de trois ans de prison et il y a beaucop de circonstances atténuantes, le procureur peut décider l’ajournement de la mise en accusation d’une au deux ans. On peut prévoir différentes obligations et règlements du comportement pour le prévenu. Par example on peut prévoir de dédommager la victime avec l ‘accord des parties. J’ai examiné cette institution juridique et son efficacité dans la pratique aussi.
Troisièmement j’ai analysé une institution juridique qui entrera en vigeur le 1er janvier 2007. C’est la médiation pénale. Il y a un cadre de décision européen (2001/220/IB) qui préconise aux États memnbres d’introduire la médiation pénale. Pour pouvoir appliquer cette institution juridique il faut modifier le Code Pénale et la loi de la procédure pénale. C’est le procureur qui aura le droit de la suspension du procès pour maximum six mois et renvoyer l’affaire devant un méditeur. Cette procédure devant le médiateur sera regie par une loi d’exeption.( Il y a déja une projet de la loi). Je présente les problèmes en relation la médiation pénale. En résumé on peut dire que la mise en place et la régulation de la médiation demandent du temps et de l’énergie. Je statue qu’il faut attendre beaucoup de temps en Hongrie pour que l’opinion publique et les justiciables acceptent et appliquent avec efficacité la médiation pénale.

Some Thoughts on Participation of Civil Organisations in the Process of Policy- and Law Making in Hungary
10-26Views:170Among the tools of including the concerned elements of society into the decision making processes the government operating since 2010 rather prefers the non-legal ones (i.e. those which do not constitute direct obligations for the government); rather solutions outside of the legal system are put into focus. Therefore the so-called national consultation, which – among others, such as sectoral, professional and other negotiating forums – introduced in Hungary a previously unknown political technique: within two years – in ordinary mail – each citizen received two surveys with possible answers to choose from, furthermore, – as a method not really used before in Hungary – an information booklet was sent to all citizens with the right to vote which presented the newest pieces of legislation.
Looking beyond political slogans and pathetic forms it may be well observed that the government expects from the method of crowdsourcing – which may be considered traditional in other countries – as well as from different online consultations and the introduction of new means (surfaces) of information the establishment and deepening of discussion (cooperation) with society. Among the new means of information we shall mention that the government of Hungary created its websites civil.kormany.hu and kozhasznusag.kormany.hu related to the civil sector (in broader sense about legislation related to the civil sector). The websites – according to the intentions of the government– are part of the process of changing the attitude aimed at with the new act on the civil sector (Act CLXXV of 2011 on right of association, non-profit status, operation and support of NGOs), through which the government wishes to establish transparent connections with the civil sector.
In Article 7 of the new Act CXXX of 2010 on legislation the two basic form of social compromise are described, general negotiation and direct negotiation. The former one provides opportunity for sharing opinion on the website of the organisation publishing concepts, drafts (in a way which obliges the organisation which asks for the opinion, e.g. through confirmation obligation or through preparing summaries on the merits), while the latter one allows the concerned minister to directly request persons and organisations to give opinion. A specific form of direct negotiation – creating obligations on the side of the minister – is the institution of strategic partnership, the framework of which is settled in a thorough agreement. One material weakness of the regulation, however, is that Article 13 paragraph (2) of the act only lists in an exemplary way those with whom such partnership may be concluded, by mentioning forms of organisations (e.g. church, trade union, civil organisation). -
Substantive conditions of asylum detention in the light of EU law
21-31Views:159Hungary lies in the route of the stream of refugees coming from the Balkan. It is a transit country, so the refugees do not typically intend to stay here, they rather wish to travel torwards to West- and North Europe. Particular sections of Hungary's border also mean the external borders of the European Union, the area of freedom, security and justice, which has a common asylum system. Significant part of illegal immigrants presents asylum claim only to avoid the aliens procedures.
From the 1st of January 2013, the legislature terminated the aliens detention against asylum applicants. From 1st of July 2013 the Hungarian legislature reintroduced the possibility of detention of applicants. The new regulation has been placed in Act LXXX of 2007 on the Right of Asylum, Sections 31/A-31/H by Act XCIII of 2013 on the Amendment of Particular Laws Concerning Law Enforcement. The introduction of asylum-seeker detention and the practice of its application have raised dust. In my essay I am introducing the connections between the reasons of ordering asylum-seeker detention in the Act on Asylum and its backgroud in the EU Directive. I am not dealing with the question of compatibility of asylum detention and human rights and with problematic procedural issues, because I consider it more important to review the substantive conditions of asylum-seeker detention and the certain practical questions of its application therefore I am focusing on this segment of jurisdiction.

Historical developments of lease
Views:542The mostly economy-inspired legal institution of lease is a relatively new “multidimensional” formation in our law of obligations. Its evolution and development were mostly influenced by economic factors and motivations, which even today determine the intensity of its development. The historical and present day evolution of lease is closely intertwined with the current environment of tax law, accounting and the economy: favourable legal regulation or economic media may result in increased volumes of lease, while an unfavourable legislatorial decision or economic atmosphere may bring setbacks. Historical development in the event of lease is inseparably intertwined with considerations of economics.
The essay intends to provide an overview of the historical development of lease. We would like to present the development stages of lease in Hungary and on an international level. Outlining the historical development of lease, our purpose is to represent business, tax law and accounting impetuses that had a definitive role in the development and propagation of lease.

The legal historical antecedents of the regulation of the preparatory trial and the proposing of evidences in the Hungarian procedural law
67-94Views:176In the hungarian criminal procedure, the preparatory trial is held in the second stage of the criminal procedure, after the investigation and following the accusation, but exactly before the trial. Its elemental purposes are to give a chance for the accused to make an agreement with the court about confessing their culpability and the crimes they committed, otherwise – as it is said in its name – is to give place for the accused and the prosecutor to participate in the preparation for the trial and the proofing before the Court. The general opinion is that both of the preparatory trials’ new functions are unprecedented innovations in the Hungarian criminal procedure. I studied approximately twelve relevant acts, starting with the first Hungarian criminal procedure code from 1896, to examine the history of this legal institute. On this basis I think we are safe to say that, the re-regulation of the preparatory trial brought a significant innovation in the Hungarian Criminal Procedure Code without nearly any history. However, it is important to mention, that – according to my recent researches –, in the older Criminal Procedure Codes some special procedures or rules already appeared which’ had minor similarities to the functions of the preparatory trial today.

Mortgage and credit guarantee registry
15-26Views:247Analyzing th esystem of mortgage we must reach back to the Roman Law. At that era it had been possible to pledge liabilities, rights and moreover aggregated asset, property. Mortgage is a long term institute of Hungarian Private Law as well. Paragraphs 251 – 269 of Act IV of 1959 on the Civil Code of the Republic of Hungary regulates mortgage in the Law of Obligations, placed among collaterals. In the last two decades the old Civil Code of the Republic of Hungary has been modified twice. Act V of 2013on the Civil Code of the Republic of Hungary weakens but definitely rewritten the principles of lending. Regulation of mortgage and the system of chattel mortgage registry has significantly changed. Several novelty has been introduced therefore the system of chattel mortgage registry was reformed too. Detailed regulations of credit guarantee registry in Act CCXXI of 2013 and Act 18/2014. (III. 13.) KIM has also been accepted correspondingly to the previous changes.

Domestic violence

The court as well as the police can call for restraining, which is especially established for preventing the repetition of the domestic violence.
For the treatment of the above mentioned problem there have been founded two models: the Duluth and the Austrian model.
In the memberstates of the European Committee it can be said that the strong front against the domestic violence is quite general, but the regulation is very diverse which means there is no silver bullet in the fight against it.

Discrimination or value creation? – The real value of the wages in the Hungarian public work programme
Views:227The aim of this paper is to scrutinise the wages in the Hungarian public work programme – probably the most controversial anomaly of the Act CVI of 2011 on public work and the modification of the act on public work and other acts. Furthermore, the study analyses the effectivity of the value creation in this programme and exposes the passive sight of the public work.The paper identifies the public work programme as a hybrid contract of the Hungarian labour law and detected the social side of this kind of legal instrument of the active labour market policies. The research also focuses on Order no. 3175/2016 of the Hungarian Constitutional Court and highlights the discriminative dangers of the wages. To emphasize my opinion I set the European Pillar of Social Rights in the middle of the research and concluded that the national regulation is not even enough to create effective reintegration to the primal labour market. In my opinion, to increase the effectivity of this program, we need to use the principles of the Social Pillar and the national labour law system. The conclusion of the paper can be a possible way to highlight the value creation in the public work programme.

The Hungarian system of sanctions in connection with copyright law comparising to directive 2004/48 EC about validation of intellectual property right
Views:193Copyright law is a relative young area of civil law. Intellectual property and creations ensure the revelation of human personality. The infringement of these rights became general with the development of technology. From the beginning copyright law tried not only circumscribe the possibilities of unrestricted use but ensure effective protection to authors with exact sanctions.
In the essay I examine the international and Hungarian regulation against usurpation demonstrating all sanctions and opportunities. Not only one area of law gives protection to these rights. Civil law, criminal law and administration law has different sanctions for infringements.
On 29th April 2004 2004/48/EC directive has been accepted about validation of intellectual property rights. The explanation of this directive is that different regulations in member states endanger the unified internal market. The directive consists of the rules of proceedings and sanctions.
In this study I present the development about system of sanctions form an international and from a Hungarian perspective. I examine all types of sanctions concerning to the field of civil law and try to analyze functions and aims in connection with them. The effectiveness and history of these legal institutions are also presented in the study.
Comparing the directive and the Hungarian copyright law it can be said that despite of all circumstances the Hungarian law has to be improved especially on the field of proceedings and temporary arrangements. These rules are specified compared to the ones in the Hungarian civil procedure, so judges have to take care of these differences.

The legal consequences of the unlawful termination of the employment relationship by the employer in the light of Act I of 2012 on the Labor Code
125-144Views:265Highlighting the consequences of the illegal termination of the employment by the employer, the thesis presents its recent short historical background, development direction, current regulation – mainly the Act I of 2012 on the Labor Code (Mt.) 82. § (1), (2) and (4)
paragraphs –, especially the practical application of the judicial experience accumulated over more than ten years. The thesis covers the legal basis of the labor law claims presented against the employer's decisions in question, as well as the summativeness of the issues, calling for help the case decisions of the higher courts, i.e. either the judgment boards or the Kúria, made in similar matters, which can be considered as guidelines in the application of the law. -
Unilateral determination of working time in the effective regulations of labor law
63-80Views:330In most cases, law does not differentiate between various people in equal-level positions of a contract; during sales, the State has the same rights and obligations as the contracting private person. Labor law is a specific field of law where one of the parties that are theoretically on equal level – i.e. the employee – is actually in a somewhat subordinated and obviously more exposed position. In the light of the foregoing, it is especially notable that there are some fields of labor right where the third way applies; parties are not equally positioned in terms of power; however, it is not the employee who gets legal assistance for the equality of opportunities, but the law itself supports their disadvantaged position. Such situation is called the legal situation of unilateral power, and we aim to study to what extent it is present in Hungarian labor law and how advantageous or disadvantageous this it to the parties. The field of law where one is likely to detect the traces of unilateral power is the legal regulation related to working time, which, therefore, is the subject of this study, and the definition of working time will hereinafter be looked into from the aspect of the employer’s unilateral right to establish employment. Unilateral power is basically not typical to be enforced in labor law, and therefore, working time-related regulations – that belong to the employer’s own discretion – form an exception in such respect. At the same time, the option of flexible work order provides an exception from the superiority of unilateral power, and therefore it is actually an exception to the exception. Such complex system, however, provides the option to make sure whether the enforcement of unilateral power is constructive in labor law, or it would be more reasonable to apply a more balanced system such as the principle of the employer’s ultima ratio as suggested by Guy Davidov. While noting that according to those described above, flexible work order poses some potential risks, too, in our opinion, it would be more efficient and social to set up a consensus-based system, which would also allow us to satisfy our obligation of European Union legal harmonization. Hungarian legislation, and labor law legislation in particular has numerous tasks to do in order to promote the solution of socio-economic problems, as well as to fulfill our obligations related to legal harmonization; in our opinion, the conclusions above confirm that making working time regulations more liberal is one of the major tasks of legislation.

The special requirements applicable to the management of national assets, with a special respect to the requirement of transparency
85-96.Views:306The Fundamental Law of Hungary states that the property of the Hungarian State and of municipal governments shall be considered national assets. National assets shall be managed and protected for the purpose of serving the public interest, satisfying common needs and preserving natural resources, taking also into account the needs of future generations. Economic operators – such as companies - owned by the State or municipal governments shall conduct business prudently and independently, in accordance with the relevant legislation, under the requirements of legality, efficiency and effectiveness. The special requirements regarding the management and safeguarding are laid down in Act CXCVI of 2011 on National Assets (hereinafter: National Assets Act) and Act CVI of 2007 on State Property (hereinafter: State Property Act) also contains a few requirements in its preamble.
Based on the above, national assets shall be managed and protected in a special way, compared to privately owned assets. Publicly owned enterprises play a very important role in the national economy, since they provide a significant amount of GDP, they employ numerous people, they usually provide public services and last but not least they manage public funds. As a consequence, these companies shall also manage their assets with respect to the special requirements. In our article, we introduce these requirements by examining their content and also their relationship towards each other.
One of the most important requirements is transparency, since these enterprises manage public funds and according to the Fundamental Law, every organization managing public funds shall publicly account for the management of those funds. Public funds and national assets shall be managed according to the principles of transparency and of corruption-free public life. Data relating to public funds or to national assets shall be recognized as data of public interest. We lay a special emphasis on transparency by introducing the relating regulation and also by summarizing the most prominent statements of court decisions from the last few years. In their judgements the courts interpreted the requirement of transparency in connection with state-owned enterprises and the relationship between transparency and the protection of business secrets and business interests of the companies.

Consumer insolvency in the European Union
153-163Views:223Almost all modern civil legal systems respect property rights as a privileged and fundamental right, which means the property rights of individuals cannot be restricted or taken away without due process of law. In the case of insolvency proceedings, the person's right to property is violated, as the debtor is deprived of this right, at least partially. In such situations, the property rights of the debtor and the creditor are strained against each other, even to such level that the debtor's livelihood and alimentation is threatened by the satisfaction of the creditor's demands. During insolvency proceedings, we should restore the property rights relationship that was broken on the part of the creditor as a result of the debtor's behavior at the expense of the debtor's assets, ensuring that the debtor's interests are also protected, and that the proceedings take into account the interests of both parties. National lawmakers should, therefore, take several aspects into account to create the material and procedural legislation on the basis of which property of private individuals can also be subject to insolvency proceedings. Lawmakers should act in an environment where, due to the impact of globalization, it is no longer evident that the debtor and the creditor are citizens of the same country. This is the reason it is also important to examine how the European Union regulates insolvency proceedings in the case of consumer over-indebtedness in a manner that crosses national borders and still remains inside the Union.

Questions around prescription by title
81-89Views:495In this paper I am willing to introduce different aspects of the new institution of the Hungarian civil law, the so-called prescription by title. This young way of acquiring property was a novelty in the field of law and jurisprudence, and a novelty for entities as well. The law of property contains the most important and fundamental rules of private law, this is the reason why it is always ultimately important that the legislator and the exact purpose of the legislation has to be as clearly defined as possible, since this is what ensures the security of property transactions and guarantees the freedom and protection of one of the most ancient social institutions, property. By its unique nature, prescription has always been the subject of legal disputes, thus the arguments above are cumulative.
The aim of this paper is to present the regulation of prescription by title, its dogmatic features, draw parallels with its ancestor in Hungarian legal history and an unusual foreign example, examine some relevant aspects of judicial practice and finally attempt to compose a possible alternative regulatory technique.

Periodic Property in the Regulation of the Romanian Civil Code

A tulajdonjog részjogosítványai nem feltétlenül egyformán és egyidejűleg gyakorolhatók. A tulajdon részjogosítványai közül a birtoklás annak ellenére folyamatosnak tekinthető, hogy egymást követő időszakok, szünetek vannak az ingóságok használatában.
Külön fejezetben kerül bemutatásra az időszakos tulajdon fogalma, meghatározása.
Az időszakos tulajdon több módon is keletkezhet, így megállapodással vagy végrendeleti örökléssel. Bemutatásra kerül, hogyan gyakorolhatja a tulajdonos ebben a tulajdonosi formában a tulajdoni részjogosítványokat. A polgári perrel kapcsolatos szabályok körében ismerhetjük meg a jogviták elrendezési lehetőségeit, így a társtulajdonos kérheti a közös tulajdon megszüntetését, de pénzbeli kompenzációt is követelhet a társtulajdonostól.

Possibilities of workplace mediation in the European Union
1-13.Views:535The world of labor market and industrial relations is a field where conflicts and disputes are inevitable characteristics of the operation, regardless of the form of employment. Also, labor disputes appear both from an individual aspect, where the disputants are the employer and the employee, and in a collective respect, where the disputes take place between the employer(s) and the collective of the workers, typically represented by an employee organization (union) or a works council.
When a conflict or a dispute cannot be resolved through negotiation, the law offers dispute resolution mechanisms for the participants. Therefore, several legal mechanisms have been evolved in order to resolve disputes, starting from the classical form of litigation, where a court determines the end of the dispute by its judgement, and other alternative forms of dispute resolution, such as arbitration, mediation and conciliation, where the parties can reach a decision or a settlement outside of the judicial system of the state.
EU Member States have introduced various legislative rules for labor dispute resolution covering all manner of individual and collective disputes. ADR schemes are also supported by the ILO, as the ILO Recommendation No. 92 (1951) suggests that voluntary conciliation should be made available to assist in the prevention and settlement of industrial disputes between employers and workers. Within the aegis of the European Union, several instruments have emerged with the attempt to elaborate the basic principles for the operation of ADR schemes in the context of cases between businesses and consumers. The Directive 2013/11/EU on alternative dispute resolution for consumer disputes (the “ADR Directive”) and Regulation (EU) No 524/2013 on online dispute resolution for consumer disputes (the “ODR Regulation”) ensured that consumers could turn to quality alternative dispute resolution entities for all kinds of contractual disputes with traders, and established an EU-wide online platform for consumer disputes that arise from online transactions with traders.
Workplace mediation is widely and successfully utilized in the USA for solely employment purposes both in the private and the public sector. Also, in the United States is a “employment at will” doctrine prevails, that basically means – unless stipulated to the contrary by the parties – the employment relationship can be terminated with immediate effect without any justification (just cause), thus workers do not have access to legal remedies as in the EU where the statutory laws provide a broad protection against arbitrary or unjust termination. Mediation, however, provide an effective solution for employees and workers, even if situated outside the protective scope of labor law.
While the role of customer/consumer ADR and mediation is increasing throughout the whole European Union, workplace and employment mediation still constitutes a “grey zone”. In many of the legal instruments of the EU and also in several products of the national legislations, consumers and workers are treated with the same legal awareness, thus protective laws compensate their weaker position in their legal relationships, but as far as the utilization and access of dispute resolution schemes are concerned, a significant but not always reasonable differentiation can be detected. Also, while mediation is an available tool for individual employment matters, still has not been utilized considerably, and remained an instrument only to resolve mostly collective conflicts. Therefore, the aim of this paper to present various styles of mediations from a comparative perspective, to express their biggest advantages and to highlight the areas where mediation could be more suitable to use in the context of the individual disputes of the workplace.

Validation of the claim for paid leave
127-152Views:206The study covers the most important rules regarding leave, with the aim of helping employees and employers deepen their knowledge of how to grant leave. In this context, the study covers what should be done with leave not granted until the end of the year, whether the economic interest of the employer can justify its interruption, whether and when it can be redeemed for money, and how long the request in this direction can be asserted, i.e. when it occurs the statute of limitations. Furthermore, it covers what the solution is in the event of the termination of the employment relationship, when the employee has taken less or even more leave than he or she would have been entitled to in proportion to the time, focusing on who needs to prove what to successfully enforce the claim, and what is the importance of it the employer's registration obligation. In addition to the European Union and domestic regulation of freedom, the study included some guiding decisions of the Court of Justice of the European Union and the Curia, on the basis of which the conclusion can be drawn that the courts try to give the correct interpretation of the legislation in the individual cases that come before them, which are precedents due to their nature, they are also binding in other matters.

Prevailing regulation of the termination of parental control under the Civil Code
12-18Views:311Being a judge practicing on the area of the law of crimes I rarely come across with the need to apply civil law. Nevertheless, a handful legal concepts may be applied also by criminal courts. One of these concepts is the termination of parental control. Before turning to relevant case analysis in my study, I focus on the principle of the "child's best interest" which is referred to under article 3 of the New York Convention on the rights of children and which has a general fundamental applicability in respect of all provisions of the Convention. This principle must apply not only in civil, but also in criminal proceedings and generally in all types of proceedings irrespective of the area of law such proceedings fall under. Special emphasis is attributed to the legal consequences of terminating parental control and to the distinction of cases where the termination of parental control by the court is mandatory and where such a decision is made in the discretion of the court. I pay separate attention to cases where the court has convicted the parent of a crime committed wilfully against the convicted person's own child and in which cases the convicted person is sentenced to prisonment and as a result of these the criminal court has competence to order the termination of parental control. I address also some issues relating to matters of proof and evidence in connection with crimes of domestic violence. Finally, I explain the nature of a child-focused jurisdiction through the presentation of the Hungarian system which ensures to respect and to give effect to the rights of children to the maximum extent possible. The ability of providing special treatment for children in court proceedings is of the utmost importance.

Fragmentation and changes in Hungarian succession law
81-103Views:394The right to inherit is recognized in the Fundamental Law, the detailed substantive legal rules are laid down in the Seventh Book of the Civil Code. In recent years, the legislator has formulated rules of substantive succession in other legislation beyond our private law code (the Civil Code). According to the Registered Partnership Act, the rules applicable to the spouse apply mutatis mutandis to the registered partner, which means that the registered partner is also a legal heir. The special rules for the acquisition of ownership of agricultural and forestry land by succession by will are laid down in the Land Traffic Act (Act CXXII of 2013). On 1 January 2023, a new law will enter into force (Act CXLIII of 2021), which will supplement the succession law provisions of the Civil Code in the case of joint legal intestate succession of undivided common ownership of agricultural land by several heirs. The designation of a public body to represent the State in succession matters is provided for in a separate ministerial decree. The present article analyzes how all these complex, fragmented regulations make it difficult to enforce the law and the extent to which it hinders the speedy execution of probate proceedings. The present article criticizes the fragmented regulation and proposes the integration of the rules of the separate laws into the Civil Code, as this could contribute to a more efficient application of the law.
